77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the assignment of public school students enrolled in
1010 certain school districts to an uncertified teacher.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 7.056(e), Education Code, is amended to
1313 read as follows:
1414 (e) Except as provided by Subsection (f), a school campus or
1515 district may not receive an exemption or waiver under this section
1616 from:
1717 (1) a prohibition on conduct that constitutes a
1818 criminal offense;
1919 (2) a requirement imposed by federal law or rule,
2020 including a requirement for special education or bilingual
2121 education programs; or
2222 (3) a requirement, restriction, or prohibition
2323 relating to:
2424 (A) essential knowledge or skills under Section
2525 28.002 or high school graduation requirements under Section 28.025;
2626 (B) public school accountability as provided by
2727 Subchapters B, C, D, and J, Chapter 39, and Chapter 39A;
2828 (C) extracurricular activities under Section
2929 33.081 or participation in a University Interscholastic League
3030 area, regional, or state competition under Section 33.0812;
3131 (D) health and safety under Chapter 38;
3232 (E) purchasing under Subchapter B, Chapter 44;
3333 (F) elementary school class size limits, except
3434 as provided by Section 25.112;
3535 (G) removal of a disruptive student from the
3636 classroom under Subchapter A, Chapter 37;
3737 (H) at-risk programs under Subchapter C, Chapter
3838 29;
3939 (I) prekindergarten programs under Subchapter E,
4040 Chapter 29;
4141 (J) educator rights and benefits under
4242 Subchapters A, C, D, E, F, G, and I, Chapter 21, or under Subchapter
4343 A, Chapter 22;
4444 (K) special education programs under Subchapter
4545 A, Chapter 29;
4646 (L) bilingual education programs under
4747 Subchapter B, Chapter 29; [or]
4848 (M) the requirements for the first day of
4949 instruction under Section 25.0811; or
5050 (N) assignment of a student to a teacher under
5151 Section 28.0215, except as provided by Subsection (c) of that
5252 section.
5353 SECTION 2. Subchapter B, Chapter 28, Education Code, is
5454 amended by adding Section 28.0215 to read as follows:
5555 Sec. 28.0215. REQUIREMENTS FOR ASSIGNMENT OF STUDENTS TO
5656 TEACHERS. (a) This section applies only to a school district with
5757 an enrollment of 5,000 or more students.
5858 (b) A student in first through sixth grade who attends an
5959 elementary school may not be assigned for two consecutive school
6060 years to a teacher teaching a subject in the foundation curriculum
6161 under Section 28.002(a)(1) who has less than one year of teaching
6262 experience and who does not hold the appropriate certificate
6363 required under Section 21.003 unless:
6464 (1) the student's parent or other person standing in
6565 parental relation to the student and a school counselor or school
6666 administrator agree otherwise regarding assignment of the student
6767 to the teacher; or
6868 (2) the assignment of the student to the teacher
6969 occurs during the first year a student transfers into a school
7070 district.
7171 (c) The commissioner may grant a waiver from the
7272 requirements of this section to a school district if the
7373 commissioner finds that extreme circumstances in the district
7474 warrant the waiver. The commissioner may adopt rules as necessary
7575 to implement this section.
7676 SECTION 3. This Act applies beginning with the 2025-2026
7777 school year.
7878 SECTION 4. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2025.
