77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the creation of the criminal offense of residential
1010 picketing.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 42.04(a) and (c), Penal Code, are
1313 amended to read as follows:
1414 (a) If conduct that would otherwise violate Section
1515 42.01(a)(5) (Unreasonable Noise), 42.03 (Obstructing Passageway),
1616 [or] 42.055 (Funeral Service Disruptions), or 42.056 (Residential
1717 Picketing) consists of speech or other communication, of gathering
1818 with others to hear or observe such speech or communication, or of
1919 gathering with others to picket or otherwise express in a
2020 nonviolent manner a position on social, economic, political, or
2121 religious questions, the actor must be ordered to move, disperse,
2222 or otherwise remedy the violation prior to the actor's [his] arrest
2323 if the actor [he] has not yet intentionally harmed the interests of
2424 others which those sections seek to protect.
2525 (c) It is a defense to prosecution under Section
2626 42.01(a)(5), 42.03, [or] 42.055, or 42.056:
2727 (1) that in circumstances in which this section
2828 requires an order no order was given;
2929 (2) that an order, if given, was manifestly
3030 unreasonable in scope; or
3131 (3) that an order, if given, was promptly obeyed.
3232 SECTION 2. Chapter 42, Penal Code, is amended by adding
3333 Section 42.056 to read as follows:
3434 Sec. 42.056. RESIDENTIAL PICKETING. (a) In this section:
3535 (1) "Dwelling" means any structure or part of a
3636 structure that is occupied as, or designed or intended for
3737 occupancy as, a residence by one or more individuals.
3838 (2) "Picketing" means:
3939 (A) standing, sitting, or repeated walking,
4040 riding, driving, or other similar action by a person displaying or
4141 carrying a banner, placard, or sign;
4242 (B) engaging in loud singing, chanting,
4343 whistling, or yelling, with or without noise amplification through
4444 a device such as a bullhorn or microphone; or
4545 (C) blocking access to a dwelling.
4646 (b) A person commits an offense if the person engages in
4747 picketing before or about the dwelling of any individual with the
4848 intent to harass or disturb the individual in the individual's
4949 dwelling.
5050 (c) An offense under this section is a Class B misdemeanor.
5151 (d) If conduct constituting an offense under this section
5252 also constitutes an offense under another law, the actor may be
5353 prosecuted under this section, the other law, or both.
5454 SECTION 3. This Act takes effect September 1, 2025.
