77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to weight limitations for hydrogen-fueled motor vehicles.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 621.101, Transportation Code, is amended
1212 by adding Subsection (b-2) to read as follows:
1313 (b-2) Notwithstanding any other provision of this section,
1414 a vehicle or combination of vehicles that is powered by an engine
1515 fueled primarily by hydrogen may exceed any weight limitation under
1616 this section by an amount that is equal to the difference between
1717 the weight of the vehicle attributable to the hydrogen tank and
1818 fueling system carried by that vehicle and the weight of a
1919 comparable diesel tank and fueling system, provided that the
2020 maximum gross weight of the vehicle or combination of vehicles may
2121 not exceed 82,000 pounds.
2222 SECTION 2. (a) Except as otherwise provided by this
2323 section, this Act takes effect September 1, 2025.
2424 (b) This Act takes effect only if the United States Congress
2525 enacts legislation or a federal agency adopts a regulation that
2626 becomes law authorizing a vehicle that is powered by an engine
2727 fueled primarily by hydrogen to be operated on a federal interstate
2828 or highway at a weight that exceeds a weight limitation established
2929 by federal law. If the United States Congress or a federal agency
3030 does not enact legislation or adopt a regulation that becomes law
3131 described by this subsection, this Act has no effect.
