| 9 | 9 | | relating to weight limitations for hydrogen-fueled motor vehicles. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 621.101, Transportation Code, is amended |
|---|
| 12 | 12 | | by adding Subsection (b-2) to read as follows: |
|---|
| 13 | 13 | | (b-2) Notwithstanding any other provision of this section, |
|---|
| 14 | 14 | | a vehicle or combination of vehicles that is powered by an engine |
|---|
| 15 | 15 | | fueled primarily by hydrogen may exceed any weight limitation under |
|---|
| 16 | 16 | | this section by an amount that is equal to the difference between |
|---|
| 17 | 17 | | the weight of the vehicle attributable to the hydrogen tank and |
|---|
| 18 | 18 | | fueling system carried by that vehicle and the weight of a |
|---|
| 19 | 19 | | comparable diesel tank and fueling system, provided that the |
|---|
| 20 | 20 | | maximum gross weight of the vehicle or combination of vehicles may |
|---|
| 21 | 21 | | not exceed 82,000 pounds. |

| 22 | 22 | | SECTION 2. (a) Except as otherwise provided by this |
|---|
| 23 | 23 | | section, this Act takes effect September 1, 2025. |
|---|
| 24 | 24 | | (b) This Act takes effect only if the United States Congress |
|---|
| 25 | 25 | | enacts legislation or a federal agency adopts a regulation that |
|---|
| 26 | 26 | | becomes law authorizing a vehicle that is powered by an engine |
|---|
| 27 | 27 | | fueled primarily by hydrogen to be operated on a federal interstate |
|---|
| 28 | 28 | | or highway at a weight that exceeds a weight limitation established |
|---|
| 29 | 29 | | by federal law. If the United States Congress or a federal agency |
|---|
| 30 | 30 | | does not enact legislation or adopt a regulation that becomes law |
|---|
| 31 | 31 | | described by this subsection, this Act has no effect. |
