| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Section 28.02(d), Penal Code, is amended to read | |
| 13 | 13 | as follows: | |
| 14 | 14 | (d) An offense under Subsection (a) is a felony of the | |
| 15 | 15 | second degree, except that the offense is a felony of the first | |
| 16 | 16 | degree if it is shown on the trial of the offense that: | |
| 17 | 17 | (1) bodily injury or death was suffered by any person | |
| 18 | 18 | by reason of the commission of the offense; or | |
| 19 | 19 | (2) the property intended to be damaged or destroyed | |
| 20 | 20 | by the actor was a: | |
| 21 | 21 | (A) government building; | |
| 22 | 22 | (B) habitation; or | |
| 23 | 23 | (C) [a] place of assembly or worship. | |
| 24 | 24 | SECTION 2. The change in law made by this Act applies only | |
| 25 | 25 | to an offense committed on or after the effective date of this Act. | |
| 26 | 26 | An offense committed before the effective date of this Act is | |
| 27 | 27 | governed by the law in effect on the date the offense was committed, | |
| 28 | 28 | and the former law is continued in effect for that purpose. For | |
| 29 | 29 | purposes of this section, an offense was committed before the | |
| 30 | 30 | effective date of this Act if any element of the offense occurred | |
| 31 | 31 | before that date. | |
| 32 | 32 | SECTION 3. This Act takes effect September 1, 2025. |
