88 AN ACT
99 relating to recognizing persons who separated from military service
1010 solely on the basis of sexual orientation as honorably discharged
1111 veterans under state law.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 434, Government Code, is amended by
1414 adding Subchapter J to read as follows:
1515 SUBCHAPTER J. BENEFITS, RIGHTS, PRIVILEGES, AND IMMUNITIES OF
1616 CERTAIN VETERANS
1717 Sec. 434.451. DEFINITIONS. In this subchapter:
1818 (1) "Active military service" has the meaning assigned
1919 by Section 437.001.
2020 (2) "DD Form 214" means any edition of United States
2121 Department of Defense Form 214 (Certificate of Release or Discharge
2222 from Active Duty).
2323 (3) "Military discharge record" means a document
2424 issued to a service member of the armed forces of the United States
2525 or the Texas military forces showing the service member's release
2626 or discharge from active military service. The term includes DD
2727 Form 214.
2828 (4) "Separation code" means:
2929 (A) an alphanumeric code found in block 26 of the
3030 edition of DD Form 214 dated August 2009; or
3131 (B) a numeric code commonly known as a separation
3232 program code used on a previous edition of DD Form 214.
3333 Sec. 434.452. CERTAIN PERSONS CONSIDERED HONORABLY
3434 DISCHARGED. (a) The State of Texas recognizes a person as having
3535 been honorably discharged from active military service if:
3636 (1) according to the person's military discharge
3737 record, the person on the basis of the person's sexual orientation:
3838 (A) was dishonorably discharged; or
3939 (B) resigned, retired, or otherwise separated
4040 from active military service; and
4141 (2) based on any previous characterization of service,
4242 the person would have otherwise received a more favorable character
4343 of discharge.
4444 (b) For purposes of Subsection (a)(1), a person is
4545 considered to have been dishonorably discharged or to have
4646 resigned, retired, or otherwise separated from active military
4747 service on the basis of the person's sexual orientation if:
4848 (1) any of the following separation codes appear on
4949 the person's DD Form 214 and represent a ground on which the person
5050 was released or discharged from the armed forces of the United
5151 States:
5252 (A) BLC;
5353 (B) BML;
5454 (C) BRA;
5555 (D) BRB;
5656 (E) BRC;
5757 (F) DLC;
5858 (G) GKC;
5959 (H) GLC;
6060 (I) GML;
6161 (J) GRA;
6262 (K) GRB;
6363 (L) GRC;
6464 (M) HLC;
6565 (N) HRA;
6666 (O) HRB;
6767 (P) HRC;
6868 (Q) HWL;
6969 (R) JB;
7070 (S) JJB;
7171 (T) JKC;
7272 (U) JLC;
7373 (V) JML;
7474 (W) JRA;
7575 (X) JRB;
7676 (Y) JRC;
7777 (Z) KRA;
7878 (AA) KRB;
7979 (BB) KRC;
8080 (CC) RA;
8181 (DD) RC;

9191 (2) any other ground for release or discharge from
9292 active military service based on sexual orientation, including a
9393 predecessor or successor to a separation code listed in Subdivision
9494 (1), appears on the person's military discharge record.
9595 Sec. 434.453. ENTITLEMENT TO BENEFITS, RIGHTS, PRIVILEGES,
9696 AND IMMUNITIES. Notwithstanding any other law, a person recognized
9797 as having been honorably discharged under Section 434.452(a) is
9898 entitled to all benefits, rights, privileges, and immunities
9999 provided by this state or under state law to an honorably discharged
100100 veteran.
101101 Sec. 434.454. PROOF OF CERTAIN DISCHARGE. For purposes of
102102 this subchapter, an agency or officer of this state shall accept a
103103 copy of a person's DD Form 214 identified or commonly known as
104104 "Service 2 Copy" or "Member 4 Copy."
105105 SECTION 2. This Act takes effect September 1, 2025.
