77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a municipality to remove territory
1010 from an emergency services district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 775.022, Health and Safety Code, is
1313 amended by adding Subsection (h) to read as follows:
1414 (h) The authority of a municipality to remove territory from
1515 a district and be the sole provider of emergency services to the
1616 territory under this section expires September 1, 2025.
1717 SECTION 2. Section 8437.002(d), Special District Local Laws
1818 Code, is amended to read as follows:
1919 (d) Notwithstanding Section 775.022(h), Health and Safety
2020 Code, Sections 775.022(b), (c), (d), (e), (e-1), and (f), Health
2121 and Safety Code, apply to a disannexation under this section, as if
2222 the disannexation occurred under the provisions of Section
2323 775.022(a), Health and Safety Code.
2424 SECTION 3. Section 9036.002(d), Special District Local Laws
2525 Code, is amended to read as follows:
2626 (d) Notwithstanding Section 775.022(h), Health and Safety
2727 Code, Sections 775.022(b), (c), (d), (e), (e-1), and (f), Health
2828 and Safety Code, apply to a disannexation under this section, as if
2929 the disannexation occurred under the provisions of Section
3030 775.022(a), Health and Safety Code.
3131 SECTION 4. Section 9042.002(d), Special District Local Laws
3232 Code, is amended to read as follows:
3333 (d) Notwithstanding Section 775.022(h), Health and Safety
3434 Code, Sections 775.022(b), (c), (d), (e), (e-1), and (f), Health
3535 and Safety Code, apply to a disannexation under this section, as if
3636 the disannexation occurred under the provisions of Section
3737 775.022(a), Health and Safety Code.
3838 SECTION 5. Section 49.353(d), Water Code, is amended to
3939 read as follows:
4040 (d) Notwithstanding Section 775.022(h), Health and Safety
4141 Code, if [If] a district enters into a strategic partnership
4242 agreement with a municipality that includes the provision of
4343 fire-fighting services under this section, the territory of the
4444 district annexed by the municipality for limited purposes and to be
4545 served by the municipality under the agreement shall be disannexed
4646 from the emergency services district in the manner provided by
4747 Section 775.022, Health and Safety Code, for territory that is
4848 annexed by a municipality for full purposes.
4949 SECTION 6. Section 775.0235, Health and Safety Code, is
5050 repealed.
5151 SECTION 7. This Act takes effect September 1, 2025.
