| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subtitle F, Title 4, Government Code, is amended |
|---|
| 14 | 14 | | by adding Chapter 483 to read as follows: |
|---|
| 15 | 15 | | CHAPTER 483. Texas Advanced Nuclear and Innovative Energy |
|---|
| 16 | 16 | | Technologies Act |
|---|
| 17 | 17 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 18 | 18 | | Sec. 483.001. DEFININTIONS. In this chapter: |
|---|
| 19 | 19 | | (1) "Advanced nuclear reactor" means a range of proven |
|---|
| 20 | 20 | | and innovative nuclear reactor technologies. |
|---|
| 21 | 21 | | (2) "Advanced nuclear reactor fuel" means fuel for use |
|---|
| 22 | 22 | | in an advanced nuclear reactor or a research and test reactor. |
|---|
| 23 | 23 | | (3) "Commission" means the Public Utility Commission |
|---|
| 24 | 24 | | of Texas. |
|---|
| 25 | 25 | | (4) "Office" means the Texas Advanced Nuclear and |
|---|
| 26 | 26 | | Innovative Energy Technologies Office. |
|---|
| 27 | 27 | | SUBCHAPTER B. TEXAS ADVANCED NUCLEAR AND INNOVATIVE ENERGY |

| 29 | 29 | | Sec. 483.101. (a) The Texas Advanced Nuclear and |
|---|
| 30 | 30 | | Innovative Energy Technologies Office is an office within the |
|---|
| 31 | 31 | | office of the Governor. |
|---|
| 32 | 32 | | (b) The purpose of the office is to support the development |
|---|
| 33 | 33 | | and deployment of advanced nuclear and innovative energy |
|---|
| 34 | 34 | | technologies in this state. |
|---|
| 35 | 35 | | SUBCHAPTER C. TEXAS ADVANCED NUCLEAR AND INNOVATIVE ENERGY |

| 36 | 36 | | TECHNOLOGIES FUND |
|---|
| 37 | 37 | | Sec. 483.201. (a) The Texas Advanced Nuclear and |
|---|
| 38 | 38 | | Innovative Energy Technologies Fund is created as a dedicated |
|---|
| 39 | 39 | | account within the general revenue fund administered by the office |
|---|
| 40 | 40 | | and used for the purposes authorized by this chapter. The fund |
|---|
| 41 | 41 | | consists of: |
|---|
| 42 | 42 | | (1) gifts, grants, or donations to the fund; and |
|---|
| 43 | 43 | | (2) money from any other source designated by the |
|---|
| 44 | 44 | | legislature. |
|---|
| 45 | 45 | | (b) The office shall provide the commission with |
|---|
| 46 | 46 | | information regarding grant recipients and funded projects. The |
|---|
| 47 | 47 | | commission shall plan for the use of advanced nuclear reactors in |
|---|
| 48 | 48 | | this state. |
|---|
| 49 | 49 | | Sec. 483.202. TIER 1 PROJECT DEVELOPMENT PROGRAM. (a) |
|---|
| 50 | 50 | | Using money in the fund established in section 483.201, the office |
|---|
| 51 | 51 | | may reimburse qualifying expenses associated with the early |
|---|
| 52 | 52 | | development and siting activities of an advanced nuclear project in |
|---|
| 53 | 53 | | this state. |
|---|
| 54 | 54 | | Sec. 483.203. TIER 2 PROJECT CONSTRUCTION PROGRAM. (a) |
|---|
| 55 | 55 | | Using money in the fund established in section 483.201, the office |
|---|
| 56 | 56 | | may reimburse qualifying expenses associated with the construction |
|---|
| 57 | 57 | | of an advanced nuclear reactor project in this state |
|---|
| 58 | 58 | | SECTION 2. This Act takes effect September 1, 2025. |
|---|
