88 AN ACT
99 relating to the prohibition of certain housing discrimination
1010 related to brokerage services.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 301.027, Property Code, is amended to
1313 read as follows:
1414 Sec. 301.027. BROKERAGE SERVICES. (a) A person may not
1515 deny another access to, or membership or participation in, a
1616 multiple-listing service, real estate brokers' organization, or
1717 other service, organization, or facility relating to the business
1818 of selling or renting dwellings, or discriminate against a person
1919 in the terms or conditions of access, membership, or participation
2020 in such an organization, service, or facility because of race,
2121 color, religion, sex, disability, familial status, or national
2222 origin.
2323 (b) For purposes of this section, the initiation of an
2424 ethics complaint against a person in relation to speech involving a
2525 matter of public concern or religion is included in the meaning of
2626 discrimination in the terms or conditions of membership.
2727 SECTION 2. The change in law made by this Act applies only
2828 to a complaint filed with the Texas Workforce Commission civil
2929 rights division on or after the effective date of this Act. A
3030 complaint filed before that date is governed by the law as it
3131 existed immediately before the effective date of this Act, and that
3232 law is continued in effect for that purpose.
3333 SECTION 3. This Act takes effect September 1, 2025.
