9	9	relating to strategies to address homelessness and affordable
10	10	housing in certain counties, including the repurposing of land
11	11	located in those counties, the use of certain tax revenue
12	12	attributable to that land, and building restrictions in certain
13	13	municipalities.
14	14	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	15	SECTION 1. Section 3151.002, Government Code, is amended to
16	16	read as follows:
17	17	Sec. 3151.002. DEFINITION OF CAPITOL VIEW CORRIDOR. In
18	18	this chapter, "Capitol view corridor" means:
19	19	(1) the South Mall of The University of Texas
20	20	Corridor, which encompasses all of the area between two lines:
21	21	(A) one of which begins at an elevation of 594
22	22	feet above sea level at Texas Plane Coordinate X-2818794.86,

450	450	SECTION 2. Section 3151.053, Government Code, is amended to
451	451	read as follows:
452	452	Sec. 3151.053. CONFLICT WITH OTHER REQUIREMENTS. (a)
453	453	Except as provided by Subsection (b), if [If] a requirement of this
454	454	chapter conflicts with a requirement enacted by a municipality or
455	455	with any other requirement under state law, the stricter
456	456	requirement prevails.
457	457	(b) A municipality may not enact a building restriction
458	458	related to the view of the Capitol other than the Capitol view
459	459	corridors provided under Section 3151.002.
460	460	SECTION 3. Title 7, Government Code, is amended by adding
461	461	Chapter 795 to read as follows:
462	462	CHAPTER 795. AFFORDABLE HOUSING BOARD
463	463	Sec. 795.001. DEFINITIONS. In this chapter:
464	464	(1) "Capitol view corridor" has the meaning assigned
465	465	by Section 3151.002.
466	466	(2) "Eligible county" means a county in which a
467	467	Capitol view corridor is located.
468	468	(3) "Eligible taxing unit" means a taxing unit that
469	469	imposes an ad valorem tax on real property located in a former
470	470	Capitol view corridor.
471	471	(4) "First responder" has the meaning assigned by
472	472	Section 78A.001, Civil Practice and Remedies Code.
473	473	(5) "Former Capitol view corridor" means a Capitol
474	474	view corridor described by Sections 3151.002(10), (12), (14), (15),
475	475	and (17), as those subdivisions existed on January 1, 2025.
476	476	(6) "Tax increment base" is the total taxable value of
477	477	all real property taxable by a taxing unit and located in a former
478	478	Capitol view corridor on January 1, 2025.
479	479	(7) "Taxing unit" has the meaning assigned by Section
480	480	1.04, Tax Code.
481	481	Sec. 795.002. AFFORDABLE HOUSING BOARD; DUTIES. (a) The
482	482	affordable housing board is created to address the issues of
483	483	homelessness and affordable housing in eligible counties. The
484	484	board consists of the following members:
485	485	(1) three members appointed by the governor who have
486	486	experience on issues relating to homelessness and affordable
487	487	housing; and
488	488	(2) one member appointed by the governing body of each
489	489	eligible taxing unit that elects to deposit the taxing unit's
490	490	incremental tax revenue to the credit of the affordable housing
491	491	fund as authorized under Section 795.004.
492	492	(b) The affordable housing board shall establish and
493	493	administer a grant program to provide financial assistance to
494	494	public and private entities for purposes of reducing homelessness
495	495	and increasing affordable housing in eligible counties.
496	496	Sec. 795.003. AFFORDABLE HOUSING FUND. (a) The affordable
497	497	housing board shall establish an affordable housing fund. The
498	498	affordable housing fund consists of:
499	499	(1) the incremental tax revenue deposited to the
500	500	credit of the fund by eligible taxing units under Section 795.004;
501	501	and
502	502	(2) any gifts, grants, or donations from a public or
503	503	private entity made to the board for a purpose for which the fund
504	504	may be used.
505	505	(b) The affordable housing fund must be established as an
506	506	interest bearing account in a financial institution in this state
507	507	in the name of the affordable housing board.
508	508	(c) Money in the affordable housing fund may be used only
509	509	for a purpose described by Section 795.005.
510	510	Sec. 795.004. INCREMENTAL TAX REVENUE. (a) The governing
511	511	body of an eligible taxing unit may by ordinance, resolution, or
512	512	order elect to deposit the taxing unit's incremental tax revenue to
513	513	the credit of the affordable housing fund.
514	514	(b) The amount of an eligible taxing unit's incremental tax
515	515	revenue for a year is an amount of tax revenue equal to the total
516	516	taxable value of all real property taxable by the taxing unit and
517	517	located in a former Capitol view corridor for that tax year less the
518	518	taxing unit's tax increment base.
519	519	(c) An eligible taxing unit that elects to deposit the
520	520	taxing unit's incremental tax revenue into the affordable housing
521	521	fund shall each year:
522	522	(1) provide for the collection of taxes in the former
523	523	Capitol view corridor as for any other real property taxable by the
524	524	taxing unit; and
525	525	(2) pay into the affordable housing fund the taxing
526	526	unit's incremental tax revenue for that year.
527	527	Sec. 795.005. GRANTS. (a) The affordable housing board may
528	528	use money in the affordable housing fund only to award grants to
529	529	private or public entities for projects that address homelessness
530	530	or affordable housing in eligible counties.
531	531	(b) Grants may be awarded to:
532	532	(1) provide mortgage or down payment assistance to
533	533	first responders and teachers employed in eligible counties;
534	534	(2) purchase or construct single- or multi-family
535	535	housing units for use by homeless individuals, first responders, or
536	536	teachers; and
537	537	(3) reduce homelessness in eligible counties,
538	538	including repurposing and relocating the facilities that house
539	539	homeless individuals in the downtown and business districts of
540	540	municipalities located in eligible counties.
541	541	(c) The affordable housing board shall adopt procedures for
542	542	applying for a grant and evaluating applications for a grant under
543	543	this chapter.
544	544	Sec. 795.006. OVERSIGHT. The comptroller shall oversee the
545	545	operation of the affordable housing board and the affordable
546	546	housing fund.
547	547	SECTION 4. Subchapter D, Chapter 49, Education Code, is
548	548	amended by adding Section 49.1574 to read as follows:
549	549	Sec. 49.1574. CREDIT FOR INCREMENTAL TAXES PAID INTO
550	550	AFFORDABLE HOUSING FUND. (a) This section applies only to a school
551	551	district that elects to deposit the district's incremental tax
552	552	revenue into an affordable housing fund under Section 795.004,
553	553	Government Code.
554	554	(b) The total amount required under Section 49.153 for a
555	555	school district to purchase attendance credit under this subchapter
556	556	for any school year is reduced by an amount equal to the incremental
557	557	tax revenue deposited by the district in an affordable housing fund
558	558	under Section 795.004, Government Code, in that school year.
559	559	(c) A reduction under Subsection (b) shall be made after
560	560	making any reduction to which the district is entitled under
561	561	Section 49.157 or another provision of this chapter.
562	562	SECTION 5. This Act applies only to ad valorem taxes imposed
563	563	for a tax year that begins on or after the effective date of this
564	564	Act.
565	565	SECTION 6. This Act takes effect September 1, 2025.
