77 AN ACT
88 relating to age verification for the online sale of obscene
99 devices.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 43, Penal Code, is amended by adding
1212 Section 43.29 to read as follows:
1313 Sec. 43.29. ONLINE SALE OF OBSCENE DEVICES TO MINORS
1414 PROHIBITED. (a) A person commits an offense if, with criminal
1515 negligence, the person sells or delivers an obscene device online:
1616 (1) to an individual under the age of 18; or
1717 (2) to any person without implementing an age
1818 verification process at the point of sale to reasonably ensure that
1919 the purchaser is 18 years of age or older.
2020 (b) For the purposes of this section, "age verification
2121 process" means a commercially reasonable age verification method as
2222 referenced under Section 129B.003 of the Civil Practices and
2323 Remedies Code to verify a purchaser's age including, but not
2424 limited to:
2525 (1) the requirement to submit a government-issued
2626 photographic identification;
2727 (2) third-party age verification services that use
2828 public records or other reliable sources to verify the purchaser's
2929 identity and age; or
3030 (3) exclusive use of payment methods that are
3131 restricted to individuals 18 years of age of older, provided such
3232 verification is supplemented by another age verification method.
3333 (c) It is a defence to prosecution under this section that
3434 the minor falsely represented themselves to be 18 years of age or
3535 older by providing a government-issued identification card or other
3636 documentation that:
3737 (1) appears to be valid on its face; or
3838 (2) the minor presents a form of identification that
3939 is valid but was not issued to the minor.
4040 (d) A violation of this section is a Class A Misdemeanour.
4141 (e) A person who violates this section is also subject to a
4242 civil penalty of an amount not to exceed $5,000 for each violation
4343 under Chapter 43.
4444 SECTION 2. The changes in law made by this Act apply only to
4545 an action brought on or after the effective date of this Act. An
4646 action brought before the effective date of this Act is governed by
4747 the law applicable to the action immediately before the effective
4848 date of this Act, and that law is continued in effect for that
4949 purpose.
5050 SECTION 3. This Act takes effect September 1, 2025.
