9 | 9 | relating to a policy governing the operation of a motor vehicle by a | |

11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Chapter 5B, Code of Criminal Procedure, is | |
13 | 13 | amended by adding Article 5B.004 to read as follows: | |
14 | 14 | Art. 5B.004. POLICY ON CERTAIN VEHICULAR PURSUITS. The | |
15 | 15 | Department of Public Safety shall adopt a policy governing the | |
16 | 16 | manner in which a peace officer of the department may operate a | |
17 | 17 | motor vehicle in pursuit of a person the officer has reasonable | |
18 | 18 | suspicion or probable cause to believe committed an offense under | |
19 | 19 | Chapter 51, Penal Code. The policy must be substantially similar to | |
20 | 20 | the United States Customs and Border Protection's directive number | |
21 | 21 | 4510-026A on emergency driving and vehicular pursuits. | |
22 | 22 | SECTION 2. Not later than December 1, 2025, the Department | |
23 | 23 | of Public Safety of the State of Texas shall adopt the rules | |
24 | 24 | necessary to implement Article 5B.004, Code of Criminal Procedure, | |
25 | 25 | as added by this Act. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2025. |
