77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the amendment of standard permits for certain concrete
1010 plants.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 382.05195, Health and Safety Code, is
1313 amended by adding Subsection (f-1) and amending Subsection (k) to
1414 read as follows:
1515 (f-1) If the commission amends a standard permit issued
1616 under this section that authorizes the operation of a permanent
1717 concrete plant that performs wet batching, dry batching, or central
1818 mixing, a facility authorized to operate under the former standard
1919 permit shall comply with the amended standard permit beginning on
2020 the earlier of:
2121 (1) the date the facility's authorization to use the
2222 standard permit is renewed; or
2323 (2) the second anniversary of the effective date of
2424 the permit amendment.
2525 (k) An application for an authorization to use [the issuance
2626 of] a standard permit under this section for a concrete plant that
2727 performs wet batching, dry batching, or central mixing, including a
2828 permanent, temporary, or specialty concrete batch plant, as defined
2929 by the commission, must include a plot plan that clearly shows:
3030 (1) a distance scale;
3131 (2) a north arrow;
3232 (3) all property lines, emission points, buildings,
3333 tanks, and process vessels and other process equipment in the area
3434 in which the facility will be located;
3535 (4) at least two benchmark locations in the area in
3636 which the facility will be located; and
3737 (5) if the permit requires a distance, setback, or
3838 buffer from other property or structures as a condition of the
3939 permit, whether the required distance or setback will be met.
4040 SECTION 2. Section 382.05198, Health and Safety Code, is
4141 amended by amending Subsection (c) and adding Subsection (d) to
4242 read as follows:
4343 (c) An application for an authorization to use [the issuance
4444 of] a standard permit under this section must include a plot plan
4545 that meets the requirements of Section 382.05195(k).
4646 (d) If the commission amends the standard permit issued
4747 under this section, a facility authorized to operate under the
4848 former standard permit shall comply with the amended standard
4949 permit beginning on the earlier of:
5050 (1) the date the facility's authorization to use the
5151 standard permit is renewed; or
5252 (2) the second anniversary of the effective date of
5353 the permit amendment.
5454 SECTION 3. Notwithstanding the changes in law made by this
5555 Act, the Texas Commission on Environmental Quality may allow a
5656 facility authorized to use a standard permit issued under Section
5757 382.05195 or 382.05198, Health and Safety Code, that was amended
5858 before the effective date of this Act to continue to operate under
5959 the former standard permit until the date the facility's
6060 authorization is eligible for renewal.
6161 SECTION 4. This Act takes effect September 1, 2025.
