77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a biennial state report on suicide rates, the Texas
1010 Violent Death Reporting System, and certain suicide data shared
1111 under a memorandum of understanding.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 547, Government Code, as effective April
1414 1, 2025, is amended by adding Subchapter K to read as follows:
1515 SUBCHAPTER K. BIENNIAL STATE REPORT ON SUICIDE
1616 Sec. 547.0501. DEFINITIONS. In this subchapter:
1717 (1) "Council" means the Statewide Behavioral Health
1818 Coordinating Council.
1919 (2) "First responder" has the meaning assigned by
2020 Section 421.095.
2121 (3) "Postvention" includes activities promoting
2222 healing necessary to reduce the risk of suicide by an individual
2323 affected by the suicide of another.
2424 Sec. 547.0502. BIENNIAL REPORT. (a) The commission, in
2525 conjunction with the Department of State Health Services, shall
2626 prepare a biennial report on the prevalence of suicide in this state
2727 and state policies and programs adopted across state systems and
2828 agencies to prevent suicide. The report must:
2929 (1) incorporate available statewide and regional data
3030 on the prevalence rates of suicide-related events, including
3131 suicidal thoughts, suicide attempts, and deaths caused by suicide,
3232 and to the extent practicable be presented in a form that is:
3333 (A) disaggregated by county and recognized
3434 categories of risk; and
3535 (B) longitudinal to identify changes in suicide
3636 prevalence rates since 2000;
3737 (2) identify the highest categories of risk with
3838 correlational data;
3939 (3) include information on the prevalence rates of
4040 suicide-related events among active duty military personnel,
4141 veterans, first responders, and children and adolescents;
4242 (4) list state statutes, agency rules, and policies
4343 related to suicide and suicide prevention, intervention, and
4444 postvention; and
4545 (5) describe state agency initiatives taken since 2000
4646 to address suicide and include the following information relating
4747 to each initiative:
4848 (A) the administering state agency;
4949 (B) the funding sources, including whether the
5050 funding was provided by:
5151 (i) a federal block grant;
5252 (ii) a federal discretionary grant; or
5353 (iii) state appropriations;
5454 (C) the years of operation; and
5555 (D) whether the initiative is a community-based
5656 effort to address suicide.
5757 (b) Each state agency or institution of higher education, as
5858 defined by Section 61.003, Education Code, that designates a
5959 representative on the council shall provide to the commission the
6060 information described by Subsection (a), to the extent that
6161 information pertains to the respective duties of the agency or
6262 institution.
6363 (c) Not later than November 1 of each even-numbered year,
6464 the council shall submit a copy of the report to the governor, the
6565 lieutenant governor, the speaker of the house of representatives,
6666 and each standing legislative committee with primary jurisdiction
6767 over health and mental health.
6868 SECTION 2. Section 193.011, Health and Safety Code, is
6969 amended by amending Subsections (a) and (c) and adding Subsection
7070 (b-1) to read as follows:
7171 (a) In this section, "authorized entity" means the
7272 department, the Health and Human Services Commission, the Statewide
7373 Behavioral Health Coordinating Council, a medical examiner, a local
7474 registrar, a local health authority, a local mental health
7575 authority, a community mental health center, a mental health center
7676 that acts as a collection agent for the suicide data reported by
7777 community mental health centers, or any other political subdivision
7878 of this state.
7979 (b-1) The department and the Health and Human Services
8080 Commission shall enter into a memorandum of understanding to share,
8181 as soon as practicable, suicide data the vital statistics unit
8282 collects for the conduct of timely fatality reviews and
8383 surveillance to prevent additional deaths.
8484 (c) The suicide data an authorized entity receives or
8585 provides under Subsection (b) or (b-1) is not confidential.
8686 SECTION 3. Subchapter D, Chapter 1001, Health and Safety
8787 Code, is amended by adding Section 1001.090 to read as follows:
8888 Sec. 1001.090. TEXAS VIOLENT DEATH REPORTING SYSTEM. (a)
8989 The department shall establish and operate the Texas Violent Death
9090 Reporting System to participate in the National Violent Death
9191 Reporting System operated by the federal Centers for Disease
9292 Control and Prevention.
9393 (b) The department shall provide suicide data obtained or
9494 maintained through the Texas Violent Death Reporting System:
9595 (1) in accordance with a memorandum of understanding
9696 the department entered into under Section 193.011; and
9797 (2) to the commission for the biennial state report on
9898 suicide required under Subchapter K, Chapter 547, Government Code.
9999 (c) The executive commissioner may adopt rules necessary to
100100 implement this section.
101101 SECTION 4. This Act takes effect immediately if it receives
102102 a vote of two-thirds of all the members elected to each house, as
103103 provided by Section 39, Article III, Texas Constitution. If this
104104 Act does not receive the vote necessary for immediate effect, this
105105 Act takes effect September 1, 2025.
