| 8 | 8 | | relating to the ability for students to recite the pledge of |

| 9 | 9 | | allegiance. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. SECTION 25.082, Education Code, is amended as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | (b) The board of trustees of each school district and the |
|---|
| 14 | 14 | | governing board of each open-enrollment charter school shall |
|---|
| 15 | 15 | | require students, once during each school day at each campus, to |
|---|
| 16 | 16 | | recite or silently observe the recitation of: |
|---|
| 17 | 17 | | (1) the pledge of allegiance to the United States flag |
|---|
| 18 | 18 | | in accordance with 4 U.S.C. Section 4; and |
|---|
| 19 | 19 | | (2) the pledge of allegiance to the state flag in |
|---|
| 20 | 20 | | accordance with Subchapter C, Chapter 3100, Government Code. |
|---|
| 21 | 21 | | (b-1) The board of trustees of each school district and the |
|---|
| 22 | 22 | | governing board of each open-enrollment charter school shall |
|---|
| 23 | 23 | | require that the United States and Texas flags be prominently |
|---|
| 24 | 24 | | displayed in accordance with 4 U.S.C. Sections 5-10 and Chapter |
|---|
| 25 | 25 | | 3100, Government Code, in each campus classroom to which a student |
|---|
| 26 | 26 | | is assigned at the time the pledges of allegiance to those flags are |
|---|
| 27 | 27 | | recited. A district or school is not required to spend federal, |
|---|
| 28 | 28 | | state, or local district or school funds to acquire flags required |
|---|
| 29 | 29 | | under this subsection. A district or school may raise money or |
|---|
| 30 | 30 | | accept gifts, grants, and donations to acquire flags required under |
|---|
| 31 | 31 | | this subsection. |
|---|
| 32 | 32 | | (c) On written request from a student's parent or guardian, |
|---|
| 33 | 33 | | a school district or open-enrollment charter school shall excuse |
|---|
| 34 | 34 | | the student from reciting a pledge of allegiance under Subsection |
|---|
| 35 | 35 | | (b) and these students must wait outside of the room as these |
|---|
| 36 | 36 | | activities are being conducted. |
|---|
| 37 | 37 | | SECTION 2. This Act takes effect September 1, 2025. |
