66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the ability for students to recite the pledge of
99 allegiance.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. SECTION 25.082, Education Code, is amended as
1212 follows:
1313 (b) The board of trustees of each school district and the
1414 governing board of each open-enrollment charter school shall
1515 require students, once during each school day at each campus, to
1616 recite or silently observe the recitation of:
1717 (1) the pledge of allegiance to the United States flag
1818 in accordance with 4 U.S.C. Section 4; and
1919 (2) the pledge of allegiance to the state flag in
2020 accordance with Subchapter C, Chapter 3100, Government Code.
2121 (b-1) The board of trustees of each school district and the
2222 governing board of each open-enrollment charter school shall
2323 require that the United States and Texas flags be prominently
2424 displayed in accordance with 4 U.S.C. Sections 5-10 and Chapter
2525 3100, Government Code, in each campus classroom to which a student
2626 is assigned at the time the pledges of allegiance to those flags are
2727 recited. A district or school is not required to spend federal,
2828 state, or local district or school funds to acquire flags required
2929 under this subsection. A district or school may raise money or
3030 accept gifts, grants, and donations to acquire flags required under
3131 this subsection.
3232 (c) On written request from a student's parent or guardian,
3333 a school district or open-enrollment charter school shall excuse
3434 the student from reciting a pledge of allegiance under Subsection
3535 (b) and these students must wait outside of the room as these
3636 activities are being conducted.
3737 SECTION 2. This Act takes effect September 1, 2025.
