88 relating to the creation of La Cima Municipal Management District
99 No. 1; providing authority to issue bonds; providing authority to
1010 impose assessments, fees, and taxes; granting a limited power of

1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1414 Code, is amended by adding Chapter 4012 to read as follows:
1515 CHAPTER 4012. LA CIMA MUNICIPAL MANAGEMENT DISTRICT NO. 1
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 4012.0101. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "City" means the City of San Marcos.
2020 (3) "Director" means a board member.
2121 (4) "District" means La Cima Municipal Management
2222 District No. 1.
2323 Sec. 4012.0102. NATURE OF DISTRICT. La Cima Municipal
2424 Management District No. 1 is a special district created under
2525 Section 59, Article XVI, Texas Constitution.
2626 Sec. 4012.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2727 creation of the district is essential to accomplish the purposes of
2828 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2929 Texas Constitution, and other public purposes stated in this
3030 chapter.
3131 (b) By creating the district and in authorizing the city and
3232 other political subdivisions to contract with the district, the
3333 legislature has established a program to accomplish the public
3434 purposes set out in Section 52-a, Article III, Texas Constitution.
3535 (c) The creation of the district is necessary to promote,
3636 develop, encourage, and maintain employment, commerce,
3737 transportation, housing, tourism, recreation, the arts,
3838 entertainment, economic development, safety, and the public
3939 welfare in the district.
4040 (d) This chapter and the creation of the district may not be
4141 interpreted to relieve the city from providing the level of
4242 services provided as of the effective date of the Act enacting this
4343 chapter to the area in the district. The district is created to
4444 supplement and not to supplant city services provided in the
4545 district.
4646 Sec. 4012.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4747 (a) All land and other property included in the district will
4848 benefit from the improvements and services to be provided by the
4949 district under powers conferred by Sections 52 and 52-a, Article
5050 III, and Section 59, Article XVI, Texas Constitution, and other
5151 powers granted under this chapter.
5252 (b) The district is created to serve a public use and
5353 benefit.
5454 (c) The creation of the district is in the public interest
5555 and is essential to further the public purposes of:
5656 (1) developing and diversifying the economy of the
5757 state;
5858 (2) eliminating unemployment and underemployment; and
5959 (3) developing or expanding transportation and
6060 commerce.
6161 (d) The district will:
6262 (1) promote the health, safety, and general welfare of
6363 residents, employers, potential employees, employees, visitors,
6464 and consumers in the district, and of the public;
6565 (2) provide needed funding for the district to
6666 preserve, maintain, and enhance the economic health and vitality of
6767 the district territory as a community and business center;
6868 (3) promote the health, safety, welfare, and enjoyment
6969 of the public by providing pedestrian ways and by landscaping and
7070 developing certain areas in the district, which are necessary for
7171 the restoration, preservation, and enhancement of scenic beauty;
7272 and
7373 (4) provide for water, wastewater, drainage, road, and
7474 recreational facilities for the district.
7575 (e) Pedestrian ways along or across a street, whether at
7676 grade or above or below the surface, and street lighting, street
7777 landscaping, parking, and street art objects are parts of and
7878 necessary components of a street and are considered to be a street
7979 or road improvement.
8080 (f) The district will not act as the agent or
8181 instrumentality of any private interest even though the district
8282 will benefit many private interests as well as the public.
8383 Sec. 4012.0105. INITIAL DISTRICT TERRITORY. (a) The
8484 district is initially composed of the territory described by
8585 Section 2 of the Act enacting this chapter.
8686 (b) The boundaries and field notes contained in Section 2 of
8787 the Act enacting this chapter form a closure. A mistake in the
8888 field notes or in copying the field notes in the legislative process
8989 does not affect the district's:
9090 (1) organization, existence, or validity;
9191 (2) right to issue any type of bonds for the purposes
9292 for which the district is created or to pay the principal of and
9393 interest on the bonds;
9494 (3) right to impose or collect an assessment or tax; or
9595 (4) legality or operation.
9696 Sec. 4012.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9797 All or any part of the area of the district is eligible to be
9898 included in:
9999 (1) a tax increment reinvestment zone created under
100100 Chapter 311, Tax Code; or
101101 (2) a tax abatement reinvestment zone created under
102102 Chapter 312, Tax Code.
103103 Sec. 4012.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
104104 DISTRICTS LAW. Except as otherwise provided by this chapter,
105105 Chapter 375, Local Government Code, applies to the district.
106106 Sec. 4012.0108. CONSTRUCTION OF CHAPTER. This chapter
107107 shall be liberally construed in conformity with the findings and
108108 purposes stated in this chapter.
109109 SUBCHAPTER B. BOARD OF DIRECTORS
110110 Sec. 4012.0201. GOVERNING BODY; TERMS. (a) The district is
111111 governed by a board of five elected directors who serve staggered
112112 terms of four years.
113113 (b) Directors are elected in the manner provided by
114114 Subchapter D, Chapter 49, Water Code.
115115 Sec. 4012.0202. COMPENSATION; EXPENSES. A director is
116116 entitled to receive fees of office and reimbursement for actual
117117 expenses as provided by Section 49.060, Water Code. Sections
118118 375.069 and 375.070, Local Government Code, do not apply to the
119119 board.
120120 Sec. 4012.0203. INITIAL DIRECTORS. (a) The initial board

134134 (b) Of the initial directors, the terms of directors
135135 appointed for positions one through three expire June 1, 2027, and
136136 the terms of directors appointed for positions four and five expire
137137 June 1, 2029.
138138 SUBCHAPTER C. POWERS AND DUTIES
139139 Sec. 4012.0301. GENERAL POWERS AND DUTIES. The district
140140 has the powers and duties necessary to accomplish the purposes for
141141 which the district is created.
142142 Sec. 4012.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
143143 district, using any money available to the district for the
144144 purpose, may provide, design, construct, acquire, improve,
145145 relocate, operate, maintain, or finance an improvement project or
146146 service authorized under this chapter or Chapter 375, Local
147147 Government Code.
148148 (b) The district may contract with a governmental or private
149149 entity to carry out an action under Subsection (a).
150150 (c) The implementation of a district project or service is a
151151 governmental function or service for the purposes of Chapter 791,
152152 Government Code.
153153 Sec. 4012.0303. NONPROFIT CORPORATION. (a) The board by
154154 resolution may authorize the creation of a nonprofit corporation to
155155 assist and act for the district in implementing a project or
156156 providing a service authorized by this chapter.
157157 (b) The nonprofit corporation:
158158 (1) has each power of and is considered to be a local
159159 government corporation created under Subchapter D, Chapter 431,
160160 Transportation Code; and
161161 (2) may implement any project and provide any service
162162 authorized by this chapter.
163163 (c) The board shall appoint the board of directors of the
164164 nonprofit corporation. The board of directors of the nonprofit
165165 corporation shall serve in the same manner as the board of directors
166166 of a local government corporation created under Subchapter D,
167167 Chapter 431, Transportation Code, except that a board member is not
168168 required to reside in the district.
169169 Sec. 4012.0304. LAW ENFORCEMENT SERVICES. To protect the
170170 public interest, the district may contract with a qualified party,
171171 including the city, to provide law enforcement services in the
172172 district for a fee.
173173 Sec. 4012.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
174174 The district may join and pay dues to a charitable or nonprofit
175175 organization that performs a service or provides an activity
176176 consistent with the furtherance of a district purpose.
177177 Sec. 4012.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
178178 district may engage in activities that accomplish the economic
179179 development purposes of the district.
180180 (b) The district may establish and provide for the
181181 administration of one or more programs to promote state or local
182182 economic development and to stimulate business and commercial
183183 activity in the district, including programs to:
184184 (1) make loans and grants of public money; and
185185 (2) provide district personnel and services.
186186 (c) The district may create economic development programs
187187 and exercise the economic development powers provided to
188188 municipalities by:
189189 (1) Chapter 380, Local Government Code; and
190190 (2) Subchapter A, Chapter 1509, Government Code.
191191 Sec. 4012.0307. PARKING FACILITIES. (a) The district may
192192 acquire, lease as lessor or lessee, construct, develop, own,
193193 operate, and maintain parking facilities or a system of parking
194194 facilities, including lots, garages, parking terminals, or other
195195 structures or accommodations for parking motor vehicles off the
196196 streets and related appurtenances.
197197 (b) The district's parking facilities serve the public
198198 purposes of the district and are owned, used, and held for a public
199199 purpose even if leased or operated by a private entity for a term of
200200 years.
201201 (c) The district's parking facilities are parts of and
202202 necessary components of a street and are considered to be a street
203203 or road improvement.
204204 (d) The development and operation of the district's parking
205205 facilities may be considered an economic development program.
206206 Sec. 4012.0308. DISBURSEMENTS AND TRANSFERS OF MONEY. The
207207 board by resolution shall establish the number of directors'
208208 signatures and the procedure required for a disbursement or
209209 transfer of district money.
210210 Sec. 4012.0309. ADDING OR EXCLUDING LAND. Except as
211211 provided by Section 4012.0310, the district may add or exclude land
212212 in the manner provided by Subchapter J, Chapter 49, Water Code, or
213213 by Subchapter H, Chapter 54, Water Code.
214214 Sec. 4012.0310. DIVISION OF DISTRICT. (a) The district may
215215 be divided into two or more new districts only if the district:
216216 (1) has no outstanding bonded debt; and
217217 (2) is not imposing ad valorem taxes.
218218 (b) This chapter applies to any new district created by the
219219 division of the district, and a new district has all the powers and
220220 duties of the district.
221221 (c) Any new district created by the division of the district
222222 may not, at the time the new district is created, contain any land
223223 outside the area described by Section 2 of the Act enacting this
224224 chapter.
225225 (d) The board, on its own motion or on receipt of a petition
226226 signed by the owner or owners of a majority of the assessed value of
227227 the real property in the district, may adopt an order dividing the
228228 district.
229229 (e) An order dividing the district must:
230230 (1) name each new district;
231231 (2) include the metes and bounds description of the
232232 territory of each new district;
233233 (3) appoint initial directors for each new district;
234234 and
235235 (4) provide for the division of assets and liabilities
236236 between or among the new districts.
237237 (f) On or before the 30th day after the date of adoption of
238238 an order dividing the district, the district shall file the order
239239 with the Texas Commission on Environmental Quality and record the
240240 order in the real property records of each county in which the
241241 district is located.
242242 (g) Municipal consent to the creation of the district and to
243243 the inclusion of land in the district granted under Section
244244 4012.0506 acts as municipal consent to the creation of any new
245245 district created by the division of the district and to the
246246 inclusion of land in the new district.
247247 Sec. 4012.0311. EMINENT DOMAIN. The district may exercise
248248 the power of eminent domain in the manner provided by Section
249249 49.222, Water Code.
250250 SUBCHAPTER D. ASSESSMENTS
251251 Sec. 4012.0401. PETITION REQUIRED FOR FINANCING SERVICES
252252 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
253253 service or improvement project with assessments under this chapter
254254 unless a written petition requesting that service or improvement
255255 has been filed with the board.
256256 (b) A petition filed under Subsection (a) must be signed by
257257 the owners of a majority of the assessed value of real property in
258258 the district subject to assessment according to the most recent
259259 certified tax appraisal roll for the county.
260260 Sec. 4012.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
261261 The board by resolution may impose and collect an assessment for any
262262 purpose authorized by this chapter in all or any part of the
263263 district.
264264 (b) An assessment, a reassessment, or an assessment
265265 resulting from an addition to or correction of the assessment roll
266266 by the district, penalties and interest on an assessment or
267267 reassessment, an expense of collection, and reasonable attorney's
268268 fees incurred by the district:
269269 (1) are a first and prior lien against the property
270270 assessed;
271271 (2) are superior to any other lien or claim other than
272272 a lien or claim for county, school district, or municipal ad valorem
273273 taxes; and
274274 (3) are the personal liability of and a charge against
275275 the owners of the property even if the owners are not named in the
276276 assessment proceedings.
277277 (c) The lien is effective from the date of the board's
278278 resolution imposing the assessment until the date the assessment is
279279 paid. The board may enforce the lien in the same manner that the
280280 board may enforce an ad valorem tax lien against real property.
281281 (d) The board may make a correction to or deletion from the
282282 assessment roll that does not increase the amount of assessment of
283283 any parcel of land without providing notice and holding a hearing in
284284 the manner required for additional assessments.
285285 SUBCHAPTER E. TAXES AND BONDS
286286 Sec. 4012.0501. TAX ELECTION REQUIRED. (a) The district
287287 must hold an election in the manner provided by Chapter 49, Water
288288 Code, or, if applicable, Chapter 375, Local Government Code, to
289289 obtain voter approval before the district may impose an ad valorem
290290 tax.
291291 (b) Section 375.243, Local Government Code, does not apply
292292 to the district.
293293 Sec. 4012.0502. OPERATION AND MAINTENANCE TAX. (a) If
294294 authorized by a majority of the district voters voting at an
295295 election under Section 4012.0501, the district may impose an
296296 operation and maintenance tax on taxable property in the district
297297 in the manner provided by Section 49.107, Water Code, for any
298298 district purpose, including to:
299299 (1) maintain and operate the district;
300300 (2) construct or acquire improvements; or
301301 (3) provide a service.
302302 (b) The board shall determine the operation and maintenance
303303 tax rate. The rate may not exceed the rate approved at the
304304 election.
305305 Sec. 4012.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
306306 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
307307 terms determined by the board.
308308 (b) The district may issue, by public or private sale,
309309 bonds, notes, or other obligations payable wholly or partly from ad
310310 valorem taxes, assessments, impact fees, revenue, contract
311311 payments, grants, or other district money, or any combination of
312312 those sources of money, to pay for any authorized district purpose.
313313 (c) The district may issue, by public or private sale,
314314 bonds, notes, or other obligations payable wholly or partly from
315315 assessments in the manner provided by Subchapter A, Chapter 372,
316316 Local Government Code, if the improvements financed by an
317317 obligation issued under this section will be conveyed to or
318318 operated and maintained by a municipality or other retail utility
319319 provider pursuant to an agreement with the district entered into
320320 before the issuance of the obligation.
321321 Sec. 4012.0504. BONDS SECURED BY REVENUE OR CONTRACT
322322 PAYMENTS. The district may issue, without an election, bonds
323323 secured by:
324324 (1) revenue other than ad valorem taxes, including
325325 contract revenues; or
326326 (2) contract payments, provided that the requirements
327327 of Section 49.108, Water Code, have been met.
328328 Sec. 4012.0505. BONDS SECURED BY AD VALOREM TAXES;
329329 ELECTIONS. (a) If authorized at an election under Section
330330 4012.0501, the district may issue bonds payable from ad valorem
331331 taxes.
332332 (b) At the time the district issues bonds payable wholly or
333333 partly from ad valorem taxes, the board shall provide for the annual
334334 imposition of a continuing direct annual ad valorem tax, without
335335 limit as to rate or amount, for each year that all or part of the
336336 bonds are outstanding as required and in the manner provided by
337337 Sections 54.601 and 54.602, Water Code.
338338 (c) All or any part of any facilities or improvements that
339339 may be acquired by a district by the issuance of its bonds may be
340340 submitted as a single proposition or as several propositions to be
341341 voted on at the election.
342342 Sec. 4012.0506. CONSENT OF MUNICIPALITY REQUIRED. (a) The
343343 board may not issue bonds until each municipality in whose
344344 corporate limits or extraterritorial jurisdiction the district is
345345 located has consented by ordinance or resolution to the creation of
346346 the district and to the inclusion of land in the district as
347347 required by applicable law.
348348 (b) This section applies only to the district's first
349349 issuance of bonds payable from ad valorem taxes.
350350 SUBCHAPTER I. DISSOLUTION
351351 Sec. 4012.0901. DISSOLUTION. (a) The board shall dissolve
352352 the district on written petition filed with the board by the owners
353353 of:
354354 (1) at least two-thirds of the assessed value of the
355355 property subject to assessment by the district based on the most
356356 recent certified county property tax rolls; or
357357 (2) at least two-thirds of the surface area of the
358358 district, excluding roads, streets, highways, utility
359359 rights-of-way, other public areas, and other property exempt from
360360 assessment by the district according to the most recent certified
361361 county property tax rolls.
362362 (b) The board by majority vote may dissolve the district at
363363 any time.
364364 (c) The district may not be dissolved by its board under
365365 Subsection (a) or (b) if the district:
366366 (1) has any outstanding bonded indebtedness until that
367367 bonded indebtedness has been repaid or defeased in accordance with
368368 the order or resolution authorizing the issuance of the bonds;
369369 (2) has a contractual obligation to pay money until
370370 that obligation has been fully paid in accordance with the
371371 contract; or
372372 (3) owns, operates, or maintains public works,
373373 facilities, or improvements unless the district contracts with
374374 another person for the ownership, operation, or maintenance of the
375375 public works, facilities, or improvements.
376376 (d) Sections 375.261, 375.262, and 375.264, Local
377377 Government Code, do not apply to the district.

379379 initially includes all territory contained in the following area:

18741874 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
18751875 Government Code.
18761876 (b) The governor, one of the required recipients, has
18771877 submitted the notice and Act to the Texas Commission on
18781878 Environmental Quality.
18791879 (c) The Texas Commission on Environmental Quality has filed
18801880 its recommendations relating to this Act with the governor,
18811881 lieutenant governor, and speaker of the house of representatives
18821882 within the required time.
18831883 (d) All requirements of the constitution and laws of this
18841884 state and the rules and procedures of the legislature with respect
18851885 to the notice, introduction, and passage of this Act have been
18861886 fulfilled and accomplished.
18871887 SECTION 4. (a) Section 4012.0311, Special District Local
18881888 Laws Code, as added by Section 1 of this Act, takes effect only if
18891889 this Act receives a two-thirds vote of all the members elected to
18901890 each house.
18911891 (b) If this Act does not receive a two-thirds vote of all the
18921892 members elected to each house, Subchapter C, Chapter 4012, Special
18931893 District Local Laws Code, as added by Section 1 of this Act, is
18941894 amended by adding Section 4012.0311 to read as follows:
18951895 Sec. 4012.0311. NO EMINENT DOMAIN POWER. The district may
18961896 not exercise the power of eminent domain.
18971897 SECTION 5. This Act takes effect immediately if it receives
18981898 a vote of two-thirds of all the members elected to each house, as
18991899 provided by Section 39, Article III, Texas Constitution. If this
19001900 Act does not receive the vote necessary for immediate effect, this
19011901 Act takes effect September 1, 2025.
