77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the resumption of employment by certain retirees under
1010 the Texas Municipal Retirement System.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 852.108, Government Code, is amended by
1313 amending Subsections (e) and (f) and adding Subsection (e-1) to
1414 read as follows:
1515 (e) After termination of employment with the reemploying
1616 municipality and after filing of an application for resumption of
1717 retirement with the board of trustees, a person described by
1818 Subsection (c) is entitled to receive:
1919 (1) future payments of the suspended annuity, as
2020 provided by:
2121 (A) Subsection (e-1); or
2222 (B) Subsection (f);[,] and
2323 (2) if subject to Subsection (f), [to the] additional
2424 benefits as provided by Subsections (g), (h), (i), and (j).
2525 (e-1) A person described by Subsection (c) who becomes an
2626 employee of the person's reemploying municipality at any time
2727 during the 120 consecutive days after the effective date of the
2828 person's initial retirement from the reemploying municipality may
2929 elect, in the manner and form prescribed by the board of trustees,
3030 to restore to effect the person's membership, including any prior
3131 service credit, special prior service credit, antecedent service
3232 credit, or updated service credit used in determining the amount of
3333 the person's annuity at the time of the initial retirement. If the
3434 person subsequently retires from the reemploying municipality, the
3535 retirement system shall:
3636 (1) allow the person credit for all current service
3737 for which required contributions have been made and not withdrawn
3838 or distributed;
3939 (2) recompute the person's annuity based on service
4040 before and after the initial retirement, provided the annuity is
4141 actuarially reduced to reflect the value of benefits received by
4242 the person before the person resumed employment with the
4343 reemploying municipality; and
4444 (3) resume monthly payments of the recomputed annuity
4545 effective beginning with the month following the month in which
4646 employment is terminated with the reemploying municipality.
4747 (f) Monthly payments of an annuity suspended under
4848 Subsection (c) other than an annuity subject to Subsection (e-1)
4949 shall resume effective beginning with the month following the month
5050 in which employment is terminated with the reemploying
5151 municipality, without change in the amount except for any increase
5252 allowed under Section 854.203 or the duration of or another
5353 condition pertaining to the suspended benefit. Except as provided
5454 by Subsection (j), payment of the resumed benefit may not be made
5555 for any month during which the payment was suspended under this
5656 section.
5757 SECTION 2. Section 852.108, Government Code, as amended by
5858 this Act, applies to a retiree of the Texas Municipal Retirement
5959 System regardless of whether the person retired from employment
6060 before, on, or after the effective date of this Act.
6161 SECTION 3. This Act takes effect September 1, 2025.
