77 AN ACT
88 relating to air quality permits for certain concrete plants and
99 crushing facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 382.004(c), Health and Safety Code, is
1212 amended to read as follows:
1313 (c) A person may not begin construction under this section
1414 if the facility that is the subject of the permit amendment:
1515 (1) is concrete batch plant located within 880 yards
1616 of a property that is used as a residence; or
1717 (2) is a:
1818 (A) concrete crushing facility; or
1919 (B) concrete plant that performs wet batching,
2020 dry batching, or central mixing that is located within 2000 yards of
2121 a hospital.
2222 SECTION 2. Section 382.065, Health and Safety Code, is
2323 amended to read as follows:
2424 Sec. 382.065. CERTAIN LOCATIONS FOR OPERATING CERTAIN
2525 CONCRETE FACILITIES [CRUSHING FACILITY] PROHIBITED. (a) This
2626 section applies only to a facility that is:
2727 (1) a concrete crushing facility; or
2828 (2) a concrete plant that performs wet batching, dry
2929 batching, or central mixing.
3030 (a-1) The commission by rule shall prohibit the operation of
3131 a concrete crushing facility within 440 yards of a building in use
3232 as a single or multifamily residence, school, or place of worship at
3333 the time the application for a permit to operate the facility at a
3434 site near the residence, school, or place of worship is filed with
3535 the commission.
3636 (a-2) The commission by rule shall prohibit the operation of
3737 a facility within 2000 yards of a building in use as a hospital.
3838 (a-3) The measurement of distance for purposes of this
3939 section is the shortest distance between [subsection shall be taken
4040 from the point on] the [concrete crushing] facility and a building
4141 or area described by Subsections (a-1) and (a-2) [that is nearest to
4242 the residence, school, or place of worship toward the point on the
4343 residence, school, or place of worship that is nearest the concrete
4444 crushing facility].
4545 (b) A rule adopted under this section [Subsection (a)] does
4646 not apply to a [concrete crushing facility]:
4747 (1) concrete crushing facility at a location for which
4848 commission authorization for the operation of a concrete crushing
4949 facility was in effect on September 1, 2001;
5050 (2) facility at a location that satisfies the distance
5151 requirements of Subsection (a-1) [(a)] at the time the application
5252 for the initial authorization for the operation of that facility at
5353 that location is filed with the commission, provided that the
5454 authorization is granted and maintained, regardless of whether a
5555 building described by Subsections (a-1)and(a-2) [single or
5656 multifamily residence, school, or place of worship] is subsequently
5757 built or put to use within 440 yards of the facility; or
5858 (3) facility that:
5959 (A) uses a concrete crusher:
6060 (i) in the manufacture of products that
6161 contain recycled materials; and
6262 (ii) that is located in an enclosed
6363 building; and
6464 (B) is located:
6565 (i) within 25 miles of an international
6666 border; and
6767 (ii) in a municipality with a population of
6868 not less than 6,100 but not more than 20,000.
6969 (c) Except as provided by Subsection (d), Subsections(a-1)
7070 and(a-2)[(a)] [does] do not apply to a concrete crushing facility
7171 that:
7272 (1) is engaged in crushing concrete and other
7373 materials produced by the demolition of a structure at the location
7474 of the structure and the concrete and other materials are being
7575 crushed primarily for use at that location;
7676 (2) operates at that location for not more than 180
7777 days;
7878 (3) the commission determines will cause no adverse
7979 environmental or health effects by operating at that location; and
8080 (4) complies with conditions stated in commission
8181 rules, including operating conditions.
8282 (d) Notwithstanding Subsection (c), Subsection (a-1) [(a)]
8383 applies to a [concrete crushing] facility in a county with a
8484 population of 3.3 million or more or in a county adjacent to such a
8585 county.
8686 SECTION 3. The changes in law made by this Act apply to an
8787 application for a permit, permit amendment, or authorization to use
8888 a permit filed with the Texas Commission on Environmental Quality
8989 on or after the effective date of this Act and a permit subject to
9090 pending litigation on the effective date of this act.
9191 SECTION 4. This Act takes effect immediately.
