88 relating to the creation of the Bluebonnet Hills Municipal
99 Management District No. 1; providing authority to issue bonds;
1010 providing authority to impose assessments, fees, and taxes;
1111 granting a limited power of eminent domain.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1414 Code, is amended by adding Chapter 4016 to read as follows:
1515 CHAPTER 4016. BLUEBONNET HILLS MUNICIPAL MANAGEMENT DISTRICT NO. 1
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 4016.0101. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "City" means the City of Midlothian.
2020 (3) "Director" means a board member.
2121 (4) "District" means the Bluebonnet Hills Municipal
2222 Management District No. 1.
2323 Sec. 4016.0102. NATURE OF DISTRICT. The Bluebonnet Hills
2424 Municipal Management District No. 1 is a special district created
2525 under Section 59, Article XVI, Texas Constitution.
2626 Sec. 4016.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2727 creation of the district is essential to accomplish the purposes of
2828 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2929 Texas Constitution, and other public purposes stated in this
3030 chapter.
3131 (b) By creating the district and in authorizing the city and
3232 other political subdivisions to contract with the district, the
3333 legislature has established a program to accomplish the public
3434 purposes set out in Section 52-a, Article III, Texas Constitution.
3535 (c) The creation of the district is necessary to promote,
3636 develop, encourage, and maintain employment, commerce,
3737 transportation, housing, tourism, recreation, the arts,
3838 entertainment, economic development, safety, and the public
3939 welfare in the district.
4040 (d) This chapter and the creation of the district may not be
4141 interpreted to relieve the city from providing the level of
4242 services provided as of the effective date of the Act enacting this
4343 chapter to the area in the district. The district is created to
4444 supplement and not to supplant city services provided in the
4545 district.
4646 Sec. 4016.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4747 (a) All land and other property included in the district will
4848 benefit from the improvements and services to be provided by the
4949 district under powers conferred by Sections 52 and 52-a, Article
5050 III, and Section 59, Article XVI, Texas Constitution, and other
5151 powers granted under this chapter.
5252 (b) The district is created to serve a public use and
5353 benefit.
5454 (c) The creation of the district is in the public interest
5555 and is essential to further the public purposes of:
5656 (1) developing and diversifying the economy of the
5757 state;
5858 (2) eliminating unemployment and underemployment; and
5959 (3) developing or expanding transportation and
6060 commerce.
6161 (d) The district will:
6262 (1) promote the health, safety, and general welfare of
6363 residents, employers, potential employees, employees, visitors,
6464 and consumers in the district, and of the public;
6565 (2) provide needed funding for the district to
6666 preserve, maintain, and enhance the economic health and vitality of
6767 the district territory as a community and business center;
6868 (3) promote the health, safety, welfare, and enjoyment
6969 of the public by providing pedestrian ways and by landscaping and
7070 developing certain areas in the district, which are necessary for
7171 the restoration, preservation, and enhancement of scenic beauty;
7272 and
7373 (4) provide for water, wastewater, drainage, road, and
7474 recreational facilities for the district.
7575 (e) Pedestrian ways along or across a street, whether at
7676 grade or above or below the surface, and street lighting, street
7777 landscaping, parking, and street art objects are parts of and
7878 necessary components of a street and are considered to be a street
7979 or road improvement.
8080 (f) The district will not act as the agent or
8181 instrumentality of any private interest even though the district
8282 will benefit many private interests as well as the public.
8383 Sec. 4016.0105. INITIAL DISTRICT TERRITORY. (a) The
8484 district is initially composed of the territory described by
8585 Section 2 of the Act enacting this chapter.
8686 (b) The boundaries and field notes contained in Section 2 of
8787 the Act enacting this chapter form a closure. A mistake in the
8888 field notes or in copying the field notes in the legislative process
8989 does not affect the district's:
9090 (1) organization, existence, or validity;
9191 (2) right to issue any type of bonds for the purposes
9292 for which the district is created or to pay the principal of and
9393 interest on the bonds;
9494 (3) right to impose or collect an assessment or tax; or
9595 (4) legality or operation.
9696 Sec. 4016.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9797 All or any part of the area of the district is eligible to be
9898 included in:
9999 (1) a tax increment reinvestment zone created under
100100 Chapter 311, Tax Code; or
101101 (2) a tax abatement reinvestment zone created under
102102 Chapter 312, Tax Code.
103103 Sec. 4016.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
104104 DISTRICTS LAW. Except as otherwise provided by this chapter,
105105 Chapter 375, Local Government Code, applies to the district.
106106 Sec. 4016.0108. CONSTRUCTION OF CHAPTER. This chapter
107107 shall be liberally construed in conformity with the findings and
108108 purposes stated in this chapter.
109109 SUBCHAPTER B. BOARD OF DIRECTORS
110110 Sec. 4016.0201. GOVERNING BODY; TERMS. (a) The district is
111111 governed by a board of five elected directors who serve staggered
112112 terms of four years.
113113 (b) Directors are elected in the manner provided by
114114 Subchapter D, Chapter 49, Water Code.
115115 Sec. 4016.0202. COMPENSATION; EXPENSES. (a) The district
116116 may compensate each director in an amount not to exceed $150 for
117117 each board meeting. The total amount of compensation for each
118118 director in one year may not exceed $7,200.
119119 (b) A director is entitled to reimbursement for necessary
120120 and reasonable expenses incurred in carrying out the duties and
121121 responsibilities of the board.
122122 (c) Sections 375.069 and 375.070, Local Government Code, do
123123 not apply to the board.
124124 Sec. 4016.0203. INITIAL DIRECTORS. (a) The initial board
125125 consists of the following directors:

138138 (b) Of the initial directors, the terms of directors
139139 appointed for positions one through three expire June 1, 2027, and
140140 the terms of directors appointed for positions four and five expire
141141 June 1, 2029.
142142 SUBCHAPTER C. POWERS AND DUTIES
143143 Sec. 4016.0301. GENERAL POWERS AND DUTIES. The district
144144 has the powers and duties necessary to accomplish the purposes for
145145 which the district is created.
146146 Sec. 4016.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
147147 district, using any money available to the district for the
148148 purpose, may provide, design, construct, acquire, improve,
149149 relocate, operate, maintain, or finance an improvement project or
150150 service authorized under this chapter or under Chapter 375, Local
151151 Government Code.
152152 (b) The district may contract with a governmental or private
153153 entity to carry out an action under Subsection (a).
154154 (c) The implementation of a district project or service is a
155155 governmental function or service for the purposes of Chapter 791,
156156 Government Code.
157157 Sec. 4016.0303. NONPROFIT CORPORATION. (a) The board by
158158 resolution may authorize the creation of a nonprofit corporation to
159159 assist and act for the district in implementing a project or
160160 providing a service authorized by this chapter.
161161 (b) The nonprofit corporation:
162162 (1) has each power of and is considered to be a local
163163 government corporation created under Subchapter D, Chapter 431,
164164 Transportation Code; and
165165 (2) may implement any project and provide any service
166166 authorized by this chapter.
167167 (c) The board shall appoint the board of directors of the
168168 nonprofit corporation. The board of directors of the nonprofit
169169 corporation shall serve in the same manner as the board of directors
170170 of a local government corporation created under Subchapter D,
171171 Chapter 431, Transportation Code, except that a board member is not
172172 required to reside in the district.
173173 Sec. 4016.0304. LAW ENFORCEMENT SERVICES. To protect the
174174 public interest, the district may contract with a qualified party,
175175 including the city, to provide law enforcement services in the
176176 district for a fee.
177177 Sec. 4016.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
178178 The district may join and pay dues to a charitable or nonprofit
179179 organization that performs a service or provides an activity
180180 consistent with the furtherance of a district purpose.
181181 Sec. 4016.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
182182 district may engage in activities that accomplish the economic
183183 development purposes of the district.
184184 (b) The district may establish and provide for the
185185 administration of one or more programs to promote state or local
186186 economic development and to stimulate business and commercial
187187 activity in the district, including programs to:
188188 (1) make loans and grants of public money; and
189189 (2) provide district personnel and services.
190190 (c) The district may create economic development programs
191191 and exercise the economic development powers provided to
192192 municipalities by:
193193 (1) Chapter 380, Local Government Code; and
194194 (2) Subchapter A, Chapter 1509, Government Code.
195195 Sec. 4016.0307. PARKING FACILITIES. (a) The district may
196196 acquire, lease as lessor or lessee, construct, develop, own,
197197 operate, and maintain parking facilities or a system of parking
198198 facilities, including lots, garages, parking terminals, or other
199199 structures or accommodations for parking motor vehicles off the
200200 streets and related appurtenances.
201201 (b) The district's parking facilities serve the public
202202 purposes of the district and are owned, used, and held for a public
203203 purpose even if leased or operated by a private entity for a term of
204204 years.
205205 (c) The district's parking facilities are parts of and
206206 necessary components of a street and are considered to be a street
207207 or road improvement.
208208 (d) The development and operation of the district's parking
209209 facilities may be considered an economic development program.
210210 Sec. 4016.0308. DISBURSEMENTS AND TRANSFERS OF MONEY. The
211211 board by resolution shall establish the number of directors'
212212 signatures and the procedure required for a disbursement or
213213 transfer of district money.
214214 Sec. 4016.0309. ADDING OR EXCLUDING LAND. Except as
215215 provided by Section 4016.0310, the district may add or exclude land
216216 in the manner provided by Subchapter J, Chapter 49, Water Code, or
217217 by Subchapter H, Chapter 54, Water Code.
218218 Sec. 4016.0310. DIVISION OF DISTRICT. (a) The district may
219219 be divided into two or more new districts only if the district:
220220 (1) has no outstanding bonded debt; and
221221 (2) is not imposing ad valorem taxes.
222222 (b) This chapter applies to any new district created by the
223223 division of the district, and a new district has all the powers and
224224 duties of the district.
225225 (c) Any new district created by the division of the district
226226 may not, at the time the new district is created, contain any land
227227 outside the area described by Section 2 of the Act enacting this
228228 chapter.
229229 (d) The board, on its own motion or on receipt of a petition
230230 signed by the owner or owners of a majority of the assessed value of
231231 the real property in the district, may adopt an order dividing the
232232 district.
233233 (e) An order dividing the district must:
234234 (1) name each new district;
235235 (2) include the metes and bounds description of the
236236 territory of each new district;
237237 (3) appoint initial directors for each new district;
238238 and
239239 (4) provide for the division of assets and liabilities
240240 between or among the new districts.
241241 (f) On or before the 30th day after the date of adoption of
242242 an order dividing the district, the district shall file the order
243243 with the Texas Commission on Environmental Quality and record the
244244 order in the real property records of each county in which the
245245 district is located.
246246 (g) Any new district created by the division of the district
247247 must hold an election as required by this chapter to obtain voter
248248 approval before the district may impose a maintenance tax or issue
249249 bonds payable wholly or partly from ad valorem taxes.
250250 (h) Municipal consent to the creation of the district and to
251251 the inclusion of land in the district granted under Section
252252 4016.0506 acts as municipal consent to the creation of any new
253253 district created by the division of the district and to the
254254 inclusion of land in the new district.
255255 Sec. 4016.0311. EMINENT DOMAIN. The district may exercise
256256 the power of eminent domain in the manner provided by Section
257257 49.222, Water Code.
258258 SUBCHAPTER D. ASSESSMENTS
259259 Sec. 4016.0401. PETITION REQUIRED FOR FINANCING SERVICES
260260 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
261261 service or improvement project with assessments under this chapter
262262 unless a written petition requesting that service or improvement
263263 has been filed with the board.
264264 (b) A petition filed under Subsection (a) must be signed by
265265 the owners of a majority of the assessed value of real property in
266266 the district subject to assessment according to the most recent
267267 certified tax appraisal roll for the county.
268268 Sec. 4016.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
269269 The board by resolution may impose and collect an assessment for any
270270 purpose authorized by this chapter in all or any part of the
271271 district.
272272 (b) An assessment, a reassessment, or an assessment
273273 resulting from an addition to or correction of the assessment roll
274274 by the district, penalties and interest on an assessment or
275275 reassessment, an expense of collection, and reasonable attorney's
276276 fees incurred by the district:
277277 (1) are a first and prior lien against the property
278278 assessed;
279279 (2) are superior to any other lien or claim other than
280280 a lien or claim for county, school district, or municipal ad valorem
281281 taxes; and
282282 (3) are the personal liability of and a charge against
283283 the owners of the property even if the owners are not named in the
284284 assessment proceedings.
285285 (c) The lien is effective from the date of the board's
286286 resolution imposing the assessment until the date the assessment is
287287 paid. The board may enforce the lien in the same manner that the
288288 board may enforce an ad valorem tax lien against real property.
289289 (d) The board may make a correction to or deletion from the
290290 assessment roll that does not increase the amount of assessment of
291291 any parcel of land without providing notice and holding a hearing in
292292 the manner required for additional assessments.
293293 SUBCHAPTER E. TAXES AND BONDS
294294 Sec. 4016.0501. TAX ELECTION REQUIRED. (a) The district
295295 must hold an election in the manner provided by Chapter 49, Water
296296 Code, or, if applicable, Chapter 375, Local Government Code, to
297297 obtain voter approval before the district may impose an ad valorem
298298 tax.
299299 (b) Section 375.243, Local Government Code, does not apply
300300 to the district.
301301 Sec. 4016.0502. OPERATION AND MAINTENANCE TAX. (a) If
302302 authorized by a majority of the district voters voting at an
303303 election under Section 4016.0501, the district may impose an
304304 operation and maintenance tax on taxable property in the district
305305 in the manner provided by Section 49.107, Water Code, for any
306306 district purpose, including to:
307307 (1) maintain and operate the district;
308308 (2) construct or acquire improvements; or
309309 (3) provide a service.
310310 (b) The board shall determine the operation and maintenance
311311 tax rate. The rate may not exceed the rate approved at the
312312 election.
313313 Sec. 4016.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
314314 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
315315 terms determined by the board.
316316 (b) The district may issue, by public or private sale,
317317 bonds, notes, or other obligations payable wholly or partly from ad
318318 valorem taxes, assessments, impact fees, revenue, contract
319319 payments, grants, or other district money, or any combination of
320320 those sources of money, to pay for any authorized district purpose.
321321 (c) The district may issue, by public or private sale,
322322 bonds, notes, or other obligations payable wholly or partly from
323323 assessments in the manner provided by Subchapter A, Chapter 372,
324324 Local Government Code, if the improvement financed by the
325325 obligation issued under this section will be conveyed to or
326326 operated and maintained by a municipality or other retail utility
327327 provider pursuant to an agreement with the district entered into
328328 before the issuance of the obligation.
329329 Sec. 4016.0504. BONDS SECURED BY REVENUE OR CONTRACT
330330 PAYMENTS. The district may issue, without an election, bonds
331331 secured by:
332332 (1) revenue other than ad valorem taxes, including
333333 contract revenues; or
334334 (2) contract payments, provided that the requirements
335335 of Section 49.108, Water Code, have been met.
336336 Sec. 4016.0505. BONDS SECURED BY AD VALOREM TAXES;
337337 ELECTIONS. (a) If authorized at an election under Section
338338 4016.0501, the district may issue bonds payable from ad valorem
339339 taxes.
340340 (b) At the time the district issues bonds payable wholly or
341341 partly from ad valorem taxes, the board shall provide for the annual
342342 imposition of a continuing direct annual ad valorem tax, without
343343 limit as to rate or amount, for each year that all or part of the
344344 bonds are outstanding as required and in the manner provided by
345345 Sections 54.601 and 54.602, Water Code.
346346 (c) All or any part of any facilities or improvements that
347347 may be acquired by a district by the issuance of its bonds may be
348348 submitted as a single proposition or as several propositions to be
349349 voted on at the election.
350350 Sec. 4016.0506. CONSENT OF MUNICIPALITY REQUIRED. (a) The
351351 board may not issue bonds until each municipality in whose
352352 corporate limits or extraterritorial jurisdiction the district is
353353 located has consented by ordinance or resolution to the creation of
354354 the district and to the inclusion of land in the district as
355355 required by applicable law.
356356 (b) This section applies only to the district's first
357357 issuance of bonds payable from ad valorem taxes.
358358 SUBCHAPTER I. DISSOLUTION
359359 Sec. 4016.0901. DISSOLUTION. (a) The board shall dissolve
360360 the district on written petition filed with the board by the owners
361361 of:
362362 (1) at least two-thirds of the assessed value of the
363363 property subject to assessment by the district based on the most
364364 recent certified county property tax rolls; or
365365 (2) at least two-thirds of the surface area of the
366366 district, excluding roads, streets, highways, utility
367367 rights-of-way, other public areas, and other property exempt from
368368 assessment by the district according to the most recent certified
369369 county property tax rolls.
370370 (b) The board by majority vote may dissolve the district at
371371 any time.
372372 (c) The district may not be dissolved by its board under
373373 Subsection (a) or (b) if the district:
374374 (1) has any outstanding bonded indebtedness until that
375375 bonded indebtedness has been repaid or defeased in accordance with
376376 the order or resolution authorizing the issuance of the bonds;
377377 (2) has a contractual obligation to pay money until
378378 that obligation has been fully paid in accordance with the
379379 contract; or
380380 (3) owns, operates, or maintains public works,
381381 facilities, or improvements unless the district contracts with
382382 another person for the ownership, operation, or maintenance of the
383383 public works, facilities, or improvements.
384384 (d) Sections 375.261, 375.262, and 375.264, Local
385385 Government Code, do not apply to the district.
386386 SECTION 2. The Bluebonnet Hills Municipal Management
387387 District No. 1 initially includes all territory contained in the
388388 following area:
389389 TRACT 1:
390390 Being a tract of land situated in the John Chamblee Survey, Abstract
391391 No. 192, in the M.E.P. & P. Railroad Survey, Abstract No. 761 and in
392392 the Allen Reeves Survey, Abstract No. 939, Ellis County, Texas, and
393393 being part of a called 367.8751 acre tract of land conveyed to
394394 Fulson Midlothian Partners I, LP by deed recorded in Volume 2220,
395395 Page 194, Official Public Records, Ellis County, Texas and part of a
396396 145.15 acre tract of land conveyed to Fulson Midlothian Partners I,
397397 LP by deed recorded in Volume 2214, Page 2136, Deed Records, Ellis
398398 County, Texas and being more particularly described as follows:
399399 Beginning at a 1/2" iron pin found with orange cap stamped
400400 "8172753361" on the northwest line of said 367.8751 acre tract, on
401401 the southeast line of a 406.638 acre tract of land conveyed to One
402402 Windsor Hills, LP by deed recorded in Volume 2206, Page 1415, Deed
403403 Records, Ellis County, Texas and being the north corner of Tract 4,
404404 a 9.607 acre tract of land conveyed to Kruthin, LLC by deed recorded
405405 in Instrument No. 2136939, Official Public Records, Ellis County,
406406 Texas;
407407 Thence, North 58°46'14" East, along the northwest line of said
408408 367.8751 acre tract and the southeast line of said 406.638 acre

652652 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
653653 Government Code.
654654 (b) The governor, one of the required recipients, has
655655 submitted the notice and Act to the Texas Commission on
656656 Environmental Quality.
657657 (c) The Texas Commission on Environmental Quality has filed
658658 its recommendations relating to this Act with the governor,
659659 lieutenant governor, and speaker of the house of representatives
660660 within the required time.
661661 (d) All requirements of the constitution and laws of this
662662 state and the rules and procedures of the legislature with respect
663663 to the notice, introduction, and passage of this Act have been
664664 fulfilled and accomplished.
665665 SECTION 4. (a) Section 4016.0311, Special District Local
666666 Laws Code, as added by Section 1 of this Act, takes effect only if
667667 this Act receives a two-thirds vote of all the members elected to
668668 each house.
669669 (b) If this Act does not receive a two-thirds vote of all the
670670 members elected to each house, Subchapter C, Chapter 4016, Special
671671 District Local Laws Code, as added by Section 1 of this Act, is
672672 amended by adding Section 4016.0311 to read as follows:
673673 Sec. 4016.0311. NO EMINENT DOMAIN POWER. The district may
674674 not exercise the power of eminent domain.
675675 SECTION 5. This Act takes effect immediately if it receives
676676 a vote of two-thirds of all the members elected to each house, as
677677 provided by Section 39, Article III, Texas Constitution. If this
678678 Act does not receive the vote necessary for immediate effect, this
679679 Act takes effect September 1, 2025.
