6	11		A BILL TO BE ENTITLED
7	12		AN ACT
8	13		relating to the criminal offense of passing certain vehicles on a
9	14		highway.
10	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	16		SECTION 1. Section 545.157(a), Transportation Code, is
12	17		amended to read as follows:
13	18		(a) This section applies only to the following vehicles:
14	19		(1) a stationary authorized emergency vehicle using
15	20		visual signals that meet the requirements of Sections 547.305 and
16	21		547.702;
17	22		(2) a stationary tow truck using equipment authorized
18	23		by Section 547.305(d);
19	24		(3) a Texas Department of Transportation vehicle or a
20	25		highway maintenance or construction vehicle operated pursuant to a
21	26		contract awarded under Subchapter A, Chapter 223, not separated
22	27		from the roadway by a traffic control channelizing device and using
23	28		visual signals that comply with the standards and specifications
24	29		adopted under Section 547.105;
25	30		(4) a service vehicle used by or for a utility, as
26	31		defined by Section 203.091, and using visual signals that comply
27	32		with the standards and specifications adopted under Section
28	33		547.105;
29	34		(5) a stationary vehicle used exclusively to transport
30	35		municipal solid waste, as defined by Section 361.003, Health and
31	36		Safety Code, or recyclable material, as defined by Section 361.421,
32	37		Health and Safety Code, while being operated in connection with the
33	38		removal or transportation of municipal solid waste or recyclable
34	39		material from a location adjacent to the highway; [and]
35	40		(6) a vehicle operated by or pursuant to a contract
36	41		with a toll project entity, as defined by Section 372.001, using
37	42		visual signals that comply with the standards and specifications
38	43		adopted under Section 547.105;
39	44		(7) a vehicle operated by an animal control officer,
40	45		as defined by Section 829.001, Health and Safety Code, for the
41	46		purpose of removing an animal or animal carcass from a roadway, or
42	47		an individual authorized to dispose of a carcass of an animal under
43	48		Section 361.117, Health and Safety Code, for the purpose of
44	49		removing an animal carcass from a roadway, and using visual signals
45	50		that comply with the standards and specifications adopted under
46	51		Section 547.105; and
47	52		(8) a vehicle operated by an employee of a local
48	53		authority for the purpose of issuing a parking citation and using
49	54		visual signals that comply with the standards and specifications
50	55		adopted under Section 547.105.
51	56		SECTION 2. This Act takes effect September 1, 2025.
