611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the criminal offense of passing certain vehicles on a
914 highway.
1015 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1116 SECTION 1. Section 545.157(a), Transportation Code, is
1217 amended to read as follows:
1318 (a) This section applies only to the following vehicles:
1419 (1) a stationary authorized emergency vehicle using
1520 visual signals that meet the requirements of Sections 547.305 and
1621 547.702;
1722 (2) a stationary tow truck using equipment authorized
1823 by Section 547.305(d);
1924 (3) a Texas Department of Transportation vehicle or a
2025 highway maintenance or construction vehicle operated pursuant to a
2126 contract awarded under Subchapter A, Chapter 223, not separated
2227 from the roadway by a traffic control channelizing device and using
2328 visual signals that comply with the standards and specifications
2429 adopted under Section 547.105;
2530 (4) a service vehicle used by or for a utility, as
2631 defined by Section 203.091, and using visual signals that comply
2732 with the standards and specifications adopted under Section
2833 547.105;
2934 (5) a stationary vehicle used exclusively to transport
3035 municipal solid waste, as defined by Section 361.003, Health and
3136 Safety Code, or recyclable material, as defined by Section 361.421,
3237 Health and Safety Code, while being operated in connection with the
3338 removal or transportation of municipal solid waste or recyclable
3439 material from a location adjacent to the highway; [and]
3540 (6) a vehicle operated by or pursuant to a contract
3641 with a toll project entity, as defined by Section 372.001, using
3742 visual signals that comply with the standards and specifications
3843 adopted under Section 547.105;
3944 (7) a vehicle operated by an animal control officer,
4045 as defined by Section 829.001, Health and Safety Code, for the
4146 purpose of removing an animal or animal carcass from a roadway, or
4247 an individual authorized to dispose of a carcass of an animal under
4348 Section 361.117, Health and Safety Code, for the purpose of
4449 removing an animal carcass from a roadway, and using visual signals
4550 that comply with the standards and specifications adopted under
4651 Section 547.105; and
4752 (8) a vehicle operated by an employee of a local
4853 authority for the purpose of issuing a parking citation and using
4954 visual signals that comply with the standards and specifications
5055 adopted under Section 547.105.
5156 SECTION 2. This Act takes effect September 1, 2025.
