8	8	relating to the creation of the Alluvium Ranch Municipal Management
9	9	District No. 1; providing authority to issue bonds; providing
10	10	authority to impose assessments, fees, and taxes; granting a
11	11	limited power of eminent domain.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subtitle C, Title 4, Special District Local Laws
14	14	Code, is amended by adding Chapter 4014 to read as follows:
15	15	CHAPTER 4014. ALLUVIUM RANCH MUNICIPAL MANAGEMENT DISTRICT NO. 1
16	16	SUBCHAPTER A. GENERAL PROVISIONS
17	17	Sec. 4014.0101. DEFINITIONS. In this chapter:
18	18	(1) "Board" means the district's board of directors.
19	19	(2) "City" means the City of Sherman.
20	20	(3) "County" means Grayson County.
21	21	(4) "Director" means a board member.
22	22	(5) "District" means the Alluvium Ranch Municipal
23	23	Management District No. 1.
24	24	Sec. 4014.0102. NATURE OF DISTRICT. The Alluvium Ranch
25	25	Municipal Management District No. 1 is a special district created
26	26	under Section 59, Article XVI, Texas Constitution.
27	27	Sec. 4014.0103. PURPOSE; DECLARATION OF INTENT. (a) The
28	28	creation of the district is essential to accomplish the purposes of
29	29	Sections 52 and 52-a, Article III, and Section 59, Article XVI,
30	30	Texas Constitution, and other public purposes stated in this
31	31	chapter.
32	32	(b) By creating the district and in authorizing the city,
33	33	the county, or other political subdivisions to contract with the
34	34	district, the legislature has established a program to accomplish
35	35	the public purposes set out in Section 52-a, Article III, Texas
36	36	Constitution.
37	37	(c) The creation of the district is necessary to promote,
38	38	develop, encourage, and maintain employment, commerce,
39	39	transportation, housing, tourism, recreation, the arts,
40	40	entertainment, economic development, safety, and the public
41	41	welfare in the district.
42	42	(d) This chapter and the creation of the district may not be
43	43	interpreted to relieve the city or county from providing the level
44	44	of services provided as of the effective date of the Act enacting
45	45	this chapter to the area in the district. The district is created
46	46	to supplement and not to supplant any city or county services
47	47	provided in the district.
48	48	Sec. 4014.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
49	49	(a) All land and other property included in the district will
50	50	benefit from the improvements and services to be provided by the
51	51	district under powers conferred by Sections 52 and 52-a, Article
52	52	III, and Section 59, Article XVI, Texas Constitution, and other
53	53	powers granted under this chapter.
54	54	(b) The district is created to serve a public use and
55	55	benefit.
56	56	(c) The creation of the district is in the public interest
57	57	and is essential to further the public purposes of:
58	58	(1) developing and diversifying the economy of the
59	59	state;
60	60	(2) eliminating unemployment and underemployment; and
61	61	(3) developing or expanding transportation and
62	62	commerce.
63	63	(d) The district will:
64	64	(1) promote the health, safety, and general welfare of
65	65	residents, employers, potential employees, employees, visitors,
66	66	and consumers in the district, and of the public;
67	67	(2) provide needed funding for the district to
68	68	preserve, maintain, and enhance the economic health and vitality of
69	69	the district territory as a community and business center;
70	70	(3) promote the health, safety, welfare, and enjoyment
71	71	of the public by providing pedestrian ways and by landscaping and
72	72	developing certain areas in the district, which are necessary for
73	73	the restoration, preservation, and enhancement of scenic beauty;
74	74	and
75	75	(4) provide for water, wastewater, drainage, road, and
76	76	recreational facilities for the district.
77	77	(e) Pedestrian ways along or across a street, whether at
78	78	grade or above or below the surface, and street lighting, street
79	79	landscaping, parking, and street art objects are parts of and
80	80	necessary components of a street and are considered to be a street
81	81	or road improvement.
82	82	(f) The district will not act as the agent or
83	83	instrumentality of any private interest even though the district
84	84	will benefit many private interests as well as the public.
85	85	Sec. 4014.0105. INITIAL DISTRICT TERRITORY. (a) The
86	86	district is initially composed of the territory described by
87	87	Section 2 of the Act enacting this chapter.
88	88	(b) The boundaries and field notes contained in Section 2 of
89	89	the Act enacting this chapter form a closure. A mistake in the
90	90	field notes or in copying the field notes in the legislative process
91	91	does not affect the district's:
92	92	(1) organization, existence, or validity;
93	93	(2) right to issue any type of bonds for the purposes
94	94	for which the district is created or to pay the principal of and
95	95	interest on the bonds;
96	96	(3) right to impose or collect an assessment or tax; or
97	97	(4) legality or operation.
98	98	Sec. 4014.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
99	99	All or any part of the area of the district is eligible to be
100	100	included in:
101	101	(1) a tax increment reinvestment zone created under
102	102	Chapter 311, Tax Code; or
103	103	(2) a tax abatement reinvestment zone created under
104	104	Chapter 312, Tax Code.
105	105	Sec. 4014.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
106	106	DISTRICTS LAW. Except as otherwise provided by this chapter,
107	107	Chapter 375, Local Government Code, applies to the district.
108	108	Sec. 4014.0108. CONSTRUCTION OF CHAPTER. This chapter
109	109	shall be liberally construed in conformity with the findings and
110	110	purposes stated in this chapter.
111	111	SUBCHAPTER B. BOARD OF DIRECTORS
112	112	Sec. 4014.0201. GOVERNING BODY; TERMS. (a) The district is
113	113	governed by a board of five elected directors who serve staggered
114	114	terms of four years.
115	115	(b) Directors are elected in the manner provided by
116	116	Subchapter D, Chapter 49, Water Code.
117	117	Sec. 4014.0202. COMPENSATION; EXPENSES. (a) The district
118	118	may compensate each director in an amount not to exceed $150 for
119	119	each board meeting. The total amount of compensation for each
120	120	director in one year may not exceed $7,200.
121	121	(b) A director is entitled to reimbursement for necessary
122	122	and reasonable expenses incurred in carrying out the duties and
123	123	responsibilities of the board.
124	124	(c) Sections 375.069 and 375.070, Local Government Code, do
125	125	not apply to the board.
126	126	Sec. 4014.0203. INITIAL DIRECTORS. (a) The initial board
127	127	consists of the following directors:

140	140	(b) Of the initial directors, the terms of directors
141	141	appointed for positions one through three expire June 1, 2027, and
142	142	the terms of directors appointed for positions four and five expire
143	143	June 1, 2029.
144	144	SUBCHAPTER C. POWERS AND DUTIES
145	145	Sec. 4014.0301. GENERAL POWERS AND DUTIES. The district
146	146	has the powers and duties necessary to accomplish the purposes for
147	147	which the district is created.
148	148	Sec. 4014.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
149	149	district, using any money available to the district for the
150	150	purpose, may provide, design, construct, acquire, improve,
151	151	relocate, operate, maintain, or finance an improvement project or
152	152	service authorized under this chapter or under Chapter 375, Local
153	153	Government Code.
154	154	(b) The district may contract with a governmental or private
155	155	entity to carry out an action under Subsection (a).
156	156	(c) The implementation of a district project or service is a
157	157	governmental function or service for the purposes of Chapter 791,
158	158	Government Code.
159	159	Sec. 4014.0303. NONPROFIT CORPORATION. (a) The board by
160	160	resolution may authorize the creation of a nonprofit corporation to
161	161	assist and act for the district in implementing a project or
162	162	providing a service authorized by this chapter.
163	163	(b) The nonprofit corporation:
164	164	(1) has each power of and is considered to be a local
165	165	government corporation created under Subchapter D, Chapter 431,
166	166	Transportation Code; and
167	167	(2) may implement any project and provide any service
168	168	authorized by this chapter.
169	169	(c) The board shall appoint the board of directors of the
170	170	nonprofit corporation. The board of directors of the nonprofit
171	171	corporation shall serve in the same manner as the board of directors
172	172	of a local government corporation created under Subchapter D,
173	173	Chapter 431, Transportation Code, except that a board member is not
174	174	required to reside in the district.
175	175	Sec. 4014.0304. LAW ENFORCEMENT SERVICES. To protect the
176	176	public interest, the district may contract with a qualified party,
177	177	including the city or the county, to provide law enforcement
178	178	services in the district for a fee.
179	179	Sec. 4014.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
180	180	The district may join and pay dues to a charitable or nonprofit
181	181	organization that performs a service or provides an activity
182	182	consistent with the furtherance of a district purpose.
183	183	Sec. 4014.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
184	184	district may engage in activities that accomplish the economic
185	185	development purposes of the district.
186	186	(b) The district may establish and provide for the
187	187	administration of one or more programs to promote state or local
188	188	economic development and to stimulate business and commercial
189	189	activity in the district, including programs to:
190	190	(1) make loans and grants of public money; and
191	191	(2) provide district personnel and services.
192	192	(c) The district may create economic development programs
193	193	and exercise the economic development powers provided to
194	194	municipalities by:
195	195	(1) Chapter 380, Local Government Code; and
196	196	(2) Subchapter A, Chapter 1509, Government Code.
197	197	Sec. 4014.0307. PARKING FACILITIES. (a) The district may
198	198	acquire, lease as lessor or lessee, construct, develop, own,
199	199	operate, and maintain parking facilities or a system of parking
200	200	facilities, including lots, garages, parking terminals, or other
201	201	structures or accommodations for parking motor vehicles off the
202	202	streets and related appurtenances.
203	203	(b) The district's parking facilities serve the public
204	204	purposes of the district and are owned, used, and held for a public
205	205	purpose even if leased or operated by a private entity for a term of
206	206	years.
207	207	(c) The district's parking facilities are parts of and
208	208	necessary components of a street and are considered to be a street
209	209	or road improvement.
210	210	(d) The development and operation of the district's parking
211	211	facilities may be considered an economic development program.
212	212	Sec. 4014.0308. DISBURSEMENTS AND TRANSFERS OF MONEY. The
213	213	board by resolution shall establish the number of directors'
214	214	signatures and the procedure required for a disbursement or
215	215	transfer of district money.
216	216	Sec. 4014.0309. ADDING OR EXCLUDING LAND. Except as
217	217	provided by Section 4014.0310, the district may add or exclude land
218	218	in the manner provided by Subchapter J, Chapter 49, Water Code, or
219	219	by Subchapter H, Chapter 54, Water Code.
220	220	Sec. 4014.0310. DIVISION OF DISTRICT. (a) The district may
221	221	be divided into two or more new districts only if the district has
222	222	no outstanding bonded debt.
223	223	(b) This chapter applies to any new district created by the
224	224	division of the district, and a new district has all the powers and
225	225	duties of the district.
226	226	(c) Any new district created by the division of the district
227	227	may not, at the time the new district is created, contain any land
228	228	outside the area described by Section 2 of the Act enacting this
229	229	chapter.
230	230	(d) The board, on its own motion or on receipt of a petition
231	231	signed by the owner or owners of a majority of the assessed value of
232	232	the real property in the district, may adopt an order dividing the
233	233	district.
234	234	(e) An order dividing the district must:
235	235	(1) name each new district;
236	236	(2) include the metes and bounds description of the
237	237	territory of each new district;
238	238	(3) appoint initial directors for each new district;
239	239	and
240	240	(4) provide for the division of assets and liabilities
241	241	between or among the new districts.
242	242	(f) On or before the 30th day after the date of adoption of
243	243	an order dividing the district, the district shall file the order
244	244	with the Texas Commission on Environmental Quality and record the
245	245	order in the real property records of each county in which the
246	246	district is located.
247	247	(g) A political subdivision's consent to the creation of the
248	248	district and to the inclusion of land in the district granted under
249	249	Section 4014.0505 acts as the political subdivision's consent to
250	250	the creation of any new district created by the division of the
251	251	district and to the inclusion of land in the new district.
252	252	(h) Any new district created by the division of the district
253	253	must hold an election as required by this chapter to obtain voter
254	254	approval before the district may impose a maintenance tax.
255	255	Sec. 4014.0311. CERTAIN RESIDENTIAL PROPERTY NOT EXEMPT.
256	256	Section 375.161, Local Government Code, does not apply to the
257	257	district.
258	258	Sec. 4014.0312. EMINENT DOMAIN. The district may exercise
259	259	the power of eminent domain in the manner provided by Section
260	260	49.222, Water Code.
261	261	SUBCHAPTER D. ASSESSMENTS
262	262	Sec. 4014.0401. PETITION REQUIRED FOR FINANCING SERVICES
263	263	AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
264	264	service or improvement project with assessments under this chapter
265	265	unless a written petition requesting that service or improvement
266	266	has been filed with the board.
267	267	(b) A petition filed under Subsection (a) must be signed by
268	268	the owners of a majority of the assessed value of real property in
269	269	the district subject to assessment according to the most recent
270	270	certified tax appraisal roll for the county.
271	271	Sec. 4014.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
272	272	The board by resolution may impose and collect an assessment for any
273	273	purpose authorized by this chapter in all or any part of the
274	274	district.
275	275	(b) An assessment, a reassessment, or an assessment
276	276	resulting from an addition to or correction of the assessment roll
277	277	by the district, penalties and interest on an assessment or
278	278	reassessment, an expense of collection, and reasonable attorney's
279	279	fees incurred by the district:
280	280	(1) are a first and prior lien against the property
281	281	assessed;
282	282	(2) are superior to any other lien or claim other than
283	283	a lien or claim for county, school district, or municipal ad valorem
284	284	taxes; and
285	285	(3) are the personal liability of and a charge against
286	286	the owners of the property even if the owners are not named in the
287	287	assessment proceedings.
288	288	(c) The lien is effective from the date of the board's
289	289	resolution imposing the assessment until the date the assessment is
290	290	paid. The board may enforce the lien in the same manner that the
291	291	board may enforce an ad valorem tax lien against real property.
292	292	(d) The board may make a correction to or deletion from the
293	293	assessment roll that does not increase the amount of assessment of
294	294	any parcel of land without providing notice and holding a hearing in
295	295	the manner required for additional assessments.
296	296	SUBCHAPTER E. TAXES AND BONDS
297	297	Sec. 4014.0501. TAX ELECTION REQUIRED. (a) The district
298	298	must hold an election in the manner provided by Chapter 49, Water
299	299	Code, or, if applicable, Chapter 375, Local Government Code, to
300	300	obtain voter approval before the district may impose an ad valorem
301	301	tax.
302	302	(b) Section 375.243, Local Government Code, does not apply
303	303	to the district.
304	304	Sec. 4014.0502. OPERATION AND MAINTENANCE TAX. (a) If
305	305	authorized by a majority of the district voters voting at an
306	306	election under Section 4014.0501, the district may impose an
307	307	operation and maintenance tax on taxable property in the district
308	308	in the manner provided by Section 49.107, Water Code, for any
309	309	district purpose, including to:
310	310	(1) maintain and operate the district;
311	311	(2) construct or acquire improvements; or
312	312	(3) provide a service.
313	313	(b) The board shall determine the operation and maintenance
314	314	tax rate. The rate may not exceed the rate approved at the
315	315	election.
316	316	Sec. 4014.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
317	317	BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
318	318	terms determined by the board.
319	319	(b) The district may issue, by public or private sale,
320	320	bonds, notes, or other obligations payable wholly or partly from
321	321	assessments, impact fees, revenue, contract payments, grants, or
322	322	other district money, or any combination of those sources of money,
323	323	to pay for any authorized district purpose.
324	324	(c) The district may not issue bonds, notes, or other
325	325	obligations payable wholly or partly from ad valorem taxes.
326	326	(d) The district may issue, by public or private sale,
327	327	bonds, notes, or other obligations payable wholly or partly from
328	328	assessments in the manner provided by Subchapter A, Chapter 372,
329	329	Local Government Code, if the improvement financed by the
330	330	obligation issued under this section will be conveyed to or
331	331	operated and maintained by a municipality, county, or other retail
332	332	utility provider pursuant to an agreement with the district entered
333	333	into before the issuance of the obligation.
334	334	Sec. 4014.0504. BONDS SECURED BY REVENUE OR CONTRACT
335	335	PAYMENTS. The district may issue, without an election, bonds
336	336	secured by:
337	337	(1) revenue other than ad valorem taxes, including
338	338	contract revenues; or
339	339	(2) contract payments, provided that the requirements
340	340	of Section 49.108, Water Code, have been met.
341	341	Sec. 4014.0505. CONSENT OF POLITICAL SUBDIVISION REQUIRED.
342	342	(a) The board may not issue bonds until each political subdivision
343	343	in which the district is located from which consent is required by
344	344	applicable general law has consented by ordinance or resolution to
345	345	the creation of the district and to the inclusion of land in the
346	346	district.
347	347	(b) This section applies only to the district's first
348	348	issuance of bonds.
349	349	SUBCHAPTER I. DISSOLUTION
350	350	Sec. 4014.0901. DISSOLUTION. (a) The board shall dissolve
351	351	the district on written petition filed with the board by the owners
352	352	of:
353	353	(1) at least two-thirds of the assessed value of the
354	354	property subject to assessment by the district based on the most
355	355	recent certified county property tax rolls; or
356	356	(2) at least two-thirds of the surface area of the
357	357	district, excluding roads, streets, highways, utility
358	358	rights-of-way, other public areas, and other property exempt from
359	359	assessment by the district according to the most recent certified
360	360	county property tax rolls.
361	361	(b) The board by majority vote may dissolve the district at
362	362	any time.
363	363	(c) The district may not be dissolved by its board under
364	364	Subsection (a) or (b) if the district:
365	365	(1) has any outstanding bonded indebtedness until that
366	366	bonded indebtedness has been repaid or defeased in accordance with
367	367	the order or resolution authorizing the issuance of the bonds;
368	368	(2) has a contractual obligation to pay money until
369	369	that obligation has been fully paid in accordance with the
370	370	contract; or
371	371	(3) owns, operates, or maintains public works,
372	372	facilities, or improvements unless the district contracts with
373	373	another person for the ownership, operation, or maintenance of the
374	374	public works, facilities, or improvements.
375	375	(d) Sections 375.261, 375.262, and 375.264, Local
376	376	Government Code, do not apply to the district.
377	377	SECTION 2. The Alluvium Ranch Municipal Management District
378	378	No. 1 initially includes all territory contained in the following
379	379	area:
380	380	BEING a tract of land situated in the Aaron Burleson Survey,
381	381	Abstract No. 61, James Blagg Survey, Abstract No. 63 and the James
382	382	Fox Survey, Abstract No. 425, Grayson County, Texas, and being all
383	383	of a called "First Tract", all of a called "Third Tract", and part
384	384	of a called "Second Tract, described in a deed to Gerald Eugene
385	385	Russell, as recorded in Volume 4450, Page 379, all of a called
386	386	"Third Tract", all of a called "Fourth Tract", all of a called
387	387	"Fifth Tract", and part of a called "First Tract, described in a
388	388	deed to Carolyn Washburn Russell and husband, Gerald Eugene
389	389	Russell, as recorded in Volume 4450, Page 386, and all of a called
390	390	49.884-acre tract of land, described in a deed to Gerald Eugene
391	391	Russell and Carolyn Washburn Russell, as recorded in Instrument
392	392	No. 2018-4763, all of the Official Records, Grayson County, Texas,
393	393	and being more particularly described by metes and bounds as
394	394	follows:
395	395	BEGINNING at a 5/8-inch iron rod with red plastic cap stamped "KHA"
396	396	set for the southeast corner of said "First Tract" (V4450/P386) and
397	397	the southwest corner of a called 1.2-acre tract of land described in
398	398	a deed to Christopher B. Robinson and Luanna Colette Robinson, as
399	399	recorded in Volume 5634, Page 832, said Official Records, same
400	400	being on the northerly right-of-way line of F. M. 697, a 100 foot
401	401	right of way;
402	402	THENCE North 83°50'59" West, along the southerly line of said "First
403	403	Tract" (V4450/P386) and along the northerly right-of-way line of
404	404	said F. M. 697, and generally along a barbed wire fence, a distance
405	405	of 467.07 feet to a point for corner from which a concrete monument
406	406	found for witness bears South 39°51'38" West, 1.65 feet, same being
407	407	at the beginning of a tangent curve to the right with a radius of
408	408	522.96 feet, a central angle of 02°04'00", and a chord bearing and
409	409	distance of North 82°49'00" West, 18.86 feet;
410	410	THENCE in a westerly direction, continuing along the southerly line
411	411	of said "First Tract" (V4450/P386) and the northerly right-of-way
412	412	line of said F. M. 697, and generally along a barbed wire fence, and
413	413	with said curve to the right, an arc distance of 18.86 feet to a
414	414	5/8-inch iron rod with a red plastic cap, stamped "KHA" set on the
415	415	northerly right of way line of said F. M. 697;
416	416	THENCE North 09°06'10" East, departing the northerly right of way
417	417	line of said F. M. 697, over and across said "First Tract"
418	418	(V4450/P386), a distance of 848.30 feet to a 5/8-inch iron rod with
419	419	a red plastic cap, stamped "KHA" set for corner;
420	420	THENCE North 75°29'11" West, continuing across said "First Tract"
421	421	(V4450/P386), a distance of 680.84 feet to a 5/8-inch iron rod with
422	422	a red plastic cap, stamped "KHA" set for corner on the westerly line
423	423	of said "First Tract" (V4450/P386), same being on the easterly line
424	424	of a called 20.000-acre tract of land, described in a deed to Jeff
425	425	Lillard and wife, Nicole Lillard, as recorded in Volume 3845, Page
426	426	642, said Official Records;
427	427	THENCE North 14°30'49" East, along the westerly line of said "First
428	428	Tract" (V4450/P386) and the easterly line of said 20.000-acre
429	429	tract, and generally along a barbed wire fence, a distance of
430	430	1,002.95 feet to a 1/2-inch iron rod found for the northeast corner
431	431	of said 20.000-acre tract, same being the southeast corner of a
432	432	called 33.000-acre tract of land, described in a deed to Majestic
433	433	Acres, LLC, as recorded in Instrument No. 2021-36701, said Official
434	434	Records;
435	435	THENCE North 14°24'17" East, along the westerly line of said "First
436	436	Tract" (V4450/P386) and the easterly line of said 33.000-acre
437	437	tract, passing a 1/2-inch iron rod found for the northwest corner of
438	438	said "First Tract" (V4450/P386) and the southwest corner of
439	439	aforesaid 49.884-acre tract, and continuing along the westerly line
440	440	of said 49.884-acre tract, and generally along a barbed wire fence,
441	441	a distance of 970.56 feet to a 1/2-inch iron rod found for the
442	442	northeast corner of said 33.000-acre tract and the southeast corner
443	443	of the aforesaid "First Tract" (V4450/P379);
444	444	THENCE North 74°43'02" West, along the southerly line of said "First
445	445	Tract" (V4450/P379) and the northerly line of said 33.000-acre
446	446	tract, and generally along a barbed wire fence, passing a 5/8-inch
447	447	iron rod with a plastic cap, stamped "PRESTON TRAILS LAND
448	448	SURVEYING" found for the northerly, northwest corner of said
449	449	33.000-acre tract and the northeast corner of the remainder of a

1005	1005	SECTION 3. (a) The legal notice of the intention to
1006	1006	introduce this Act, setting forth the general substance of this
1007	1007	Act, has been published as provided by law, and the notice and a
1008	1008	copy of this Act have been furnished to all persons, agencies,
1009	1009	officials, or entities to which they are required to be furnished
1010	1010	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
1011	1011	Government Code.
1012	1012	(b) The governor, one of the required recipients, has
1013	1013	submitted the notice and Act to the Texas Commission on
1014	1014	Environmental Quality.
1015	1015	(c) The Texas Commission on Environmental Quality has filed
1016	1016	its recommendations relating to this Act with the governor,
1017	1017	lieutenant governor, and speaker of the house of representatives
1018	1018	within the required time.
1019	1019	(d) All requirements of the constitution and laws of this
1020	1020	state and the rules and procedures of the legislature with respect
1021	1021	to the notice, introduction, and passage of this Act have been
1022	1022	fulfilled and accomplished.
1023	1023	SECTION 4. (a) Section 4014.0312, Special District Local
1024	1024	Laws Code, as added by Section 1 of this Act, takes effect only if
1025	1025	this Act receives a two-thirds vote of all the members elected to
1026	1026	each house.
1027	1027	(b) If this Act does not receive a two-thirds vote of all the
1028	1028	members elected to each house, Subchapter C, Chapter 4014, Special
1029	1029	District Local Laws Code, as added by Section 1 of this Act, is
1030	1030	amended by adding Section 4014.0312 to read as follows:
1031	1031	Sec. 4014.0312. NO EMINENT DOMAIN POWER. The district may
1032	1032	not exercise the power of eminent domain.
1033	1033	SECTION 5. This Act takes effect immediately if it receives
1034	1034	a vote of two-thirds of all the members elected to each house, as
1035	1035	provided by Section 39, Article III, Texas Constitution. If this
1036	1036	Act does not receive the vote necessary for immediate effect, this
1037	1037	Act takes effect September 1, 2025.
