88 relating to the creation of the Alluvium Ranch Municipal Management
99 District No. 1; providing authority to issue bonds; providing
1010 authority to impose assessments, fees, and taxes; granting a
1111 limited power of eminent domain.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1414 Code, is amended by adding Chapter 4014 to read as follows:
1515 CHAPTER 4014. ALLUVIUM RANCH MUNICIPAL MANAGEMENT DISTRICT NO. 1
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 4014.0101. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "City" means the City of Sherman.
2020 (3) "County" means Grayson County.
2121 (4) "Director" means a board member.
2222 (5) "District" means the Alluvium Ranch Municipal
2323 Management District No. 1.
2424 Sec. 4014.0102. NATURE OF DISTRICT. The Alluvium Ranch
2525 Municipal Management District No. 1 is a special district created
2626 under Section 59, Article XVI, Texas Constitution.
2727 Sec. 4014.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2828 creation of the district is essential to accomplish the purposes of
2929 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
3030 Texas Constitution, and other public purposes stated in this
3131 chapter.
3232 (b) By creating the district and in authorizing the city,
3333 the county, or other political subdivisions to contract with the
3434 district, the legislature has established a program to accomplish
3535 the public purposes set out in Section 52-a, Article III, Texas
3636 Constitution.
3737 (c) The creation of the district is necessary to promote,
3838 develop, encourage, and maintain employment, commerce,
3939 transportation, housing, tourism, recreation, the arts,
4040 entertainment, economic development, safety, and the public
4141 welfare in the district.
4242 (d) This chapter and the creation of the district may not be
4343 interpreted to relieve the city or county from providing the level
4444 of services provided as of the effective date of the Act enacting
4545 this chapter to the area in the district. The district is created
4646 to supplement and not to supplant any city or county services
4747 provided in the district.
4848 Sec. 4014.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4949 (a) All land and other property included in the district will
5050 benefit from the improvements and services to be provided by the
5151 district under powers conferred by Sections 52 and 52-a, Article
5252 III, and Section 59, Article XVI, Texas Constitution, and other
5353 powers granted under this chapter.
5454 (b) The district is created to serve a public use and
5555 benefit.
5656 (c) The creation of the district is in the public interest
5757 and is essential to further the public purposes of:
5858 (1) developing and diversifying the economy of the
5959 state;
6060 (2) eliminating unemployment and underemployment; and
6161 (3) developing or expanding transportation and
6262 commerce.
6363 (d) The district will:
6464 (1) promote the health, safety, and general welfare of
6565 residents, employers, potential employees, employees, visitors,
6666 and consumers in the district, and of the public;
6767 (2) provide needed funding for the district to
6868 preserve, maintain, and enhance the economic health and vitality of
6969 the district territory as a community and business center;
7070 (3) promote the health, safety, welfare, and enjoyment
7171 of the public by providing pedestrian ways and by landscaping and
7272 developing certain areas in the district, which are necessary for
7373 the restoration, preservation, and enhancement of scenic beauty;
7474 and
7575 (4) provide for water, wastewater, drainage, road, and
7676 recreational facilities for the district.
7777 (e) Pedestrian ways along or across a street, whether at
7878 grade or above or below the surface, and street lighting, street
7979 landscaping, parking, and street art objects are parts of and
8080 necessary components of a street and are considered to be a street
8181 or road improvement.
8282 (f) The district will not act as the agent or
8383 instrumentality of any private interest even though the district
8484 will benefit many private interests as well as the public.
8585 Sec. 4014.0105. INITIAL DISTRICT TERRITORY. (a) The
8686 district is initially composed of the territory described by
8787 Section 2 of the Act enacting this chapter.
8888 (b) The boundaries and field notes contained in Section 2 of
8989 the Act enacting this chapter form a closure. A mistake in the
9090 field notes or in copying the field notes in the legislative process
9191 does not affect the district's:
9292 (1) organization, existence, or validity;
9393 (2) right to issue any type of bonds for the purposes
9494 for which the district is created or to pay the principal of and
9595 interest on the bonds;
9696 (3) right to impose or collect an assessment or tax; or
9797 (4) legality or operation.
9898 Sec. 4014.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9999 All or any part of the area of the district is eligible to be
100100 included in:
101101 (1) a tax increment reinvestment zone created under
102102 Chapter 311, Tax Code; or
103103 (2) a tax abatement reinvestment zone created under
104104 Chapter 312, Tax Code.
105105 Sec. 4014.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
106106 DISTRICTS LAW. Except as otherwise provided by this chapter,
107107 Chapter 375, Local Government Code, applies to the district.
108108 Sec. 4014.0108. CONSTRUCTION OF CHAPTER. This chapter
109109 shall be liberally construed in conformity with the findings and
110110 purposes stated in this chapter.
111111 SUBCHAPTER B. BOARD OF DIRECTORS
112112 Sec. 4014.0201. GOVERNING BODY; TERMS. (a) The district is
113113 governed by a board of five elected directors who serve staggered
114114 terms of four years.
115115 (b) Directors are elected in the manner provided by
116116 Subchapter D, Chapter 49, Water Code.
117117 Sec. 4014.0202. COMPENSATION; EXPENSES. (a) The district
118118 may compensate each director in an amount not to exceed $150 for
119119 each board meeting. The total amount of compensation for each
120120 director in one year may not exceed $7,200.
121121 (b) A director is entitled to reimbursement for necessary
122122 and reasonable expenses incurred in carrying out the duties and
123123 responsibilities of the board.
124124 (c) Sections 375.069 and 375.070, Local Government Code, do
125125 not apply to the board.
126126 Sec. 4014.0203. INITIAL DIRECTORS. (a) The initial board

140140 (b) Of the initial directors, the terms of directors
141141 appointed for positions one through three expire June 1, 2027, and
142142 the terms of directors appointed for positions four and five expire

144144 SUBCHAPTER C. POWERS AND DUTIES
145145 Sec. 4014.0301. GENERAL POWERS AND DUTIES. The district
146146 has the powers and duties necessary to accomplish the purposes for
147147 which the district is created.
148148 Sec. 4014.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
149149 district, using any money available to the district for the
150150 purpose, may provide, design, construct, acquire, improve,
151151 relocate, operate, maintain, or finance an improvement project or
152152 service authorized under this chapter or under Chapter 375, Local
153153 Government Code.
154154 (b) The district may contract with a governmental or private
155155 entity to carry out an action under Subsection (a).
156156 (c) The implementation of a district project or service is a
157157 governmental function or service for the purposes of Chapter 791,
158158 Government Code.
159159 Sec. 4014.0303. NONPROFIT CORPORATION. (a) The board by
160160 resolution may authorize the creation of a nonprofit corporation to
161161 assist and act for the district in implementing a project or
162162 providing a service authorized by this chapter.
163163 (b) The nonprofit corporation:
164164 (1) has each power of and is considered to be a local
165165 government corporation created under Subchapter D, Chapter 431,
166166 Transportation Code; and
167167 (2) may implement any project and provide any service
168168 authorized by this chapter.
169169 (c) The board shall appoint the board of directors of the
170170 nonprofit corporation. The board of directors of the nonprofit
171171 corporation shall serve in the same manner as the board of directors
172172 of a local government corporation created under Subchapter D,
173173 Chapter 431, Transportation Code, except that a board member is not
174174 required to reside in the district.
175175 Sec. 4014.0304. LAW ENFORCEMENT SERVICES. To protect the
176176 public interest, the district may contract with a qualified party,
177177 including the city or the county, to provide law enforcement
178178 services in the district for a fee.
179179 Sec. 4014.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
180180 The district may join and pay dues to a charitable or nonprofit
181181 organization that performs a service or provides an activity
182182 consistent with the furtherance of a district purpose.
183183 Sec. 4014.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
184184 district may engage in activities that accomplish the economic
185185 development purposes of the district.
186186 (b) The district may establish and provide for the
187187 administration of one or more programs to promote state or local
188188 economic development and to stimulate business and commercial
189189 activity in the district, including programs to:
190190 (1) make loans and grants of public money; and
191191 (2) provide district personnel and services.
192192 (c) The district may create economic development programs
193193 and exercise the economic development powers provided to
194194 municipalities by:
195195 (1) Chapter 380, Local Government Code; and
196196 (2) Subchapter A, Chapter 1509, Government Code.
197197 Sec. 4014.0307. PARKING FACILITIES. (a) The district may
198198 acquire, lease as lessor or lessee, construct, develop, own,
199199 operate, and maintain parking facilities or a system of parking
200200 facilities, including lots, garages, parking terminals, or other
201201 structures or accommodations for parking motor vehicles off the
202202 streets and related appurtenances.
203203 (b) The district's parking facilities serve the public
204204 purposes of the district and are owned, used, and held for a public
205205 purpose even if leased or operated by a private entity for a term of
206206 years.
207207 (c) The district's parking facilities are parts of and
208208 necessary components of a street and are considered to be a street
209209 or road improvement.
210210 (d) The development and operation of the district's parking
211211 facilities may be considered an economic development program.
212212 Sec. 4014.0308. DISBURSEMENTS AND TRANSFERS OF MONEY. The
213213 board by resolution shall establish the number of directors'
214214 signatures and the procedure required for a disbursement or
215215 transfer of district money.
216216 Sec. 4014.0309. ADDING OR EXCLUDING LAND. Except as
217217 provided by Section 4014.0310, the district may add or exclude land
218218 in the manner provided by Subchapter J, Chapter 49, Water Code, or
219219 by Subchapter H, Chapter 54, Water Code.
220220 Sec. 4014.0310. DIVISION OF DISTRICT. (a) The district may
221221 be divided into two or more new districts only if the district has
222222 no outstanding bonded debt.
223223 (b) This chapter applies to any new district created by the
224224 division of the district, and a new district has all the powers and
225225 duties of the district.
226226 (c) Any new district created by the division of the district
227227 may not, at the time the new district is created, contain any land
228228 outside the area described by Section 2 of the Act enacting this
229229 chapter.
230230 (d) The board, on its own motion or on receipt of a petition
231231 signed by the owner or owners of a majority of the assessed value of
232232 the real property in the district, may adopt an order dividing the
233233 district.
234234 (e) An order dividing the district must:
235235 (1) name each new district;
236236 (2) include the metes and bounds description of the
237237 territory of each new district;
238238 (3) appoint initial directors for each new district;
239239 and
240240 (4) provide for the division of assets and liabilities
241241 between or among the new districts.
242242 (f) On or before the 30th day after the date of adoption of
243243 an order dividing the district, the district shall file the order
244244 with the Texas Commission on Environmental Quality and record the
245245 order in the real property records of each county in which the
246246 district is located.
247247 (g) A political subdivision's consent to the creation of the
248248 district and to the inclusion of land in the district granted under
249249 Section 4014.0505 acts as the political subdivision's consent to
250250 the creation of any new district created by the division of the
251251 district and to the inclusion of land in the new district.
252252 (h) Any new district created by the division of the district
253253 must hold an election as required by this chapter to obtain voter
254254 approval before the district may impose a maintenance tax.
255255 Sec. 4014.0311. CERTAIN RESIDENTIAL PROPERTY NOT EXEMPT.
256256 Section 375.161, Local Government Code, does not apply to the
257257 district.
258258 Sec. 4014.0312. EMINENT DOMAIN. The district may exercise
259259 the power of eminent domain in the manner provided by Section
260260 49.222, Water Code.
261261 SUBCHAPTER D. ASSESSMENTS
262262 Sec. 4014.0401. PETITION REQUIRED FOR FINANCING SERVICES
263263 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
264264 service or improvement project with assessments under this chapter
265265 unless a written petition requesting that service or improvement
266266 has been filed with the board.
267267 (b) A petition filed under Subsection (a) must be signed by
268268 the owners of a majority of the assessed value of real property in
269269 the district subject to assessment according to the most recent
270270 certified tax appraisal roll for the county.
271271 Sec. 4014.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
272272 The board by resolution may impose and collect an assessment for any
273273 purpose authorized by this chapter in all or any part of the
274274 district.
275275 (b) An assessment, a reassessment, or an assessment
276276 resulting from an addition to or correction of the assessment roll
277277 by the district, penalties and interest on an assessment or
278278 reassessment, an expense of collection, and reasonable attorney's
279279 fees incurred by the district:
280280 (1) are a first and prior lien against the property
281281 assessed;
282282 (2) are superior to any other lien or claim other than
283283 a lien or claim for county, school district, or municipal ad valorem
284284 taxes; and
285285 (3) are the personal liability of and a charge against
286286 the owners of the property even if the owners are not named in the
287287 assessment proceedings.
288288 (c) The lien is effective from the date of the board's
289289 resolution imposing the assessment until the date the assessment is
290290 paid. The board may enforce the lien in the same manner that the
291291 board may enforce an ad valorem tax lien against real property.
292292 (d) The board may make a correction to or deletion from the
293293 assessment roll that does not increase the amount of assessment of
294294 any parcel of land without providing notice and holding a hearing in
295295 the manner required for additional assessments.
296296 SUBCHAPTER E. TAXES AND BONDS
297297 Sec. 4014.0501. TAX ELECTION REQUIRED. (a) The district
298298 must hold an election in the manner provided by Chapter 49, Water
299299 Code, or, if applicable, Chapter 375, Local Government Code, to
300300 obtain voter approval before the district may impose an ad valorem
301301 tax.
302302 (b) Section 375.243, Local Government Code, does not apply
303303 to the district.
304304 Sec. 4014.0502. OPERATION AND MAINTENANCE TAX. (a) If
305305 authorized by a majority of the district voters voting at an
306306 election under Section 4014.0501, the district may impose an
307307 operation and maintenance tax on taxable property in the district
308308 in the manner provided by Section 49.107, Water Code, for any
309309 district purpose, including to:
310310 (1) maintain and operate the district;
311311 (2) construct or acquire improvements; or
312312 (3) provide a service.
313313 (b) The board shall determine the operation and maintenance
314314 tax rate. The rate may not exceed the rate approved at the
315315 election.
316316 Sec. 4014.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
317317 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
318318 terms determined by the board.
319319 (b) The district may issue, by public or private sale,
320320 bonds, notes, or other obligations payable wholly or partly from
321321 assessments, impact fees, revenue, contract payments, grants, or
322322 other district money, or any combination of those sources of money,
323323 to pay for any authorized district purpose.
324324 (c) The district may not issue bonds, notes, or other
325325 obligations payable wholly or partly from ad valorem taxes.
326326 (d) The district may issue, by public or private sale,
327327 bonds, notes, or other obligations payable wholly or partly from
328328 assessments in the manner provided by Subchapter A, Chapter 372,
329329 Local Government Code, if the improvement financed by the
330330 obligation issued under this section will be conveyed to or
331331 operated and maintained by a municipality, county, or other retail
332332 utility provider pursuant to an agreement with the district entered
333333 into before the issuance of the obligation.
334334 Sec. 4014.0504. BONDS SECURED BY REVENUE OR CONTRACT
335335 PAYMENTS. The district may issue, without an election, bonds
336336 secured by:
337337 (1) revenue other than ad valorem taxes, including
338338 contract revenues; or
339339 (2) contract payments, provided that the requirements
340340 of Section 49.108, Water Code, have been met.
341341 Sec. 4014.0505. CONSENT OF POLITICAL SUBDIVISION REQUIRED.
342342 (a) The board may not issue bonds until each political subdivision
343343 in which the district is located from which consent is required by
344344 applicable general law has consented by ordinance or resolution to
345345 the creation of the district and to the inclusion of land in the
346346 district.
347347 (b) This section applies only to the district's first
348348 issuance of bonds.
349349 SUBCHAPTER I. DISSOLUTION
350350 Sec. 4014.0901. DISSOLUTION. (a) The board shall dissolve
351351 the district on written petition filed with the board by the owners
352352 of:
353353 (1) at least two-thirds of the assessed value of the
354354 property subject to assessment by the district based on the most
355355 recent certified county property tax rolls; or
356356 (2) at least two-thirds of the surface area of the
357357 district, excluding roads, streets, highways, utility
358358 rights-of-way, other public areas, and other property exempt from
359359 assessment by the district according to the most recent certified
360360 county property tax rolls.
361361 (b) The board by majority vote may dissolve the district at
362362 any time.
363363 (c) The district may not be dissolved by its board under
364364 Subsection (a) or (b) if the district:
365365 (1) has any outstanding bonded indebtedness until that
366366 bonded indebtedness has been repaid or defeased in accordance with
367367 the order or resolution authorizing the issuance of the bonds;
368368 (2) has a contractual obligation to pay money until
369369 that obligation has been fully paid in accordance with the
370370 contract; or
371371 (3) owns, operates, or maintains public works,
372372 facilities, or improvements unless the district contracts with
373373 another person for the ownership, operation, or maintenance of the
374374 public works, facilities, or improvements.
375375 (d) Sections 375.261, 375.262, and 375.264, Local
376376 Government Code, do not apply to the district.
377377 SECTION 2. The Alluvium Ranch Municipal Management District
378378 No. 1 initially includes all territory contained in the following
379379 area:
380380 BEING a tract of land situated in the Aaron Burleson Survey,
381381 Abstract No. 61, James Blagg Survey, Abstract No. 63 and the James
382382 Fox Survey, Abstract No. 425, Grayson County, Texas, and being all
383383 of a called "First Tract", all of a called "Third Tract", and part
384384 of a called "Second Tract, described in a deed to Gerald Eugene
385385 Russell, as recorded in Volume 4450, Page 379, all of a called
386386 "Third Tract", all of a called "Fourth Tract", all of a called
387387 "Fifth Tract", and part of a called "First Tract, described in a
388388 deed to Carolyn Washburn Russell and husband, Gerald Eugene
389389 Russell, as recorded in Volume 4450, Page 386, and all of a called
390390 49.884-acre tract of land, described in a deed to Gerald Eugene
391391 Russell and Carolyn Washburn Russell, as recorded in Instrument
392392 No. 2018-4763, all of the Official Records, Grayson County, Texas,
393393 and being more particularly described by metes and bounds as
394394 follows:
395395 BEGINNING at a 5/8-inch iron rod with red plastic cap stamped "KHA"
396396 set for the southeast corner of said "First Tract" (V4450/P386) and
397397 the southwest corner of a called 1.2-acre tract of land described in
398398 a deed to Christopher B. Robinson and Luanna Colette Robinson, as
399399 recorded in Volume 5634, Page 832, said Official Records, same
400400 being on the northerly right-of-way line of F. M. 697, a 100 foot
401401 right of way;
402402 THENCE North 83°50'59" West, along the southerly line of said "First
403403 Tract" (V4450/P386) and along the northerly right-of-way line of
404404 said F. M. 697, and generally along a barbed wire fence, a distance
405405 of 467.07 feet to a point for corner from which a concrete monument
406406 found for witness bears South 39°51'38" West, 1.65 feet, same being
407407 at the beginning of a tangent curve to the right with a radius of
408408 522.96 feet, a central angle of 02°04'00", and a chord bearing and
409409 distance of North 82°49'00" West, 18.86 feet;
410410 THENCE in a westerly direction, continuing along the southerly line
411411 of said "First Tract" (V4450/P386) and the northerly right-of-way
412412 line of said F. M. 697, and generally along a barbed wire fence, and
413413 with said curve to the right, an arc distance of 18.86 feet to a
414414 5/8-inch iron rod with a red plastic cap, stamped "KHA" set on the
415415 northerly right of way line of said F. M. 697;
416416 THENCE North 09°06'10" East, departing the northerly right of way
417417 line of said F. M. 697, over and across said "First Tract"
418418 (V4450/P386), a distance of 848.30 feet to a 5/8-inch iron rod with
419419 a red plastic cap, stamped "KHA" set for corner;
420420 THENCE North 75°29'11" West, continuing across said "First Tract"
421421 (V4450/P386), a distance of 680.84 feet to a 5/8-inch iron rod with
422422 a red plastic cap, stamped "KHA" set for corner on the westerly line
423423 of said "First Tract" (V4450/P386), same being on the easterly line
424424 of a called 20.000-acre tract of land, described in a deed to Jeff
425425 Lillard and wife, Nicole Lillard, as recorded in Volume 3845, Page
426426 642, said Official Records;
427427 THENCE North 14°30'49" East, along the westerly line of said "First
428428 Tract" (V4450/P386) and the easterly line of said 20.000-acre
429429 tract, and generally along a barbed wire fence, a distance of
430430 1,002.95 feet to a 1/2-inch iron rod found for the northeast corner
431431 of said 20.000-acre tract, same being the southeast corner of a
432432 called 33.000-acre tract of land, described in a deed to Majestic
433433 Acres, LLC, as recorded in Instrument No. 2021-36701, said Official
434434 Records;
435435 THENCE North 14°24'17" East, along the westerly line of said "First
436436 Tract" (V4450/P386) and the easterly line of said 33.000-acre
437437 tract, passing a 1/2-inch iron rod found for the northwest corner of
438438 said "First Tract" (V4450/P386) and the southwest corner of
439439 aforesaid 49.884-acre tract, and continuing along the westerly line
440440 of said 49.884-acre tract, and generally along a barbed wire fence,
441441 a distance of 970.56 feet to a 1/2-inch iron rod found for the
442442 northeast corner of said 33.000-acre tract and the southeast corner
443443 of the aforesaid "First Tract" (V4450/P379);
444444 THENCE North 74°43'02" West, along the southerly line of said "First
445445 Tract" (V4450/P379) and the northerly line of said 33.000-acre
446446 tract, and generally along a barbed wire fence, passing a 5/8-inch
447447 iron rod with a plastic cap, stamped "PRESTON TRAILS LAND
448448 SURVEYING" found for the northerly, northwest corner of said
449449 33.000-acre tract and the northeast corner of the remainder of a
450450 called 46.915-acre tract of land, described in a deed to Robert
451451 Bandy Jeffrey and wife, Melanie Diane Jeffrey, as recorded in
452452 Instrument No. 2019-13286, said Official Records,, passing a
453453 5/8-inch iron rod found for the northernmost northwest corner of
454454 said 46.915-acre tract and the northeast corner of a called

10051005 SECTION 3. (a) The legal notice of the intention to
10061006 introduce this Act, setting forth the general substance of this
10071007 Act, has been published as provided by law, and the notice and a
10081008 copy of this Act have been furnished to all persons, agencies,
10091009 officials, or entities to which they are required to be furnished
10101010 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
10111011 Government Code.
10121012 (b) The governor, one of the required recipients, has
10131013 submitted the notice and Act to the Texas Commission on
10141014 Environmental Quality.
10151015 (c) The Texas Commission on Environmental Quality has filed
10161016 its recommendations relating to this Act with the governor,
10171017 lieutenant governor, and speaker of the house of representatives
10181018 within the required time.
10191019 (d) All requirements of the constitution and laws of this
10201020 state and the rules and procedures of the legislature with respect
10211021 to the notice, introduction, and passage of this Act have been
10221022 fulfilled and accomplished.
10231023 SECTION 4. (a) Section 4014.0312, Special District Local
10241024 Laws Code, as added by Section 1 of this Act, takes effect only if
10251025 this Act receives a two-thirds vote of all the members elected to
10261026 each house.
10271027 (b) If this Act does not receive a two-thirds vote of all the
10281028 members elected to each house, Subchapter C, Chapter 4014, Special
10291029 District Local Laws Code, as added by Section 1 of this Act, is
10301030 amended by adding Section 4014.0312 to read as follows:
10311031 Sec. 4014.0312. NO EMINENT DOMAIN POWER. The district may
10321032 not exercise the power of eminent domain.
10331033 SECTION 5. This Act takes effect immediately if it receives
10341034 a vote of two-thirds of all the members elected to each house, as
10351035 provided by Section 39, Article III, Texas Constitution. If this
10361036 Act does not receive the vote necessary for immediate effect, this
10371037 Act takes effect September 1, 2025.
