77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the protection of expressive activities at public
1010 institutions of higher education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 51.9315, Education Code, is amended by
1313 amending Subsection (g) and adding Subsections (k), (l), (m), and
1414 (n) to read as follows:
1515 (g) An institution of higher education may not take action
1616 against a student organization or deny the organization any benefit
1717 generally available to other student organizations at the
1818 institution on the basis of:
1919 (1) a political, religious, philosophical,
2020 ideological, or academic viewpoint expressed by the organization or
2121 of any expressive activities of the organization; or
2222 (2) a requirement of the organization that the
2323 organization's leaders or members:
2424 (A) affirm and adhere to the organization's
2525 sincerely held beliefs;
2626 (B) comply with the organization's standards of
2727 conduct; or
2828 (C) further the organization's mission or
2929 purpose.
3030 (k) Not later than the first anniversary of the date a
3131 person or student organization's expressive rights were allegedly
3232 violated by an institution of higher education under this section,
3333 the person or organization may bring an action against the
3434 institution for:
3535 (1) a declaratory judgment under Chapter 37, Civil
3636 Practice and Remedies Code; or
3737 (2) an injunction to prevent the institution from
3838 further violating this section.
3939 (l) For purposes of computing the limitation period under
4040 Subsection (k), each day of a continuing violation of this section,
4141 including each day a rule or policy of an institution of higher
4242 education that violates this section remains in effect, constitutes
4343 a separate violation.
4444 (m) A person or student organization may raise a violation
4545 of this section against the person or organization as a defense or
4646 counterclaim in any relevant civil, administrative, or
4747 disciplinary proceedings brought against the person or
4848 organization by the institution of higher education.
4949 (n) An institution of higher education's sovereign immunity
5050 to suit and from liability is waived and abolished to the extent of
5151 liability created under this section.
5252 SECTION 2. Section 51.9315, Education Code, as amended by
5353 this Act, applies only to a cause of action that accrues on or after
5454 the effective date of this Act. A cause of action that accrued
5555 before the effective date of this Act is governed by the law in
5656 effect immediately before the effective date of this Act, and that
5757 law is continued in effect for that purpose.
5858 SECTION 3. This Act takes effect September 1, 2025.
