8	8	relating to the creation of the Wolf Creek Municipal Management
9	9	District No. 1; providing authority to issue bonds; providing
10	10	authority to impose assessments, fees, and taxes; granting a
11	11	limited power of eminent domain.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Subtitle C, Title 4, Special District Local Laws
14	14	Code, is amended by adding Chapter 4015 to read as follows:
15	15	CHAPTER 4015. WOLF CREEK MUNICIPAL MANAGEMENT DISTRICT NO. 1
16	16	SUBCHAPTER A. GENERAL PROVISIONS
17	17	Sec. 4015.0101. DEFINITIONS. In this chapter:
18	18	(1) "Board" means the district's board of directors.
19	19	(2) "City" means the City of Greenville.
20	20	(3) "County" means Hunt County.
21	21	(4) "Director" means a board member.
22	22	(5) "District" means the Wolf Creek Municipal
23	23	Management District No. 1.
24	24	Sec. 4015.0102. NATURE OF DISTRICT. The Wolf Creek
25	25	Municipal Management District No. 1 is a special district created
26	26	under Section 59, Article XVI, Texas Constitution.
27	27	Sec. 4015.0103. PURPOSE; DECLARATION OF INTENT. (a) The
28	28	creation of the district is essential to accomplish the purposes of
29	29	Sections 52 and 52-a, Article III, and Section 59, Article XVI,
30	30	Texas Constitution, and other public purposes stated in this
31	31	chapter.
32	32	(b) By creating the district and in authorizing the county,
33	33	the city, and other political subdivisions to contract with the
34	34	district, the legislature has established a program to accomplish
35	35	the public purposes set out in Section 52-a, Article III, Texas
36	36	Constitution.
37	37	(c) The creation of the district is necessary to promote,
38	38	develop, encourage, and maintain employment, commerce,
39	39	transportation, housing, tourism, recreation, the arts,
40	40	entertainment, economic development, safety, and the public
41	41	welfare in the district.
42	42	(d) This chapter and the creation of the district may not be
43	43	interpreted to relieve the county or the city from providing the
44	44	level of services provided as of the effective date of the Act
45	45	enacting this chapter to the area in the district. The district is
46	46	created to supplement and not to supplant county or city services
47	47	provided in the district.
48	48	Sec. 4015.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
49	49	(a) All land and other property included in the district will
50	50	benefit from the improvements and services to be provided by the
51	51	district under powers conferred by Sections 52 and 52-a, Article
52	52	III, and Section 59, Article XVI, Texas Constitution, and other
53	53	powers granted under this chapter.
54	54	(b) The district is created to serve a public use and
55	55	benefit.
56	56	(c) The creation of the district is in the public interest
57	57	and is essential to further the public purposes of:
58	58	(1) developing and diversifying the economy of the
59	59	state;
60	60	(2) eliminating unemployment and underemployment; and
61	61	(3) developing or expanding transportation and
62	62	commerce.
63	63	(d) The district will:
64	64	(1) promote the health, safety, and general welfare of
65	65	residents, employers, potential employees, employees, visitors,
66	66	and consumers in the district, and of the public;
67	67	(2) provide needed funding for the district to
68	68	preserve, maintain, and enhance the economic health and vitality of
69	69	the district territory as a community and business center;
70	70	(3) promote the health, safety, welfare, and enjoyment
71	71	of the public by providing pedestrian ways and by landscaping and
72	72	developing certain areas in the district, which are necessary for
73	73	the restoration, preservation, and enhancement of scenic beauty;
74	74	and
75	75	(4) provide for water, wastewater, drainage, road, and
76	76	recreational facilities for the district.
77	77	(e) Pedestrian ways along or across a street, whether at
78	78	grade or above or below the surface, and street lighting, street
79	79	landscaping, parking, and street art objects are parts of and
80	80	necessary components of a street and are considered to be a street
81	81	or road improvement.
82	82	(f) The district will not act as the agent or
83	83	instrumentality of any private interest even though the district
84	84	will benefit many private interests as well as the public.
85	85	Sec. 4015.0105. INITIAL DISTRICT TERRITORY. (a) The
86	86	district is initially composed of the territory described by
87	87	Section 2 of the Act enacting this chapter.
88	88	(b) The boundaries and field notes contained in Section 2 of
89	89	the Act enacting this chapter form a closure. A mistake in the
90	90	field notes or in copying the field notes in the legislative process
91	91	does not affect the district's:
92	92	(1) organization, existence, or validity;
93	93	(2) right to issue any type of bonds for the purposes
94	94	for which the district is created or to pay the principal of and
95	95	interest on the bonds;
96	96	(3) right to impose or collect an assessment or tax; or
97	97	(4) legality or operation.
98	98	Sec. 4015.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
99	99	All or any part of the area of the district is eligible to be
100	100	included in:
101	101	(1) a tax increment reinvestment zone created under
102	102	Chapter 311, Tax Code; or
103	103	(2) a tax abatement reinvestment zone created under
104	104	Chapter 312, Tax Code.
105	105	Sec. 4015.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
106	106	DISTRICTS LAW. Except as otherwise provided by this chapter,
107	107	Chapter 375, Local Government Code, applies to the district.
108	108	Sec. 4015.0108. CONSTRUCTION OF CHAPTER. This chapter
109	109	shall be liberally construed in conformity with the findings and
110	110	purposes stated in this chapter.
111	111	SUBCHAPTER B. BOARD OF DIRECTORS
112	112	Sec. 4015.0201. GOVERNING BODY; TERMS. (a) The district is
113	113	governed by a board of five elected directors who serve staggered
114	114	terms of four years.
115	115	(b) Directors are elected in the manner provided by
116	116	Subchapter D, Chapter 49, Water Code.
117	117	Sec. 4015.0202. COMPENSATION; EXPENSES. (a) The district
118	118	may compensate each director in an amount not to exceed $150 for
119	119	each board meeting. The total amount of compensation for each
120	120	director in one year may not exceed $7,200.
121	121	(b) A director is entitled to reimbursement for necessary
122	122	and reasonable expenses incurred in carrying out the duties and
123	123	responsibilities of the board.
124	124	(c) Sections 375.069 and 375.070, Local Government Code, do
125	125	not apply to the board.
126	126	Sec. 4015.0203. TEMPORARY DIRECTORS. (a) On or after the
127	127	effective date of the Act creating this chapter, the owner or owners
128	128	of a majority of the assessed value of the real property in the
129	129	district according to the most recent certified tax appraisal roll
130	130	for the county may submit a petition to the Texas Commission on
131	131	Environmental Quality requesting that the commission appoint as
132	132	temporary directors the five persons named in the petition. The
133	133	commission shall appoint as temporary directors the five persons
134	134	named in the petition.
135	135	(b) The temporary or successor temporary directors shall
136	136	hold an election to elect five permanent directors as provided by
137	137	Section 4015.0201.
138	138	(c) Temporary directors serve until the earlier of:
139	139	(1) the date permanent directors are elected under
140	140	Subsection (b); or
141	141	(2) the fourth anniversary of the effective date of
142	142	the Act creating this chapter.
143	143	(d) If permanent directors have not been elected under
144	144	Subsection (b) and the terms of the temporary directors have
145	145	expired, successor temporary directors shall be appointed or
146	146	reappointed as provided by Subsection (e) to serve terms that
147	147	expire on the earlier of:
148	148	(1) the date permanent directors are elected under
149	149	Subsection (b); or
150	150	(2) the fourth anniversary of the date of the
151	151	appointment or reappointment.
152	152	(e) If Subsection (d) applies, the owner or owners of a
153	153	majority of the assessed value of the real property in the district
154	154	according to the most recent certified tax appraisal roll for the
155	155	county may submit a petition to the Texas Commission on
156	156	Environmental Quality requesting that the commission appoint as
157	157	successor temporary directors the five persons named in the
158	158	petition. The commission shall appoint as successor temporary
159	159	directors the five persons named in the petition.
160	160	SUBCHAPTER C. POWERS AND DUTIES
161	161	Sec. 4015.0301. GENERAL POWERS AND DUTIES. The district
162	162	has the powers and duties necessary to accomplish the purposes for
163	163	which the district is created.
164	164	Sec. 4015.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
165	165	district, using any money available to the district for the
166	166	purpose, may provide, design, construct, acquire, improve,
167	167	relocate, operate, maintain, or finance an improvement project or
168	168	service authorized under this chapter or Chapter 375, Local
169	169	Government Code.
170	170	(b) The district may contract with a governmental or private
171	171	entity to carry out an action under Subsection (a).
172	172	(c) The implementation of a district project or service is a
173	173	governmental function or service for the purposes of Chapter 791,
174	174	Government Code.
175	175	Sec. 4015.0303. NONPROFIT CORPORATION. (a) The board by
176	176	resolution may authorize the creation of a nonprofit corporation to
177	177	assist and act for the district in implementing a project or
178	178	providing a service authorized by this chapter.
179	179	(b) The nonprofit corporation:
180	180	(1) has each power of and is considered to be a local
181	181	government corporation created under Subchapter D, Chapter 431,
182	182	Transportation Code; and
183	183	(2) may implement any project and provide any service
184	184	authorized by this chapter.
185	185	(c) The board shall appoint the board of directors of the
186	186	nonprofit corporation. The board of directors of the nonprofit
187	187	corporation shall serve in the same manner as the board of directors
188	188	of a local government corporation created under Subchapter D,
189	189	Chapter 431, Transportation Code, except that a board member is not
190	190	required to reside in the district.
191	191	Sec. 4015.0304. LAW ENFORCEMENT SERVICES. To protect the
192	192	public interest, the district may contract with a qualified party,
193	193	including the county or the city, to provide law enforcement
194	194	services in the district for a fee.
195	195	Sec. 4015.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
196	196	The district may join and pay dues to a charitable or nonprofit
197	197	organization that performs a service or provides an activity
198	198	consistent with the furtherance of a district purpose.
199	199	Sec. 4015.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
200	200	district may engage in activities that accomplish the economic
201	201	development purposes of the district.
202	202	(b) The district may establish and provide for the
203	203	administration of one or more programs to promote state or local
204	204	economic development and to stimulate business and commercial
205	205	activity in the district, including programs to:
206	206	(1) make loans and grants of public money; and
207	207	(2) provide district personnel and services.
208	208	(c) The district may create economic development programs
209	209	and exercise the economic development powers provided to
210	210	municipalities by:
211	211	(1) Chapter 380, Local Government Code; and
212	212	(2) Subchapter A, Chapter 1509, Government Code.
213	213	Sec. 4015.0307. PARKING FACILITIES. (a) The district may
214	214	acquire, lease as lessor or lessee, construct, develop, own,
215	215	operate, and maintain parking facilities or a system of parking
216	216	facilities, including lots, garages, parking terminals, or other
217	217	structures or accommodations for parking motor vehicles off the
218	218	streets and related appurtenances.
219	219	(b) The district's parking facilities serve the public
220	220	purposes of the district and are owned, used, and held for a public
221	221	purpose even if leased or operated by a private entity for a term of
222	222	years.
223	223	(c) The district's parking facilities are parts of and
224	224	necessary components of a street and are considered to be a street
225	225	or road improvement.
226	226	(d) The development and operation of the district's parking
227	227	facilities may be considered an economic development program.
228	228	Sec. 4015.0308. DISBURSEMENTS AND TRANSFERS OF MONEY. The
229	229	board by resolution shall establish the number of directors'
230	230	signatures and the procedure required for a disbursement or
231	231	transfer of district money.
232	232	Sec. 4015.0309. ADDING OR EXCLUDING LAND. Except as
233	233	provided by Section 4015.0310, the district may add or exclude land
234	234	in the manner provided by Subchapter J, Chapter 49, Water Code, or
235	235	by Subchapter H, Chapter 54, Water Code.
236	236	Sec. 4015.0310. DIVISION OF DISTRICT. (a) The district may
237	237	be divided into two or more new districts only if the district:
238	238	(1) has no outstanding bonded debt; and
239	239	(2) is not imposing ad valorem taxes.
240	240	(b) This chapter applies to any new district created by the
241	241	division of the district, and a new district has all the powers and
242	242	duties of the district.
243	243	(c) Any new district created by the division of the district
244	244	may not, at the time the new district is created, contain any land
245	245	outside the area described by Section 2 of the Act enacting this
246	246	chapter.
247	247	(d) The board, on its own motion or on receipt of a petition
248	248	signed by the owner or owners of a majority of the assessed value of
249	249	the real property in the district, may adopt an order dividing the
250	250	district.
251	251	(e) An order dividing the district must:
252	252	(1) name each new district;
253	253	(2) include the metes and bounds description of the
254	254	territory of each new district;
255	255	(3) appoint initial directors for each new district;
256	256	and
257	257	(4) provide for the division of assets and liabilities
258	258	between or among the new districts.
259	259	(f) On or before the 30th day after the date of adoption of
260	260	an order dividing the district, the district shall file the order
261	261	with the Texas Commission on Environmental Quality and record the
262	262	order in the real property records of each county in which the
263	263	district is located.
264	264	Sec. 4015.0311. EMINENT DOMAIN. The district may exercise
265	265	the power of eminent domain in the manner provided by Section
266	266	49.222, Water Code.
267	267	SUBCHAPTER D. ASSESSMENTS
268	268	Sec. 4015.0401. PETITION REQUIRED FOR FINANCING SERVICES
269	269	AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
270	270	service or improvement project with assessments under this chapter
271	271	unless a written petition requesting that service or improvement
272	272	has been filed with the board.
273	273	(b) A petition filed under Subsection (a) must be signed by
274	274	the owners of a majority of the assessed value of real property in
275	275	the district subject to assessment according to the most recent
276	276	certified tax appraisal roll for the county.
277	277	Sec. 4015.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
278	278	The board by resolution may impose and collect an assessment for any
279	279	purpose authorized by this chapter in all or any part of the
280	280	district.
281	281	(b) An assessment, a reassessment, or an assessment
282	282	resulting from an addition to or correction of the assessment roll
283	283	by the district, penalties and interest on an assessment or
284	284	reassessment, an expense of collection, and reasonable attorney's
285	285	fees incurred by the district:
286	286	(1) are a first and prior lien against the property
287	287	assessed;
288	288	(2) are superior to any other lien or claim other than
289	289	a lien or claim for county, school district, or municipal ad valorem
290	290	taxes; and
291	291	(3) are the personal liability of and a charge against
292	292	the owners of the property even if the owners are not named in the
293	293	assessment proceedings.
294	294	(c) The lien is effective from the date of the board's
295	295	resolution imposing the assessment until the date the assessment is
296	296	paid. The board may enforce the lien in the same manner that the
297	297	board may enforce an ad valorem tax lien against real property.
298	298	(d) The board may make a correction to or deletion from the
299	299	assessment roll that does not increase the amount of assessment of
300	300	any parcel of land without providing notice and holding a hearing in
301	301	the manner required for additional assessments.
302	302	SUBCHAPTER E. TAXES AND BONDS
303	303	Sec. 4015.0501. TAX ELECTION REQUIRED. (a) The district
304	304	must hold an election in the manner provided by Chapter 49, Water
305	305	Code, or, if applicable, Chapter 375, Local Government Code, to
306	306	obtain voter approval before the district may impose an ad valorem
307	307	tax.
308	308	(b) Section 375.243, Local Government Code, does not apply
309	309	to the district.
310	310	Sec. 4015.0502. OPERATION AND MAINTENANCE TAX. (a) If
311	311	authorized by a majority of the district voters voting at an
312	312	election under Section 4015.0501, the district may impose an
313	313	operation and maintenance tax on taxable property in the district
314	314	in the manner provided by Section 49.107, Water Code, for any
315	315	district purpose, including to:
316	316	(1) maintain and operate the district;
317	317	(2) construct or acquire improvements; or
318	318	(3) provide a service.
319	319	(b) The board shall determine the operation and maintenance
320	320	tax rate. The rate may not exceed the rate approved at the
321	321	election.
322	322	Sec. 4015.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
323	323	BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
324	324	terms determined by the board.
325	325	(b) The district may issue, by public or private sale,
326	326	bonds, notes, or other obligations payable wholly or partly from ad
327	327	valorem taxes, assessments, impact fees, revenue, contract
328	328	payments, grants, or other district money, or any combination of
329	329	those sources of money, to pay for any authorized district purpose.
330	330	(c) The district may issue, by public or private sale,
331	331	bonds, notes, or other obligations payable wholly or partly from
332	332	assessments in the manner provided by Subchapter A, Chapter 372,
333	333	Local Government Code, if the improvement financed by the
334	334	obligation issued under this section will be conveyed to or
335	335	operated and maintained by a municipality, county, or other retail
336	336	utility provider pursuant to an agreement with the district entered
337	337	into before the issuance of the obligation.
338	338	Sec. 4015.0504. BONDS SECURED BY REVENUE OR CONTRACT
339	339	PAYMENTS. The district may issue, without an election, bonds
340	340	secured by:
341	341	(1) revenue other than ad valorem taxes, including
342	342	contract revenues; or
343	343	(2) contract payments, provided that the requirements
344	344	of Section 49.108, Water Code, have been met.
345	345	Sec. 4015.0505. BONDS SECURED BY AD VALOREM TAXES;
346	346	ELECTIONS. (a) If authorized at an election under Section
347	347	4015.0501, the district may issue bonds payable from ad valorem
348	348	taxes.
349	349	(b) At the time the district issues bonds payable wholly or
350	350	partly from ad valorem taxes, the board shall provide for the annual
351	351	imposition of a continuing direct annual ad valorem tax, without
352	352	limit as to rate or amount, for each year that all or part of the
353	353	bonds are outstanding as required and in the manner provided by
354	354	Sections 54.601 and 54.602, Water Code.
355	355	(c) All or any part of any facilities or improvements that
356	356	may be acquired by a district by the issuance of its bonds may be
357	357	submitted as a single proposition or as several propositions to be
358	358	voted on at the election.
359	359	SUBCHAPTER I. DISSOLUTION
360	360	Sec. 4015.0901. DISSOLUTION. (a) The board shall dissolve
361	361	the district on written petition filed with the board by the owners
362	362	of:
363	363	(1) at least two-thirds of the assessed value of the
364	364	property subject to assessment by the district based on the most
365	365	recent certified county property tax rolls; or
366	366	(2) at least two-thirds of the surface area of the
367	367	district, excluding roads, streets, highways, utility
368	368	rights-of-way, other public areas, and other property exempt from
369	369	assessment by the district according to the most recent certified
370	370	county property tax rolls.
371	371	(b) The board by majority vote may dissolve the district at
372	372	any time.
373	373	(c) The district may not be dissolved by its board under
374	374	Subsection (a) or (b) if the district:
375	375	(1) has any outstanding bonded indebtedness until that
376	376	bonded indebtedness has been repaid or defeased in accordance with
377	377	the order or resolution authorizing the issuance of the bonds;
378	378	(2) has a contractual obligation to pay money until
379	379	that obligation has been fully paid in accordance with the
380	380	contract; or
381	381	(3) owns, operates, or maintains public works,
382	382	facilities, or improvements unless the district contracts with
383	383	another person for the ownership, operation, or maintenance of the
384	384	public works, facilities, or improvements.
385	385	(d) Sections 375.261, 375.262, and 375.264, Local
386	386	Government Code, do not apply to the district.
387	387	SECTION 2. The Wolf Creek Municipal Management District
388	388	No. 1 initially includes all territory contained in the following
389	389	area:
390	390	LEGAL DESCRIPTION - TRACT 1
391	391	760.994 ACRE TRACT
392	392	LEGAL DESCRIPTION: Being 760.994 acres of land out of the E. Tedwell
393	393	Survey, Abstract No. 1035, the J. C. Bates Survey, Abstract No. 35,
394	394	I. White Survey, Abstract No. 144, J. Grilski Survey, Abstract
395	395	No. 387, the W. Rogers Survey, Abstract No. 1885, the A. J. Hefner
396	396	Survey, Abstract No. 473 and the Wm. H. Sowell Survey, Abstract
397	397	No. 996 in Hunt County, Texas and also being all of that certain
398	398	760.70 acre tract described in Doc. #2023-10812 of the Official
399	399	Public Records of said Hunt County, Texas; Said 760.70 acre tract
400	400	being more particularly described as follows and as surveyed under
401	401	the supervision of Cross Texas Land Services, Inc in October, 2024:
402	402	BEGINNING at a calculated point in the east line of State Highway
403	403	No. 34 for the northwest corner of that certain 93.00 acre tract
404	404	described in Volume 1493, Page 676 of the Official Public Records
405	405	and the southwest corner hereof;
406	406	THENCE along the east line of said Highway, the following 3 courses:
407	407	1. North 00°22'32" West a distance of 752.68 feet to a
408	408	concrete monument found;
409	409	2. Along a curve turning to the left with an arc length of
410	410	1345.62 feet, with a radius of 2914.79 feet, with a chord bearing of
411	411	North 13°30'37" West, a distance of 1333.70 feet to a 1/2" iron rod

413	413	3. North 26°40'59" West a distance of 1444.79 feet to a 1/2"
414	414	iron rod with cap found for the southeast corner of that certain
415	415	28.000 acre tract described in Volume 530, Page 896 of the Official

417	417	THENCE along the south and east lines of said 28.000 acre tract, the

419	419	1. North 89°25'39" East a distance of 2361.72 feet to a 3/8"

421	421	2. North 00°50'48" West a distance of 738.78 feet to a 3/8"

1152	1152	submitted the notice and Act to the Texas Commission on
1153	1153	Environmental Quality.
1154	1154	(c) The Texas Commission on Environmental Quality has filed
1155	1155	its recommendations relating to this Act with the governor,
1156	1156	lieutenant governor, and speaker of the house of representatives
1157	1157	within the required time.
1158	1158	(d) All requirements of the constitution and laws of this
1159	1159	state and the rules and procedures of the legislature with respect
1160	1160	to the notice, introduction, and passage of this Act have been

1162	1162	SECTION 4. (a) Section 4015.0311, Special District Local
1163	1163	Laws Code, as added by Section 1 of this Act, takes effect only if
1164	1164	this Act receives a two-thirds vote of all the members elected to
1165	1165	each house.
1166	1166	(b) If this Act does not receive a two-thirds vote of all the
1167	1167	members elected to each house, Subchapter C, Chapter 4015, Special
1168	1168	District Local Laws Code, as added by Section 1 of this Act, is
1169	1169	amended by adding Section 4015.0311 to read as follows:
1170	1170	Sec. 4015.0311. NO EMINENT DOMAIN POWER. The district may
1171	1171	not exercise the power of eminent domain.
1172	1172	SECTION 5. This Act takes effect immediately if it receives
1173	1173	a vote of two-thirds of all the members elected to each house, as
1174	1174	provided by Section 39, Article III, Texas Constitution. If this
1175	1175	Act does not receive the vote necessary for immediate effect, this
1176	1176	Act takes effect September 1, 2025.
