88 relating to the creation of the Wolf Creek Municipal Management
99 District No. 1; providing authority to issue bonds; providing
1010 authority to impose assessments, fees, and taxes; granting a
1111 limited power of eminent domain.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1414 Code, is amended by adding Chapter 4015 to read as follows:
1515 CHAPTER 4015. WOLF CREEK MUNICIPAL MANAGEMENT DISTRICT NO. 1
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 4015.0101. DEFINITIONS. In this chapter:
1818 (1) "Board" means the district's board of directors.
1919 (2) "City" means the City of Greenville.
2020 (3) "County" means Hunt County.
2121 (4) "Director" means a board member.
2222 (5) "District" means the Wolf Creek Municipal
2323 Management District No. 1.
2424 Sec. 4015.0102. NATURE OF DISTRICT. The Wolf Creek
2525 Municipal Management District No. 1 is a special district created
2626 under Section 59, Article XVI, Texas Constitution.
2727 Sec. 4015.0103. PURPOSE; DECLARATION OF INTENT. (a) The
2828 creation of the district is essential to accomplish the purposes of
2929 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
3030 Texas Constitution, and other public purposes stated in this
3131 chapter.
3232 (b) By creating the district and in authorizing the county,
3333 the city, and other political subdivisions to contract with the
3434 district, the legislature has established a program to accomplish
3535 the public purposes set out in Section 52-a, Article III, Texas
3636 Constitution.
3737 (c) The creation of the district is necessary to promote,
3838 develop, encourage, and maintain employment, commerce,
3939 transportation, housing, tourism, recreation, the arts,
4040 entertainment, economic development, safety, and the public
4141 welfare in the district.
4242 (d) This chapter and the creation of the district may not be
4343 interpreted to relieve the county or the city from providing the
4444 level of services provided as of the effective date of the Act
4545 enacting this chapter to the area in the district. The district is
4646 created to supplement and not to supplant county or city services
4747 provided in the district.
4848 Sec. 4015.0104. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
4949 (a) All land and other property included in the district will
5050 benefit from the improvements and services to be provided by the
5151 district under powers conferred by Sections 52 and 52-a, Article
5252 III, and Section 59, Article XVI, Texas Constitution, and other
5353 powers granted under this chapter.
5454 (b) The district is created to serve a public use and
5555 benefit.
5656 (c) The creation of the district is in the public interest
5757 and is essential to further the public purposes of:
5858 (1) developing and diversifying the economy of the
5959 state;
6060 (2) eliminating unemployment and underemployment; and
6161 (3) developing or expanding transportation and
6262 commerce.
6363 (d) The district will:
6464 (1) promote the health, safety, and general welfare of
6565 residents, employers, potential employees, employees, visitors,
6666 and consumers in the district, and of the public;
6767 (2) provide needed funding for the district to
6868 preserve, maintain, and enhance the economic health and vitality of
6969 the district territory as a community and business center;
7070 (3) promote the health, safety, welfare, and enjoyment
7171 of the public by providing pedestrian ways and by landscaping and
7272 developing certain areas in the district, which are necessary for
7373 the restoration, preservation, and enhancement of scenic beauty;
7474 and
7575 (4) provide for water, wastewater, drainage, road, and
7676 recreational facilities for the district.
7777 (e) Pedestrian ways along or across a street, whether at
7878 grade or above or below the surface, and street lighting, street
7979 landscaping, parking, and street art objects are parts of and
8080 necessary components of a street and are considered to be a street
8181 or road improvement.
8282 (f) The district will not act as the agent or
8383 instrumentality of any private interest even though the district
8484 will benefit many private interests as well as the public.
8585 Sec. 4015.0105. INITIAL DISTRICT TERRITORY. (a) The
8686 district is initially composed of the territory described by
8787 Section 2 of the Act enacting this chapter.
8888 (b) The boundaries and field notes contained in Section 2 of
8989 the Act enacting this chapter form a closure. A mistake in the
9090 field notes or in copying the field notes in the legislative process
9191 does not affect the district's:
9292 (1) organization, existence, or validity;
9393 (2) right to issue any type of bonds for the purposes
9494 for which the district is created or to pay the principal of and
9595 interest on the bonds;
9696 (3) right to impose or collect an assessment or tax; or
9797 (4) legality or operation.
9898 Sec. 4015.0106. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
9999 All or any part of the area of the district is eligible to be
100100 included in:
101101 (1) a tax increment reinvestment zone created under
102102 Chapter 311, Tax Code; or
103103 (2) a tax abatement reinvestment zone created under
104104 Chapter 312, Tax Code.
105105 Sec. 4015.0107. APPLICABILITY OF MUNICIPAL MANAGEMENT
106106 DISTRICTS LAW. Except as otherwise provided by this chapter,
107107 Chapter 375, Local Government Code, applies to the district.
108108 Sec. 4015.0108. CONSTRUCTION OF CHAPTER. This chapter
109109 shall be liberally construed in conformity with the findings and
110110 purposes stated in this chapter.
111111 SUBCHAPTER B. BOARD OF DIRECTORS
112112 Sec. 4015.0201. GOVERNING BODY; TERMS. (a) The district is
113113 governed by a board of five elected directors who serve staggered
114114 terms of four years.
115115 (b) Directors are elected in the manner provided by
116116 Subchapter D, Chapter 49, Water Code.
117117 Sec. 4015.0202. COMPENSATION; EXPENSES. (a) The district
118118 may compensate each director in an amount not to exceed $150 for
119119 each board meeting. The total amount of compensation for each
120120 director in one year may not exceed $7,200.
121121 (b) A director is entitled to reimbursement for necessary
122122 and reasonable expenses incurred in carrying out the duties and
123123 responsibilities of the board.
124124 (c) Sections 375.069 and 375.070, Local Government Code, do
125125 not apply to the board.
126126 Sec. 4015.0203. TEMPORARY DIRECTORS. (a) On or after the
127127 effective date of the Act creating this chapter, the owner or owners
128128 of a majority of the assessed value of the real property in the
129129 district according to the most recent certified tax appraisal roll
130130 for the county may submit a petition to the Texas Commission on
131131 Environmental Quality requesting that the commission appoint as
132132 temporary directors the five persons named in the petition. The
133133 commission shall appoint as temporary directors the five persons
134134 named in the petition.
135135 (b) The temporary or successor temporary directors shall
136136 hold an election to elect five permanent directors as provided by
137137 Section 4015.0201.
138138 (c) Temporary directors serve until the earlier of:
139139 (1) the date permanent directors are elected under
140140 Subsection (b); or
141141 (2) the fourth anniversary of the effective date of
142142 the Act creating this chapter.
143143 (d) If permanent directors have not been elected under
144144 Subsection (b) and the terms of the temporary directors have
145145 expired, successor temporary directors shall be appointed or
146146 reappointed as provided by Subsection (e) to serve terms that
147147 expire on the earlier of:
148148 (1) the date permanent directors are elected under
149149 Subsection (b); or
150150 (2) the fourth anniversary of the date of the
151151 appointment or reappointment.
152152 (e) If Subsection (d) applies, the owner or owners of a
153153 majority of the assessed value of the real property in the district
154154 according to the most recent certified tax appraisal roll for the
155155 county may submit a petition to the Texas Commission on
156156 Environmental Quality requesting that the commission appoint as
157157 successor temporary directors the five persons named in the
158158 petition. The commission shall appoint as successor temporary
159159 directors the five persons named in the petition.
160160 SUBCHAPTER C. POWERS AND DUTIES
161161 Sec. 4015.0301. GENERAL POWERS AND DUTIES. The district
162162 has the powers and duties necessary to accomplish the purposes for
163163 which the district is created.
164164 Sec. 4015.0302. IMPROVEMENT PROJECTS AND SERVICES. (a) The
165165 district, using any money available to the district for the
166166 purpose, may provide, design, construct, acquire, improve,
167167 relocate, operate, maintain, or finance an improvement project or
168168 service authorized under this chapter or Chapter 375, Local
169169 Government Code.
170170 (b) The district may contract with a governmental or private
171171 entity to carry out an action under Subsection (a).
172172 (c) The implementation of a district project or service is a
173173 governmental function or service for the purposes of Chapter 791,
174174 Government Code.
175175 Sec. 4015.0303. NONPROFIT CORPORATION. (a) The board by
176176 resolution may authorize the creation of a nonprofit corporation to
177177 assist and act for the district in implementing a project or
178178 providing a service authorized by this chapter.
179179 (b) The nonprofit corporation:
180180 (1) has each power of and is considered to be a local
181181 government corporation created under Subchapter D, Chapter 431,
182182 Transportation Code; and
183183 (2) may implement any project and provide any service
184184 authorized by this chapter.
185185 (c) The board shall appoint the board of directors of the
186186 nonprofit corporation. The board of directors of the nonprofit
187187 corporation shall serve in the same manner as the board of directors
188188 of a local government corporation created under Subchapter D,
189189 Chapter 431, Transportation Code, except that a board member is not
190190 required to reside in the district.
191191 Sec. 4015.0304. LAW ENFORCEMENT SERVICES. To protect the
192192 public interest, the district may contract with a qualified party,
193193 including the county or the city, to provide law enforcement
194194 services in the district for a fee.
195195 Sec. 4015.0305. MEMBERSHIP IN CHARITABLE ORGANIZATIONS.
196196 The district may join and pay dues to a charitable or nonprofit
197197 organization that performs a service or provides an activity
198198 consistent with the furtherance of a district purpose.
199199 Sec. 4015.0306. ECONOMIC DEVELOPMENT PROGRAMS. (a) The
200200 district may engage in activities that accomplish the economic
201201 development purposes of the district.
202202 (b) The district may establish and provide for the
203203 administration of one or more programs to promote state or local
204204 economic development and to stimulate business and commercial
205205 activity in the district, including programs to:
206206 (1) make loans and grants of public money; and
207207 (2) provide district personnel and services.
208208 (c) The district may create economic development programs
209209 and exercise the economic development powers provided to
210210 municipalities by:
211211 (1) Chapter 380, Local Government Code; and
212212 (2) Subchapter A, Chapter 1509, Government Code.
213213 Sec. 4015.0307. PARKING FACILITIES. (a) The district may
214214 acquire, lease as lessor or lessee, construct, develop, own,
215215 operate, and maintain parking facilities or a system of parking
216216 facilities, including lots, garages, parking terminals, or other
217217 structures or accommodations for parking motor vehicles off the
218218 streets and related appurtenances.
219219 (b) The district's parking facilities serve the public
220220 purposes of the district and are owned, used, and held for a public
221221 purpose even if leased or operated by a private entity for a term of
222222 years.
223223 (c) The district's parking facilities are parts of and
224224 necessary components of a street and are considered to be a street
225225 or road improvement.
226226 (d) The development and operation of the district's parking
227227 facilities may be considered an economic development program.
228228 Sec. 4015.0308. DISBURSEMENTS AND TRANSFERS OF MONEY. The
229229 board by resolution shall establish the number of directors'
230230 signatures and the procedure required for a disbursement or
231231 transfer of district money.
232232 Sec. 4015.0309. ADDING OR EXCLUDING LAND. Except as
233233 provided by Section 4015.0310, the district may add or exclude land
234234 in the manner provided by Subchapter J, Chapter 49, Water Code, or
235235 by Subchapter H, Chapter 54, Water Code.
236236 Sec. 4015.0310. DIVISION OF DISTRICT. (a) The district may
237237 be divided into two or more new districts only if the district:
238238 (1) has no outstanding bonded debt; and
239239 (2) is not imposing ad valorem taxes.
240240 (b) This chapter applies to any new district created by the
241241 division of the district, and a new district has all the powers and
242242 duties of the district.
243243 (c) Any new district created by the division of the district
244244 may not, at the time the new district is created, contain any land
245245 outside the area described by Section 2 of the Act enacting this
246246 chapter.
247247 (d) The board, on its own motion or on receipt of a petition
248248 signed by the owner or owners of a majority of the assessed value of
249249 the real property in the district, may adopt an order dividing the
250250 district.
251251 (e) An order dividing the district must:
252252 (1) name each new district;
253253 (2) include the metes and bounds description of the
254254 territory of each new district;
255255 (3) appoint initial directors for each new district;
256256 and
257257 (4) provide for the division of assets and liabilities
258258 between or among the new districts.
259259 (f) On or before the 30th day after the date of adoption of
260260 an order dividing the district, the district shall file the order
261261 with the Texas Commission on Environmental Quality and record the
262262 order in the real property records of each county in which the
263263 district is located.
264264 Sec. 4015.0311. EMINENT DOMAIN. The district may exercise
265265 the power of eminent domain in the manner provided by Section
266266 49.222, Water Code.
267267 SUBCHAPTER D. ASSESSMENTS
268268 Sec. 4015.0401. PETITION REQUIRED FOR FINANCING SERVICES
269269 AND IMPROVEMENTS WITH ASSESSMENTS. (a) The board may not finance a
270270 service or improvement project with assessments under this chapter
271271 unless a written petition requesting that service or improvement
272272 has been filed with the board.
273273 (b) A petition filed under Subsection (a) must be signed by
274274 the owners of a majority of the assessed value of real property in
275275 the district subject to assessment according to the most recent
276276 certified tax appraisal roll for the county.
277277 Sec. 4015.0402. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
278278 The board by resolution may impose and collect an assessment for any
279279 purpose authorized by this chapter in all or any part of the
280280 district.
281281 (b) An assessment, a reassessment, or an assessment
282282 resulting from an addition to or correction of the assessment roll
283283 by the district, penalties and interest on an assessment or
284284 reassessment, an expense of collection, and reasonable attorney's
285285 fees incurred by the district:
286286 (1) are a first and prior lien against the property
287287 assessed;
288288 (2) are superior to any other lien or claim other than
289289 a lien or claim for county, school district, or municipal ad valorem
290290 taxes; and
291291 (3) are the personal liability of and a charge against
292292 the owners of the property even if the owners are not named in the
293293 assessment proceedings.
294294 (c) The lien is effective from the date of the board's
295295 resolution imposing the assessment until the date the assessment is
296296 paid. The board may enforce the lien in the same manner that the
297297 board may enforce an ad valorem tax lien against real property.
298298 (d) The board may make a correction to or deletion from the
299299 assessment roll that does not increase the amount of assessment of
300300 any parcel of land without providing notice and holding a hearing in
301301 the manner required for additional assessments.
302302 SUBCHAPTER E. TAXES AND BONDS
303303 Sec. 4015.0501. TAX ELECTION REQUIRED. (a) The district
304304 must hold an election in the manner provided by Chapter 49, Water
305305 Code, or, if applicable, Chapter 375, Local Government Code, to
306306 obtain voter approval before the district may impose an ad valorem
307307 tax.
308308 (b) Section 375.243, Local Government Code, does not apply
309309 to the district.
310310 Sec. 4015.0502. OPERATION AND MAINTENANCE TAX. (a) If
311311 authorized by a majority of the district voters voting at an
312312 election under Section 4015.0501, the district may impose an
313313 operation and maintenance tax on taxable property in the district
314314 in the manner provided by Section 49.107, Water Code, for any
315315 district purpose, including to:
316316 (1) maintain and operate the district;
317317 (2) construct or acquire improvements; or
318318 (3) provide a service.
319319 (b) The board shall determine the operation and maintenance
320320 tax rate. The rate may not exceed the rate approved at the
321321 election.
322322 Sec. 4015.0503. AUTHORITY TO BORROW MONEY AND TO ISSUE
323323 BONDS AND OTHER OBLIGATIONS. (a) The district may borrow money on
324324 terms determined by the board.
325325 (b) The district may issue, by public or private sale,
326326 bonds, notes, or other obligations payable wholly or partly from ad
327327 valorem taxes, assessments, impact fees, revenue, contract
328328 payments, grants, or other district money, or any combination of
329329 those sources of money, to pay for any authorized district purpose.
330330 (c) The district may issue, by public or private sale,
331331 bonds, notes, or other obligations payable wholly or partly from
332332 assessments in the manner provided by Subchapter A, Chapter 372,
333333 Local Government Code, if the improvement financed by the
334334 obligation issued under this section will be conveyed to or
335335 operated and maintained by a municipality, county, or other retail
336336 utility provider pursuant to an agreement with the district entered
337337 into before the issuance of the obligation.
338338 Sec. 4015.0504. BONDS SECURED BY REVENUE OR CONTRACT
339339 PAYMENTS. The district may issue, without an election, bonds
340340 secured by:
341341 (1) revenue other than ad valorem taxes, including
342342 contract revenues; or
343343 (2) contract payments, provided that the requirements
344344 of Section 49.108, Water Code, have been met.
345345 Sec. 4015.0505. BONDS SECURED BY AD VALOREM TAXES;
346346 ELECTIONS. (a) If authorized at an election under Section
347347 4015.0501, the district may issue bonds payable from ad valorem
348348 taxes.
349349 (b) At the time the district issues bonds payable wholly or
350350 partly from ad valorem taxes, the board shall provide for the annual
351351 imposition of a continuing direct annual ad valorem tax, without
352352 limit as to rate or amount, for each year that all or part of the
353353 bonds are outstanding as required and in the manner provided by
354354 Sections 54.601 and 54.602, Water Code.
355355 (c) All or any part of any facilities or improvements that
356356 may be acquired by a district by the issuance of its bonds may be
357357 submitted as a single proposition or as several propositions to be
358358 voted on at the election.
359359 SUBCHAPTER I. DISSOLUTION
360360 Sec. 4015.0901. DISSOLUTION. (a) The board shall dissolve
361361 the district on written petition filed with the board by the owners
362362 of:
363363 (1) at least two-thirds of the assessed value of the
364364 property subject to assessment by the district based on the most
365365 recent certified county property tax rolls; or
366366 (2) at least two-thirds of the surface area of the
367367 district, excluding roads, streets, highways, utility
368368 rights-of-way, other public areas, and other property exempt from
369369 assessment by the district according to the most recent certified
370370 county property tax rolls.
371371 (b) The board by majority vote may dissolve the district at
372372 any time.
373373 (c) The district may not be dissolved by its board under
374374 Subsection (a) or (b) if the district:
375375 (1) has any outstanding bonded indebtedness until that
376376 bonded indebtedness has been repaid or defeased in accordance with
377377 the order or resolution authorizing the issuance of the bonds;
378378 (2) has a contractual obligation to pay money until
379379 that obligation has been fully paid in accordance with the
380380 contract; or
381381 (3) owns, operates, or maintains public works,
382382 facilities, or improvements unless the district contracts with
383383 another person for the ownership, operation, or maintenance of the
384384 public works, facilities, or improvements.
385385 (d) Sections 375.261, 375.262, and 375.264, Local
386386 Government Code, do not apply to the district.
387387 SECTION 2. The Wolf Creek Municipal Management District
388388 No. 1 initially includes all territory contained in the following
389389 area:
390390 LEGAL DESCRIPTION - TRACT 1
391391 760.994 ACRE TRACT
392392 LEGAL DESCRIPTION: Being 760.994 acres of land out of the E. Tedwell
393393 Survey, Abstract No. 1035, the J. C. Bates Survey, Abstract No. 35,
394394 I. White Survey, Abstract No. 144, J. Grilski Survey, Abstract
395395 No. 387, the W. Rogers Survey, Abstract No. 1885, the A. J. Hefner
396396 Survey, Abstract No. 473 and the Wm. H. Sowell Survey, Abstract
397397 No. 996 in Hunt County, Texas and also being all of that certain
398398 760.70 acre tract described in Doc. #2023-10812 of the Official
399399 Public Records of said Hunt County, Texas; Said 760.70 acre tract
400400 being more particularly described as follows and as surveyed under

402402 BEGINNING at a calculated point in the east line of State Highway
403403 No. 34 for the northwest corner of that certain 93.00 acre tract

406406 THENCE along the east line of said Highway, the following 3 courses:
407407 1. North 00°22'32" West a distance of 752.68 feet to a
408408 concrete monument found;
409409 2. Along a curve turning to the left with an arc length of
410410 1345.62 feet, with a radius of 2914.79 feet, with a chord bearing of
411411 North 13°30'37" West, a distance of 1333.70 feet to a 1/2" iron rod

11521152 submitted the notice and Act to the Texas Commission on

11541154 (c) The Texas Commission on Environmental Quality has filed
11551155 its recommendations relating to this Act with the governor,
11561156 lieutenant governor, and speaker of the house of representatives

11581158 (d) All requirements of the constitution and laws of this
11591159 state and the rules and procedures of the legislature with respect
11601160 to the notice, introduction, and passage of this Act have been

11621162 SECTION 4. (a) Section 4015.0311, Special District Local
11631163 Laws Code, as added by Section 1 of this Act, takes effect only if
11641164 this Act receives a two-thirds vote of all the members elected to
11651165 each house.
11661166 (b) If this Act does not receive a two-thirds vote of all the
11671167 members elected to each house, Subchapter C, Chapter 4015, Special
11681168 District Local Laws Code, as added by Section 1 of this Act, is
11691169 amended by adding Section 4015.0311 to read as follows:
11701170 Sec. 4015.0311. NO EMINENT DOMAIN POWER. The district may
11711171 not exercise the power of eminent domain.
11721172 SECTION 5. This Act takes effect immediately if it receives
11731173 a vote of two-thirds of all the members elected to each house, as
11741174 provided by Section 39, Article III, Texas Constitution. If this
11751175 Act does not receive the vote necessary for immediate effect, this
11761176 Act takes effect September 1, 2025.
