| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Section 11.301, Parks and Wildlife Code, is | |
| 14 | 14 | amended by adding Subsection (d) to read as follows: | |
| 15 | 15 | (d) An easement on state land managed by the department that | |
| 16 | 16 | is granted by the commission to an electric cooperative as defined | |
| 17 | 17 | by Section 161.002, Utilities Code, shall be in perpetuity. | |
| 18 | 18 | SECTION 2. Section 11.301(d), Parks and Wildlife Code, as | |
| 19 | 19 | added by this Act, applies only to an easement granted on or after | |
| 20 | 20 | the effective date of this Act. An easement granted before the | |
| 21 | 21 | effective date of this Act is governed by the law in effect on the | |
| 22 | 22 | date the easement was granted, and the former law is continued in | |
| 23 | 23 | effect for that purpose. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2025. |
