79 A BILL TO BE ENTITLED
810 AN ACT
911 relating to the determination of a majority vote in certain
1012 elections.
1113 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1214 SECTION 1. Subchapter B, Chapter 2, Election Code, is
1315 amended by adding Section 2.0215 to read as follows:
1416 Sec. 2.0215. DETERMINATION OF MAJORITY VOTE. (a) In this
1517 section, "preferential voting system" means a voting system which
1618 permits a voter to rank each candidate through a numerical
1719 designation from the candidate the voter favors most to the
1820 candidate the voter favors least.
1921 (b) In an election requiring a majority vote to be elected
2022 to a public or political party office or to receive a political
2123 party's nomination, a candidate must receive more than half of the
2224 votes as originally cast. A majority may not be determined by using
2325 a preferential voting system to reassign votes.
2426 SECTION 2. Section 2.022(b), Election Code, is amended to
2527 read as follows:
2628 (b) Sections 2.0215, 2.023, 2.025, and 2.028 supersede a law
2729 outside this subchapter to the extent of any conflict.
2830 SECTION 3. This Act takes effect September 1, 2025.
