11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter I, Chapter 21, Education Code, is | |
13 | 13 | amended by adding Section 21.416 to read as follows: | |
14 | 14 | Sec. 21.416. ELECTION BY TEACHER TO USE UNPAID LEAVE. The | |
15 | 15 | board of trustees of a school district shall adopt a policy that | |
16 | 16 | provides a classroom teacher employed by the district the option to | |
17 | 17 | elect not to take the teacher's paid personal leave concurrently | |
18 | 18 | with unpaid leave the teacher is entitled to take under the Family | |
19 | 19 | and Medical Leave Act of 1993 (29 U.S.C. Section 2601 et seq.) for | |
20 | 20 | an absence due to pregnancy or the birth or adoption of a child. | |
21 | 21 | SECTION 2. This Act applies beginning with the 2025-2026 | |
22 | 22 | school year. | |
23 | 23 | SECTION 3. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2025. |
