128 AN ACT
139 relating to an election to approve a reduction or reallocation of
1410 funding or resources for certain county prosecutors' offices.
1511 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1612 SECTION 1. The heading to Chapter 120, Local Government
1713 Code, is amended to read as follows:
1814 CHAPTER 120. ELECTION FOR REDUCTION OF FUNDING OR RESOURCES FOR
1915 CERTAIN PRIMARY LAW ENFORCEMENT AGENCIES AND PROSECUTORS' OFFICES
2016 SECTION 2. Chapter 120, Local Government Code, is amended
2117 by adding Section 120.0001 to read as follows:
2218 Sec. 120.0001. DEFINITION. In this chapter, "prosecutor's
2319 office" means the office of a district attorney, a criminal
2420 district attorney, or a county attorney with criminal jurisdiction.
2521 SECTION 3. Sections 120.002(a) and (c), Local Government
2622 Code, are amended to read as follows:
2723 (a) Except as provided by Section 120.003, a county shall
2824 hold an election in accordance with this chapter if the county
2925 adopts a budget for a fiscal year that, compared to the budget
3026 adopted by the county for the preceding fiscal year:
3127 (1) reduces for a law enforcement agency, excluding a
3228 9-1-1 call center, with primary responsibility for policing,
3329 criminal investigation, and answering calls for service or for a
3430 prosecutor's office:
3531 (A) for a fiscal year in which the overall amount
3632 of the budget is equal to or greater than the amount for the
3733 preceding fiscal year, the appropriation to the agency or office;
3834 (B) for a fiscal year in which the overall amount
3935 of the budget is less than the amount for the preceding fiscal year,
4036 the appropriation to the agency or office as a percentage of the
4137 total budget;
4238 (C) as applicable:
4339 (i) if the county has not declined in
4440 population since the preceding fiscal year, the number of peace
4541 officer positions, excluding detention officer positions; or
4642 (ii) if the county has declined in
4743 population since the preceding fiscal year, the number of peace
4844 officer positions, excluding detention officer positions, the law
4945 enforcement agency is authorized to employ per 1,000 county
5046 residents; or
5147 (D) the amount of funding per peace officer for
5248 the recruitment and training of new peace officers to fill vacant
5349 and new peace officer positions in the agency; or
5450 (2) reallocates funding or resources to another law
5551 enforcement agency or prosecutor's office.
5652 (c) For purposes of this section, a county budget does not
5753 include:
5854 (1) a one-time extraordinary expense, as determined by
5955 the comptroller, that is outside the normal costs of operating a law
6056 enforcement agency or prosecutor's office, including purchasing a
6157 fleet of law enforcement vehicles or constructing an additional
6258 training academy;
6359 (2) revenues used to repay voter-approved bonded
6460 indebtedness incurred for a law enforcement or prosecutorial
6561 purpose;
6662 (3) detention officer compensation; or
6763 (4) a donation or state or federal grant to the
6864 county's law enforcement agency or prosecutor's office.
6965 SECTION 4. Section 120.007(c), Local Government Code, is
7066 amended to read as follows:
7167 (c) Notwithstanding any other law, if the comptroller
7268 determines that a county implemented a proposed reduction or
7369 reallocation described by Section 120.002(a) without the required
7470 voter approval, the county may not adopt an ad valorem tax rate that
7571 exceeds the county's no-new-revenue tax rate until the earlier of:
7672 (1) the date the comptroller issues a written
7773 determination that the county has, as applicable:
7874 (A) reversed each funding reduction, adjusted
7975 for inflation, and personnel reduction that was a subject of the
8076 determination; or
8177 (B) restored all reallocated funding and
8278 resources that were subjects of the determination to the original
8379 law enforcement agency or prosecutor's office; or
8480 (2) the date on which each reduction and reallocation
8581 that was a subject of the determination has been approved in an
8682 election held in accordance with this chapter.
8783 SECTION 5. This Act takes effect January 1, 2026.
