77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the defense to prosecution for certain offenses
1010 involving possession of small amounts of controlled substances,
1111 marihuana, dangerous drugs, or abusable volatile chemicals, or
1212 possession of drug paraphernalia for defendants seeking assistance
1313 for a suspected overdose.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 481.115(h), Health and Safety Code, is
1616 amended to read as follows:
1717 (h) The defense to prosecution provided by Subsection (g) is
1818 not available if[:
1919 [(1)] at the time the request for emergency medical
2020 assistance was made:
2121 (1) [(A)] a peace officer was in the process of
2222 arresting the actor or executing a search warrant describing the
2323 actor or the place from which the request for medical assistance was
2424 made; or
2525 (2) [(B)] the actor is committing another offense,
2626 other than an offense punishable under Section 481.1151(b)(1),
2727 481.116(b), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
2828 481.121(b)(1) or (2), or an offense under Section 481.119(b),
2929 481.125(a), 483.041(a), or 485.031(a)[;
3030 [(2) the actor has been previously convicted of or
3131 placed on deferred adjudication community supervision for an
3232 offense under this chapter or Chapter 483 or 485;
3333 [(3) the actor was acquitted in a previous proceeding
3434 in which the actor successfully established the defense under that
3535 subsection or Section 481.1151(c), 481.116(f), 481.1161(c),
3636 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
3737 483.041(e), or 485.031(c); or
3838 [(4) at any time during the 18-month period preceding
3939 the date of the commission of the instant offense, the actor
4040 requested emergency medical assistance in response to the possible
4141 overdose of the actor or another person].
4242 SECTION 2. Section 481.1151(d), Health and Safety Code, is
4343 amended to read as follows:
4444 (d) The defense to prosecution provided by Subsection (c) is
4545 not available if[:
4646 [(1)] at the time the request for emergency medical
4747 assistance was made:
4848 (1) [(A)] a peace officer was in the process of
4949 arresting the actor or executing a search warrant describing the
5050 actor or the place from which the request for medical assistance was
5151 made; or
5252 (2) [(B)] the actor is committing another offense,
5353 other than an offense punishable under Section 481.115(b),
5454 481.116(b), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
5555 481.121(b)(1) or (2), or an offense under Section 481.119(b),
5656 481.125(a), 483.041(a), or 485.031(a)[;
5757 [(2) the actor has been previously convicted of or
5858 placed on deferred adjudication community supervision for an
5959 offense under this chapter or Chapter 483 or 485;
6060 [(3) the actor was acquitted in a previous proceeding
6161 in which the actor successfully established the defense under that
6262 subsection or Section 481.115(g), 481.116(f), 481.1161(c),
6363 481.117(f), 481.118(f), 481.119(c), 481.121(c), 481.125(g),
6464 483.041(e), or 485.031(c); or
6565 [(4) at any time during the 18-month period preceding
6666 the date of the commission of the instant offense, the actor
6767 requested emergency medical assistance in response to the possible
6868 overdose of the actor or another person].
6969 SECTION 3. Section 481.116(g), Health and Safety Code, is
7070 amended to read as follows:
7171 (g) The defense to prosecution provided by Subsection (f) is
7272 not available if[:
7373 [(1)] at the time the request for emergency medical
7474 assistance was made:
7575 (1) [(A)] a peace officer was in the process of
7676 arresting the actor or executing a search warrant describing the
7777 actor or the place from which the request for medical assistance was
7878 made; or
7979 (2) [(B)] the actor is committing another offense,
8080 other than an offense punishable under Section 481.115(b),
8181 481.1151(b)(1), 481.1161(b)(1) or (2), 481.117(b), 481.118(b), or
8282 481.121(b)(1) or (2), or an offense under Section 481.119(b),
8383 481.125(a), 483.041(a), or 485.031(a)[;
8484 [(2) the actor has been previously convicted of or
8585 placed on deferred adjudication community supervision for an
8686 offense under this chapter or Chapter 483 or 485;
8787 [(3) the actor was acquitted in a previous proceeding
8888 in which the actor successfully established the defense under that

9595 overdose of the actor or another person].
9696 SECTION 4. Section 481.1161(d), Health and Safety Code, is
9797 amended to read as follows:
9898 (d) The defense to prosecution provided by Subsection (c) is
9999 not available if[:
100100 [(1)] at the time the request for emergency medical
101101 assistance was made:
102102 (1) [(A)] a peace officer was in the process of
103103 arresting the actor or executing a search warrant describing the
104104 actor or the place from which the request for medical assistance was
105105 made; or
106106 (2) [(B)] the actor is committing another offense,
107107 other than an offense punishable under Section 481.115(b),
108108 481.1151(b)(1), 481.116(b), 481.117(b), 481.118(b), or
109109 481.121(b)(1) or (2), or an offense under Section 481.119(b),
110110 481.125(a), 483.041(a), or 485.031(a)[;
111111 [(2) the actor has been previously convicted of or

123123 SECTION 5. Section 481.117(g), Health and Safety Code, is
124124 amended to read as follows:
125125 (g) The defense to prosecution provided by Subsection (f) is
126126 not available if[:
127127 [(1)] at the time the request for emergency medical
128128 assistance was made:
129129 (1) [(A)] a peace officer was in the process of
130130 arresting the actor or executing a search warrant describing the
131131 actor or the place from which the request for medical assistance was

150150 SECTION 6. Section 481.118(g), Health and Safety Code, is
151151 amended to read as follows:
152152 (g) The defense to prosecution provided by Subsection (f) is
153153 not available if[:
154154 [(1)] at the time the request for emergency medical
155155 assistance was made:
156156 (1) [(A)] a peace officer was in the process of
157157 arresting the actor or executing a search warrant describing the
158158 actor or the place from which the request for medical assistance was
159159 made; or
160160 (2) [(B)] the actor is committing another offense,
161161 other than an offense punishable under Section 481.115(b),
162162 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b), or
163163 481.121(b)(1) or (2), or an offense under Section 481.119(b),

177177 SECTION 7. Section 481.119(d), Health and Safety Code, is
178178 amended to read as follows:
179179 (d) The defense to prosecution provided by Subsection (c) is
180180 not available if[:
181181 [(1)] at the time the request for emergency medical
182182 assistance was made:
183183 (1) [(A)] a peace officer was in the process of
184184 arresting the actor or executing a search warrant describing the
185185 actor or the place from which the request for medical assistance was
186186 made; or
187187 (2) [(B)] the actor is committing another offense,
188188 other than an offense punishable under Section 481.115(b),
189189 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
190190 481.118(b), or 481.121(b)(1) or (2), or an offense under Section

201201 the date of the commission of the instant offense, the actor

203203 overdose of the actor or another person].
204204 SECTION 8. Section 481.121(d), Health and Safety Code, is
205205 amended to read as follows:
206206 (d) The defense to prosecution provided by Subsection (c) is
207207 not available if[:
208208 [(1)] at the time the request for emergency medical
209209 assistance was made:
210210 (1) [(A)] a peace officer was in the process of
211211 arresting the actor or executing a search warrant describing the
212212 actor or the place from which the request for medical assistance was
213213 made; or
214214 (2) [(B)] the actor is committing another offense,
215215 other than an offense punishable under Section 481.115(b),
216216 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b), or
217217 481.118(b), or an offense under Section 481.119(b), 481.125(a),
218218 483.041(a), or 485.031(a)[;
219219 [(2) the actor has been previously convicted of or

231231 SECTION 9. Section 481.125(h), Health and Safety Code, is
232232 amended to read as follows:
233233 (h) The defense to prosecution provided by Subsection (g) is
234234 not available if[:
235235 [(1)] at the time the request for emergency medical
236236 assistance was made:
237237 (1) [(A)] a peace officer was in the process of
238238 arresting the actor or executing a search warrant describing the
239239 actor or the place from which the request for medical assistance was
240240 made; or
241241 (2) [(B)] the actor is committing another offense,
242242 other than an offense punishable under Section 481.115(b),

258258 SECTION 10. Section 483.041(f), Health and Safety Code, is
259259 amended to read as follows:
260260 (f) The defense to prosecution provided by Subsection (e) is
261261 not available if[:
262262 [(1)] at the time the request for emergency medical
263263 assistance was made:
264264 (1) [(A)] a peace officer was in the process of
265265 arresting the actor or executing a search warrant describing the
266266 actor or the place from which the request for medical assistance was
267267 made; or
268268 (2) [(B)] the actor is committing another offense,
269269 other than an offense punishable under Section 481.115(b),
270270 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
271271 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
272272 481.119(b), 481.125(a), or 485.031(a)[;
273273 [(2) the actor has been previously convicted of or
274274 placed on deferred adjudication community supervision for an
275275 offense under this chapter or Chapter 481 or 485;
276276 [(3) the actor was acquitted in a previous proceeding

285285 SECTION 11. Section 485.031(d), Health and Safety Code, is
286286 amended to read as follows:
287287 (d) The defense to prosecution provided by Subsection (c) is
288288 not available if[:
289289 [(1)] at the time the request for emergency medical
290290 assistance was made:
291291 (1) [(A)] a peace officer was in the process of
292292 arresting the actor or executing a search warrant describing the
293293 actor or the place from which the request for medical assistance was
294294 made; or
295295 (2) [(B)] the actor is committing another offense,
296296 other than an offense punishable under Section 481.115(b),
297297 481.1151(b)(1), 481.116(b), 481.1161(b)(1) or (2), 481.117(b),
298298 481.118(b), or 481.121(b)(1) or (2), or an offense under Section
299299 481.119(b), 481.125(a), or 483.041(a)[;
300300 [(2) the actor has been previously convicted of or
301301 placed on deferred adjudication community supervision for an
302302 offense under this chapter or Chapter 481 or 483;
303303 [(3) the actor was acquitted in a previous proceeding
304304 in which the actor successfully established the defense under that
305305 subsection or Section 481.115(g), 481.1151(c), 481.116(f),
306306 481.1161(c), 481.117(f), 481.118(f), 481.119(c), 481.121(c),
307307 481.125(g), or 483.041(e); or
308308 [(4) at any time during the 18-month period preceding
309309 the date of the commission of the instant offense, the actor
310310 requested emergency medical assistance in response to the possible
311311 overdose of the actor or another person].
312312 SECTION 12. The changes in law made by this Act apply only
313313 to an offense committed on or after the effective date of this Act.
314314 An offense committed before the effective date of this Act is
315315 governed by the law in effect on the date the offense was committed,
316316 and the former law is continued in effect for that purpose. For
317317 purposes of this section, an offense was committed before the
318318 effective date of this Act if any element of the offense occurred
319319 before that date.
320320 SECTION 13. This Act takes effect September 1, 2025.
