77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to screening by a landlord of applicants for residential
1010 tenancies.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 92.3515, Property Code, is amended by
1313 amending Subsection (a) and adding Subsection (a-1) to read as
1414 follows:
1515 (a) At the time an applicant is provided with a rental
1616 application and before accepting an application fee, the landlord
1717 shall make available to the applicant printed notice of the
1818 landlord's tenant selection criteria and the grounds for which the
1919 rental application may be denied, including the applicant's:
2020 (1) criminal history;
2121 (2) previous rental history;
2222 (3) current income;
2323 (4) credit history; or
2424 (5) failure to provide accurate or complete
2525 information on the application form.
2626 (a-1) The printed notice must state in writing that the
2727 applicant may provide evidence showing:
2828 (1) the inaccuracies in the applicant's criminal
2929 history;
3030 (2) the applicant's rehabilitation; or
3131 (3) other mitigating factors.
3232 SECTION 2. Section 92.354, Property Code, is amended to
3333 read as follows:
3434 Sec. 92.354. LIABILITY OF LANDLORD. (a) A landlord who in
3535 bad faith fails to refund an application fee or deposit in violation
3636 of this subchapter is liable for an amount equal to the sum of $100,
3737 three times the amount wrongfully retained, and the applicant's
3838 reasonable attorney's fees.
3939 (b) A landlord who violates Section 92.3515 is liable for an
4040 amount equal to the sum of $500 and the applicant's reasonable
4141 attorney's fees.
4242 SECTION 3. The changes in law made by this Act apply only to
4343 a rental application submitted on or after the effective date of
4444 this Act. A rental application submitted before the effective date
4545 of this Act is governed by the law in effect immediately before the
4646 effective date of this Act, and the former law is continued in
4747 effect for that purpose.
4848 SECTION 4. This Act takes effect September 1, 2025.
