| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 2, Election Code, is amended by adding |
|---|
| 12 | 12 | | Subchapter E to read as follows: |
|---|
| 13 | 13 | | SUBCHAPTER E. PREFERENTIAL VOTING |
|---|
| 14 | 14 | | Sec. 2.101. USE OPTIONAL. The governing body of a |
|---|
| 15 | 15 | | municipality or independent school district may authorize the use |
|---|
| 16 | 16 | | of preferential voting as provided by this subchapter for a |
|---|
| 17 | 17 | | nonpartisan election of an officer of the municipality or school |
|---|
| 18 | 18 | | district, as appropriate, by majority vote. |
|---|
| 19 | 19 | | Sec. 2.102. ADOPTION OF PREFERENTIAL VOTING PROCEDURES. |
|---|
| 20 | 20 | | (a) The secretary of state shall prescribe procedures to allow for |
|---|
| 21 | 21 | | an election of an office requiring a majority vote using a |
|---|
| 22 | 22 | | preferential voting system. |
|---|
| 23 | 23 | | (b) The system must allow a voter to rank each candidate for |
|---|
| 24 | 24 | | an office through a numerical designation from the candidate the |
|---|
| 25 | 25 | | voter favors most to the candidate the voter favors least. |
|---|
| 26 | 26 | | Sec. 2.103. DETERMINATION OF ELECTION RESULT. (a) If no |
|---|
| 27 | 27 | | candidate receives a majority of the votes cast designating the |
|---|
| 28 | 28 | | highest favorable ranking for an office, the votes of the candidate |
|---|
| 29 | 29 | | receiving the fewest number of votes are reassigned to the |
|---|
| 30 | 30 | | candidate ranking next highest in the preference of a voter. |
|---|
| 31 | 31 | | (b) If after reassigning votes under Subsection (a) no |
|---|
| 32 | 32 | | candidate receives a majority of the votes cast designating the |
|---|
| 33 | 33 | | modified highest favorable ranking, the reassignment of a vote to a |
|---|
| 34 | 34 | | voter's next most preferred candidate under Subsection (a) |
|---|
| 35 | 35 | | continues until one candidate receives a majority. |
|---|
| 36 | 36 | | Sec. 2.104. PRIMARY NOT HELD; FILING PERIOD. (a) A primary |
|---|
| 37 | 37 | | election is not held for an office to which this subchapter applies. |
|---|
| 38 | 38 | | (b) The secretary of state shall prescribe the filing |
|---|
| 39 | 39 | | deadline for an application for a place on the ballot for an office |
|---|
| 40 | 40 | | to which this subchapter applies that is filled at the general |
|---|
| 41 | 41 | | election for state and county officers. |
|---|
| 42 | 42 | | Sec. 2.105. RUNOFF ELECTION NOT HELD. Notwithstanding any |
|---|
| 43 | 43 | | other law, a runoff election is not held for an office to which this |
|---|
| 44 | 44 | | subchapter applies. |
|---|
| 45 | 45 | | SECTION 2. This Act takes effect September 1, 2025. |
