88 AN ACT
99 relating to the use of preferential voting in certain elections.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 2, Election Code, is amended by adding
1212 Subchapter E to read as follows:
1313 SUBCHAPTER E. PREFERENTIAL VOTING
1414 Sec. 2.101. USE OPTIONAL. The governing body of a
1515 municipality or independent school district may authorize the use
1616 of preferential voting as provided by this subchapter for a
1717 nonpartisan election of an officer of the municipality or school
1818 district, as appropriate, by majority vote.
1919 Sec. 2.102. ADOPTION OF PREFERENTIAL VOTING PROCEDURES.
2020 (a) The secretary of state shall prescribe procedures to allow for
2121 an election of an office requiring a majority vote using a
2222 preferential voting system.
2323 (b) The system must allow a voter to rank each candidate for
2424 an office through a numerical designation from the candidate the
2525 voter favors most to the candidate the voter favors least.
2626 Sec. 2.103. DETERMINATION OF ELECTION RESULT. (a) If no
2727 candidate receives a majority of the votes cast designating the
2828 highest favorable ranking for an office, the votes of the candidate
2929 receiving the fewest number of votes are reassigned to the
3030 candidate ranking next highest in the preference of a voter.
3131 (b) If after reassigning votes under Subsection (a) no
3232 candidate receives a majority of the votes cast designating the
3333 modified highest favorable ranking, the reassignment of a vote to a
3434 voter's next most preferred candidate under Subsection (a)
3535 continues until one candidate receives a majority.
3636 Sec. 2.104. PRIMARY NOT HELD; FILING PERIOD. (a) A primary
3737 election is not held for an office to which this subchapter applies.
3838 (b) The secretary of state shall prescribe the filing
3939 deadline for an application for a place on the ballot for an office
4040 to which this subchapter applies that is filled at the general
4141 election for state and county officers.
4242 Sec. 2.105. RUNOFF ELECTION NOT HELD. Notwithstanding any
4343 other law, a runoff election is not held for an office to which this
4444 subchapter applies.
4545 SECTION 2. This Act takes effect September 1, 2025.
