| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 572, Government Code, is |
|---|
| 13 | 13 | | amended by adding Section 572.062 to read as follows: |
|---|
| 14 | 14 | | Sec. 572.062. FORMER LEGISLATOR: LOBBYING RESTRICTED; |
|---|
| 15 | 15 | | CRIMINAL OFFENSE. (a) In this section: |
|---|
| 16 | 16 | | (1) "Administrative action," "communicates directly |
|---|
| 17 | 17 | | with," "legislation," "member of the executive branch," and "member |
|---|
| 18 | 18 | | of the legislative branch" have the meanings assigned by Section |
|---|
| 19 | 19 | | 305.002. |
|---|
| 20 | 20 | | (2) "Legislative cycle" means the two-year period |
|---|
| 21 | 21 | | beginning on the first day of a regular legislative session and |
|---|
| 22 | 22 | | ending on the day before the first day of the succeeding regular |
|---|
| 23 | 23 | | legislative session. |
|---|
| 24 | 24 | | (b) Except as provided by Subsection (c), a former member of |
|---|
| 25 | 25 | | the legislature may not engage in activities that require |
|---|
| 26 | 26 | | registration under Chapter 305 before the end of the legislative |
|---|
| 27 | 27 | | cycle following the legislative cycle in which the former member |
|---|
| 28 | 28 | | last served as a member of the legislature. |
|---|
| 29 | 29 | | (c) Subsection (b) does not apply to a former member of the |
|---|
| 30 | 30 | | legislature who does not receive compensation other than |
|---|
| 31 | 31 | | reimbursement for actual expenses for communicating directly with a |
|---|
| 32 | 32 | | member of the legislative branch or a member of the executive branch |
|---|
| 33 | 33 | | to influence legislation or an administrative action. |
|---|
| 34 | 34 | | (d) A former member of the legislature commits an offense if |
|---|
| 35 | 35 | | the former member violates this section. An offense under this |
|---|
| 36 | 36 | | section is a Class B misdemeanor. |
|---|
| 37 | 37 | | SECTION 2. Section 572.062, Government Code, as added by |
|---|
| 38 | 38 | | this Act, applies only to a member of the legislature who ceases to |
|---|
| 39 | 39 | | be a member of the legislature after the effective date of this Act. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect January 12, 2027. |
