11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter A, Chapter 38, Education Code, is | |
13 | 13 | amended by adding Section 38.044 to read as follows: | |
14 | 14 | Sec. 38.044. ACCOMMODATIONS FOR LACTATING STUDENTS. The | |
15 | 15 | board of trustees of each school district, the governing boards of | |
16 | 16 | the Texas School for the Blind and Visually Impaired and the Texas | |
17 | 17 | School for the Deaf, and the governing body of each open-enrollment | |
18 | 18 | charter school shall provide reasonable accommodations to a | |
19 | 19 | lactating student enrolled at the middle or high school level to | |
20 | 20 | enable the student to: | |
21 | 21 | (1) express breast milk; | |
22 | 22 | (2) breast-feed an infant child; and | |
23 | 23 | (3) address other needs related to breast-feeding. | |
24 | 24 | SECTION 2. This Act applies beginning with the 2025-2026 | |
25 | 25 | school year. | |
26 | 26 | SECTION 3. This Act takes effect immediately if it receives | |
27 | 27 | a vote of two-thirds of all the members elected to each house, as | |
28 | 28 | provided by Section 39, Article III, Texas Constitution. If this | |
29 | 29 | Act does not receive the vote necessary for immediate effect, this | |
30 | 30 | Act takes effect September 1, 2025. |
