77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the notice given by a property owner prohibiting
1010 certain persons from carrying certain firearms on the property.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 30.05(c), Penal Code, is amended to read
1313 as follows:
1414 (c) A person may provide notice that firearms are prohibited
1515 on the property by posting [a sign] at each entrance to the property
1616 [that]:
1717 (1) a sign that:
1818 (A) includes, in both English and Spanish,
1919 language that is identical to or substantially similar to the
2020 following: "Pursuant to Section 30.05, Penal Code (criminal
2121 trespass), a person may not enter this property with a firearm";
2222 (B) [(2) includes the language described by
2323 Subdivision (1) in both English and Spanish;
2424 [(3)] appears in contrasting colors with block letters
2525 at least one inch in height; and
2626 (C) [(4)] is displayed in a conspicuous manner
2727 clearly visible to the public; or
2828 (2) a sign that:
2929 (A) includes, in both English and Spanish,
3030 language that is identical to or substantially similar to the
3131 following: "No firearms permitted on this property";
3232 (B) appears on a white background with black
3333 block letters at least one inch in height;
3434 (C) contains a pictogram that shows, on a white
3535 background, a handgun drawn in black ink within a red circle of at
3636 least six inches in diameter and a diagonal red line across the
3737 handgun; and
3838 (D) is displayed in a conspicuous manner clearly
3939 visible to the public.
4040 SECTION 2. Section 30.06(c)(3), Penal Code, is amended to
4141 read as follows:
4242 (3) "Written communication" means:
4343 (A) a card or other document on which is written
4444 language identical to the following: "Pursuant to Section 30.06,
4545 Penal Code (trespass by license holder with a concealed handgun), a
4646 person licensed under Subchapter H, Chapter 411, Government Code
4747 (handgun licensing law), may not enter this property with a
4848 concealed handgun"; [or]
4949 (B) a sign posted on the property that:
5050 (i) includes the language described by
5151 Paragraph (A) in both English and Spanish;
5252 (ii) appears in contrasting colors with
5353 block letters at least one inch in height; and
5454 (iii) is displayed in a conspicuous manner
5555 clearly visible to the public; or
5656 (C) a sign posted on the property that:
5757 (i) includes, in both English and Spanish,
5858 language that is identical to or substantially similar to the
5959 following: "No concealed handguns permitted on this property";
6060 (ii) appears on a white background with
6161 black block letters at least one inch in height;
6262 (iii) contains a pictogram that shows, on a
6363 white background, a handgun drawn in black ink within a red circle
6464 of at least six inches in diameter and a diagonal red line across
6565 the handgun; and
6666 (iv) is displayed in a conspicuous manner
6767 clearly visible to the public.
6868 SECTION 3. Section 30.07(c)(3), Penal Code, is amended to
6969 read as follows:
7070 (3) "Written communication" means:
7171 (A) a card or other document on which is written
7272 language identical to the following: "Pursuant to Section 30.07,
7373 Penal Code (trespass by license holder with an openly carried
7474 handgun), a person licensed under Subchapter H, Chapter 411,
7575 Government Code (handgun licensing law), may not enter this
7676 property with a handgun that is carried openly"; [or]
7777 (B) a sign posted on the property that:
7878 (i) includes the language described by
7979 Paragraph (A) in both English and Spanish;
8080 (ii) appears in contrasting colors with
8181 block letters at least one inch in height; and
8282 (iii) is displayed in a conspicuous manner
8383 clearly visible to the public at each entrance to the property; or
8484 (C) a sign posted on the property that:
8585 (i) includes, in both English and Spanish,
8686 language that is identical to or substantially similar to the
8787 following: "No openly carried handguns permitted on this property";
8888 (ii) appears on a white background with
8989 black block letters at least one inch in height;
9090 (iii) contains a pictogram that shows, on a
9191 white background, a handgun drawn in black ink within a red circle
9292 of at least six inches in diameter and a diagonal red line across
9393 the handgun; and
9494 (iv) is displayed in a conspicuous manner
9595 clearly visible to the public.
9696 SECTION 4. The changes in law made by this Act apply only to
9797 an offense committed on or after the effective date of this Act. An
9898 offense committed before the effective date of this Act is governed
9999 by the law in effect on the date the offense was committed, and the
100100 former law is continued in effect for that purpose.
101101 SECTION 5. This Act takes effect September 1, 2025.
