7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to the notice given by a property owner prohibiting
10	10	certain persons from carrying certain firearms on the property.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 30.05(c), Penal Code, is amended to read
13	13	as follows:
14	14	(c) A person may provide notice that firearms are prohibited
15	15	on the property by posting [a sign] at each entrance to the property
16	16	[that]:
17	17	(1) a sign that:
18	18	(A) includes, in both English and Spanish,
19	19	language that is identical to or substantially similar to the
20	20	following: "Pursuant to Section 30.05, Penal Code (criminal
21	21	trespass), a person may not enter this property with a firearm";
22	22	(B) [(2) includes the language described by
23	23	Subdivision (1) in both English and Spanish;
24	24	[(3)] appears in contrasting colors with block letters
25	25	at least one inch in height; and
26	26	(C) [(4)] is displayed in a conspicuous manner
27	27	clearly visible to the public; or
28	28	(2) a sign that:
29	29	(A) includes, in both English and Spanish,
30	30	language that is identical to or substantially similar to the
31	31	following: "No firearms permitted on this property";
32	32	(B) appears on a white background with black
33	33	block letters at least one inch in height;
34	34	(C) contains a pictogram that shows, on a white
35	35	background, a handgun drawn in black ink within a red circle of at
36	36	least six inches in diameter and a diagonal red line across the
37	37	handgun; and
38	38	(D) is displayed in a conspicuous manner clearly
39	39	visible to the public.
40	40	SECTION 2. Section 30.06(c)(3), Penal Code, is amended to
41	41	read as follows:
42	42	(3) "Written communication" means:
43	43	(A) a card or other document on which is written
44	44	language identical to the following: "Pursuant to Section 30.06,
45	45	Penal Code (trespass by license holder with a concealed handgun), a
46	46	person licensed under Subchapter H, Chapter 411, Government Code
47	47	(handgun licensing law), may not enter this property with a
48	48	concealed handgun"; [or]
49	49	(B) a sign posted on the property that:
50	50	(i) includes the language described by
51	51	Paragraph (A) in both English and Spanish;
52	52	(ii) appears in contrasting colors with
53	53	block letters at least one inch in height; and
54	54	(iii) is displayed in a conspicuous manner
55	55	clearly visible to the public; or
56	56	(C) a sign posted on the property that:
57	57	(i) includes, in both English and Spanish,
58	58	language that is identical to or substantially similar to the
59	59	following: "No concealed handguns permitted on this property";
60	60	(ii) appears on a white background with
61	61	black block letters at least one inch in height;
62	62	(iii) contains a pictogram that shows, on a
63	63	white background, a handgun drawn in black ink within a red circle
64	64	of at least six inches in diameter and a diagonal red line across
65	65	the handgun; and
66	66	(iv) is displayed in a conspicuous manner
67	67	clearly visible to the public.
68	68	SECTION 3. Section 30.07(c)(3), Penal Code, is amended to
69	69	read as follows:
70	70	(3) "Written communication" means:
71	71	(A) a card or other document on which is written
72	72	language identical to the following: "Pursuant to Section 30.07,
73	73	Penal Code (trespass by license holder with an openly carried
74	74	handgun), a person licensed under Subchapter H, Chapter 411,
75	75	Government Code (handgun licensing law), may not enter this
76	76	property with a handgun that is carried openly"; [or]
77	77	(B) a sign posted on the property that:
78	78	(i) includes the language described by
79	79	Paragraph (A) in both English and Spanish;
80	80	(ii) appears in contrasting colors with
81	81	block letters at least one inch in height; and
82	82	(iii) is displayed in a conspicuous manner
83	83	clearly visible to the public at each entrance to the property; or
84	84	(C) a sign posted on the property that:
85	85	(i) includes, in both English and Spanish,
86	86	language that is identical to or substantially similar to the
87	87	following: "No openly carried handguns permitted on this property";
88	88	(ii) appears on a white background with
89	89	black block letters at least one inch in height;
90	90	(iii) contains a pictogram that shows, on a
91	91	white background, a handgun drawn in black ink within a red circle
92	92	of at least six inches in diameter and a diagonal red line across
93	93	the handgun; and
94	94	(iv) is displayed in a conspicuous manner
95	95	clearly visible to the public.
96	96	SECTION 4. The changes in law made by this Act apply only to
97	97	an offense committed on or after the effective date of this Act. An
98	98	offense committed before the effective date of this Act is governed
99	99	by the law in effect on the date the offense was committed, and the
100	100	former law is continued in effect for that purpose.
101	101	SECTION 5. This Act takes effect September 1, 2025.
