88 AN ACT
99 relating to the reporting of lost or stolen firearms.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 411, Government Code, is
1212 amended by adding Section 411.056 to read as follows:
1313 Sec. 411.056. REPORT OF LOST OR STOLEN FIREARM. (a) A
1414 peace officer who receives a report from the owner of a firearm or
1515 the owner's agent that the firearm was lost or stolen shall report
1616 the loss or theft to the department. The report must include:
1717 (1) the name of the owner;
1818 (2) any available information about the firearm; and
1919 (3) the date that the owner became aware the firearm
2020 was lost or stolen.
2121 (b) The department shall regularly send all reports
2222 received under Subsection (a) to the National Crime Information
2323 Center.
2424 SECTION 2. Title 4, Civil Practice and Remedies Code, is
2525 amended by adding Chapter 100B to read as follows:
2626 CHAPTER 100B. LIABILITY RELATED TO FIREARMS
2727 Sec. 100B.001. LIMITED LIABILITY FOR HARM CAUSED BY LOST OR
2828 STOLEN FIREARM. A person whose firearm is lost or stolen is not
2929 liable to another person for harm caused by that firearm after it is
3030 lost or stolen if the person reports the loss or theft, or causes a
3131 report of the loss or theft to be made, to a peace officer or law
3232 enforcement agency not later than 24 hours after the time the person
3333 became aware the firearm is lost or stolen.
3434 SECTION 3. Chapter 100B, Civil Practice and Remedies Code,
3535 as added by this Act, applies only to a cause of action that accrues
3636 on or after the effective date of this Act.
3737 SECTION 4. This Act takes effect September 1, 2025.
