88 AN ACT
99 relating to Medicaid coverage and reimbursement for emergency
1010 outpatient dialysis treatment provided to certain individuals with
1111 end stage renal disease.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1414 is amended by adding Section 32.02465 to read as follows:
1515 Sec. 32.02465. MEDICAL ASSISTANCE COVERAGE AND
1616 REIMBURSEMENT FOR CERTAIN PERSONS REQUIRING EMERGENCY OUTPATIENT
1717 DIALYSIS TREATMENT. (a) This section applies only to an individual
1818 who:
1919 (1) has end stage renal disease; and
2020 (2) in accordance with Section 1903(v), Social
2121 Security Act (42 U.S.C. Section 1396b(v)), is eligible for medical
2222 assistance benefits if the benefits are necessary to treat an
2323 emergency medical condition.
2424 (b) For purposes of 42 C.F.R. Section 440.255, emergency
2525 services required to treat an emergency medical condition include
2626 outpatient dialysis treatment provided to an individual to whom
2727 this section applies at a hospital or an end stage renal disease
2828 facility, as defined by Section 251.001, Health and Safety Code.
2929 (c) The commission shall ensure that medical assistance
3030 reimbursement authorized under Section 1903(v), Social Security
3131 Act (42 U.S.C. Section 1396b(v)), is provided for outpatient
3232 dialysis treatment provided to an individual to whom this section
3333 applies.
3434 SECTION 2. If before implementing any provision of this Act
3535 a state agency determines that a waiver or authorization from a
3636 federal agency is necessary for implementation of that provision,
3737 the agency affected by the provision shall request the waiver or
3838 authorization and may delay implementing that provision until the
3939 waiver or authorization is granted.
4040 SECTION 3. This Act takes effect September 1, 2025.
