7	10		AN ACT
8	11		relating to bond requirements for certain judges.
9	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	13		SECTION 1. Sections 25.0006(a-1) and (a-4), Government
11	14		Code, are amended to read as follows:
12	15		(a-1) Before beginning the duties of the office, the judge
13	16		of a statutory county court must execute a bond that:
14	17		(1) is payable to the treasurer of the county;
15	18		(2) is in the amount set by the commissioners court of:
16	19		(A) subject to Paragraph (B), not less than
17	20		$1,000 nor more than $10,000; or
18	21		(B) for a judge presiding in the court over
19	22		guardianship proceedings, as defined by Section 1002.015, Estates
20	23		Code, or over probate proceedings, as defined by Section 22.029,
21	24		Estates Code, not less than $500,000[:
22	25		[(i) $100,000 for a court in a county with a
23	26		population of 125,000 or less; or
24	27		[(ii) $250,000 for a court in a county with
25	28		a population of more than 125,000]; and
26	29		(3) is conditioned that the judge will:
27	30		(A) faithfully perform all duties of office; and
28	31		(B) for a judge presiding in the court over
29	32		guardianship or probate proceedings, perform the duties required by
30	33		the Estates Code.
31	34		(a-4) This section does not apply to:
32	35		(1) [a judge of a statutory county court who does not
33	36		preside over guardianship proceedings, as defined by Section
34	37		1002.015, Estates Code;
35	38		[(2)] a judge of a statutory probate court who
36	39		executes a bond, obtains insurance, or self-insures pursuant to
37	40		Section 25.00231; or
38	41		(2) [(3)] a judge who presides over a county criminal
39	42		court.
40	43		SECTION 2. Section 26.001(a), Government Code, is amended
41	44		to read as follows:
42	45		(a) Before beginning the duties of the office, the county
43	46		judge must execute a bond that:
44	47		(1) is payable to the treasurer of the county;
45	48		(2) is in the amount set by the commissioners court of:
46	49		(A) subject to Paragraph (B), not less than
47	50		$1,000 nor more than $10,000; or
48	51		(B) for a county judge presiding in the county
49	52		court over guardianship proceedings, as defined by Section
50	53		1002.015, Estates Code, or over probate proceedings, as defined by
51	54		Section 22.029, Estates Code, not less than $500,000[:
52	55		[(i) $100,000 for a court in a county with a
53	56		population of 125,000 or less; or
54	57		[(ii) $250,000 for a court in a county with
55	58		a population of more than 125,000]; and
56	59		(3) is conditioned that the judge will:
57	60		(A) faithfully perform all duties of office; and
58	61		(B) for a county judge presiding in the county
59	62		court over guardianship or probate proceedings, perform the duties
60	63		required by the Estates Code.
61	64		SECTION 3. This Act takes effect September 1, 2025.
