69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to bond requirements for certain judges.
912 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1013 SECTION 1. Sections 25.0006(a-1) and (a-4), Government
1114 Code, are amended to read as follows:
1215 (a-1) Before beginning the duties of the office, the judge
1316 of a statutory county court must execute a bond that:
1417 (1) is payable to the treasurer of the county;
1518 (2) is in the amount set by the commissioners court of:
1619 (A) subject to Paragraph (B), not less than
1720 $1,000 nor more than $10,000; or
1821 (B) for a judge presiding in the court over
1922 guardianship proceedings, as defined by Section 1002.015, Estates
2023 Code, or over probate proceedings, as defined by Section 22.029,
2124 Estates Code, not less than $500,000[:
2225 [(i) $100,000 for a court in a county with a
2326 population of 125,000 or less; or
2427 [(ii) $250,000 for a court in a county with
2528 a population of more than 125,000]; and
2629 (3) is conditioned that the judge will:
2730 (A) faithfully perform all duties of office; and
2831 (B) for a judge presiding in the court over
2932 guardianship or probate proceedings, perform the duties required by
3033 the Estates Code.
3134 (a-4) This section does not apply to:
3235 (1) [a judge of a statutory county court who does not
3336 preside over guardianship proceedings, as defined by Section
3437 1002.015, Estates Code;
3538 [(2)] a judge of a statutory probate court who
3639 executes a bond, obtains insurance, or self-insures pursuant to
3740 Section 25.00231; or
3841 (2) [(3)] a judge who presides over a county criminal
3942 court.
4043 SECTION 2. Section 26.001(a), Government Code, is amended
4144 to read as follows:
4245 (a) Before beginning the duties of the office, the county
4346 judge must execute a bond that:
4447 (1) is payable to the treasurer of the county;
4548 (2) is in the amount set by the commissioners court of:
4649 (A) subject to Paragraph (B), not less than
4750 $1,000 nor more than $10,000; or
4851 (B) for a county judge presiding in the county
4952 court over guardianship proceedings, as defined by Section
5053 1002.015, Estates Code, or over probate proceedings, as defined by
5154 Section 22.029, Estates Code, not less than $500,000[:
5255 [(i) $100,000 for a court in a county with a
5356 population of 125,000 or less; or
5457 [(ii) $250,000 for a court in a county with
5558 a population of more than 125,000]; and
5659 (3) is conditioned that the judge will:
5760 (A) faithfully perform all duties of office; and
5861 (B) for a county judge presiding in the county
5962 court over guardianship or probate proceedings, perform the duties
6063 required by the Estates Code.
6164 SECTION 3. This Act takes effect September 1, 2025.
