| 12 | 12 | SECTION 1. Section 39.167(a), Utilities Code, as added by | |
| 13 | 13 | Chapter 892 (H.B. 5066), Acts of the 88th Legislature, Regular | |
| 14 | 14 | Session, 2023, is amended to read as follows: | |
| 15 | 15 | (a) The [Not later than January 30, 2024, the] commission | |
| 16 | 16 | shall direct the independent organization certified under Section | |
| 17 | 17 | 39.151 for the ERCOT power region to develop a reliability plan | |
| 18 | 18 | under Section 39.166 for the Permian Basin region and update the | |
| 19 | 19 | plan every five years. | |
| 20 | 20 | SECTION 2. Section 39.167(c), Utilities Code, as added by | |
| 21 | 21 | Chapter 892 (H.B. 5066), Acts of the 88th Legislature, Regular | |
| 22 | 22 | Session, 2023, is repealed. | |
| 23 | 23 | SECTION 3. This Act takes effect September 1, 2025. |
