| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Article 55A.005, Code of Criminal Procedure, is | |
| 14 | 14 | amended to read as follows: | |
| 15 | 15 | Art. 55A.005. UNLAWFUL CARRYING OF HANDGUN. A person to | |
| 16 | 16 | whom this subchapter applies is entitled to have all records and | |
| 17 | 17 | files relating to the arrest expunged if: | |
| 18 | 18 | (1) the person was: | |
| 19 | 19 | (A) tried for and convicted of the offense for | |
| 20 | 20 | which the person was arrested; or | |
| 21 | 21 | (B) placed on deferred adjudication community | |
| 22 | 22 | supervision under Subchapter C, Chapter 42A, for the offense for | |
| 23 | 23 | which the person was arrested; and | |
| 24 | 24 | (2) the offense was committed before September 1, | |
| 25 | 25 | 2021, under Section 46.02(a), Penal Code, as that section existed | |
| 26 | 26 | before that date. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
