14 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 13 | | SECTION 1. Section 111.004, Occupations Code, is amended by |
---|
16 | 14 | | adding Subsections (c), (d), and (e) to read as follows: |
---|
17 | 15 | | (c) Each agency with regulatory authority over a health |
---|
18 | 16 | | professional providing a telemedicine medical service, |
---|
19 | 17 | | teledentistry dental service, or telehealth service shall adopt |
---|
20 | 18 | | rules necessary to standardize formats for and retention of records |
---|
21 | 19 | | related to a patient's consent to: |
---|
22 | 20 | | (1) treatment; |
---|
23 | 21 | | (2) data collection; and |
---|
24 | 22 | | (3) data sharing. |
---|
25 | 23 | | (d) Rules adopted under Subsection (c) must: |
---|
26 | 24 | | (1) as applicable, address the specific consent |
---|
27 | 25 | | documentation required for: |
---|
28 | 26 | | (A) telemedicine medical services; |
---|
29 | 27 | | (B) teledentistry dental services; or |
---|
30 | 28 | | (C) telehealth services; and |
---|
31 | 29 | | (2) include provisions, based on the appropriate |
---|
32 | 30 | | standard of care, for consent documentation in an audio-only |
---|
33 | 31 | | format. |
---|
34 | 32 | | (e) Rules adopted under this section must require that a |
---|
35 | 33 | | health professional conduct an in-person examination of a patient |
---|
36 | 34 | | before an irreversible medical procedure is initiated. |
---|
37 | 35 | | SECTION 2. This Act takes effect September 1, 2025. |
