97 A BILL TO BE ENTITLED
108 AN ACT
119 relating to rules regarding the provision by a health professional
1210 of a telemedicine medical service, teledentistry dental service, or
1311 telehealth service.
1412 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1513 SECTION 1. Section 111.004, Occupations Code, is amended by
1614 adding Subsections (c), (d), and (e) to read as follows:
1715 (c) Each agency with regulatory authority over a health
1816 professional providing a telemedicine medical service,
1917 teledentistry dental service, or telehealth service shall adopt
2018 rules necessary to standardize formats for and retention of records
2119 related to a patient's consent to:
2220 (1) treatment;
2321 (2) data collection; and
2422 (3) data sharing.
2523 (d) Rules adopted under Subsection (c) must:
2624 (1) as applicable, address the specific consent
2725 documentation required for:
2826 (A) telemedicine medical services;
2927 (B) teledentistry dental services; or
3028 (C) telehealth services; and
3129 (2) include provisions, based on the appropriate
3230 standard of care, for consent documentation in an audio-only
3331 format.
3432 (e) Rules adopted under this section must require that a
3533 health professional conduct an in-person examination of a patient
3634 before an irreversible medical procedure is initiated.
3735 SECTION 2. This Act takes effect September 1, 2025.
