10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 9502.0201(i), Special District Local |
---|
12 | 12 | | Laws Code, is amended to read as follows: |
---|
13 | 13 | | (i) The governor[board] shall appoint[elect] a presiding |
---|
14 | 14 | | officer from among the directors to serve in that position for two |
---|
15 | 15 | | years. A director may serve as the presiding officer for not more |
---|
16 | 16 | | than two consecutive terms. |
---|
17 | 17 | | SECTION 2. Section 9502.0301, Special District Local Laws |
---|
18 | 18 | | Code, is amended by adding Subsection (f) to read as follows: |
---|
19 | 19 | | (f) Implementation of a project described by Subsection (a) |
---|
20 | 20 | | shall not compromise navigation safety or two-way traffic vessel |
---|
21 | 21 | | movement as required by Subchapter B, Chapter 66, Transportation |
---|
22 | 22 | | Code. |
---|
23 | 23 | | SECTION 3. Section 9502.0302, Special District Local Laws |
---|
24 | 24 | | Code, is amended to read as follows: |
---|
25 | 25 | | Sec. 9502.0302. TAXES AND BONDS. (a) Subject to Subsection |
---|
26 | 26 | | (d), the[The] district must hold an election in the manner provided |
---|
27 | 27 | | by Chapter 49, Water Code, to obtain voter approval before the |
---|
28 | 28 | | district may impose an ad valorem tax or issue bonds payable from ad |
---|
29 | 29 | | valorem taxes. |
---|
30 | 30 | | (b) The board may impose the tax at a rate not to exceed 5 |
---|
31 | 31 | | cents on each $100 valuation. |
---|
32 | 32 | | (c) The district, without an election, may issue bonds, |
---|
33 | 33 | | notes, or other obligations secured by revenue other than ad |
---|
34 | 34 | | valorem taxes. |
---|
35 | 35 | | (d) The threshold for voter approval of an ad valorem tax |
---|
36 | 36 | | imposed by the district under this section is 67 percent[The |
---|
37 | 37 | | district may grant an abatement for a tax owed to the district in |
---|
38 | 38 | | the manner provided by Chapter 312, Tax Code]. |
---|
39 | 39 | | SECTION 4. This Act takes effect immediately if it receives |
---|
40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
43 | 43 | | Act takes effect September 1, 2025. |
