66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the management and operation of the Gulf Coast
99 Protection District.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 9502.0201(i), Special District Local
1212 Laws Code, is amended to read as follows:
1313 (i) The governor[board] shall appoint[elect] a presiding
1414 officer from among the directors to serve in that position for two
1515 years. A director may serve as the presiding officer for not more
1616 than two consecutive terms.
1717 SECTION 2. Section 9502.0301, Special District Local Laws
1818 Code, is amended by adding Subsection (f) to read as follows:
1919 (f) Implementation of a project described by Subsection (a)
2020 shall not compromise navigation safety or two-way traffic vessel
2121 movement as required by Subchapter B, Chapter 66, Transportation
2222 Code.
2323 SECTION 3. Section 9502.0302, Special District Local Laws
2424 Code, is amended to read as follows:
2525 Sec. 9502.0302. TAXES AND BONDS. (a) Subject to Subsection
2626 (d), the[The] district must hold an election in the manner provided
2727 by Chapter 49, Water Code, to obtain voter approval before the
2828 district may impose an ad valorem tax or issue bonds payable from ad
2929 valorem taxes.
3030 (b) The board may impose the tax at a rate not to exceed 5
3131 cents on each $100 valuation.
3232 (c) The district, without an election, may issue bonds,
3333 notes, or other obligations secured by revenue other than ad
3434 valorem taxes.
3535 (d) The threshold for voter approval of an ad valorem tax
3636 imposed by the district under this section is 67 percent[The
3737 district may grant an abatement for a tax owed to the district in
3838 the manner provided by Chapter 312, Tax Code].
3939 SECTION 4. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2025.
