| 9 | 9 | | relating to the authority of a governmental body to require certain |

| 10 | 10 | | persons to sign a confidentiality agreement in response to a |
|---|
| 11 | 11 | | request for public information for legislative purposes under the |
|---|
| 12 | 12 | | public information law. |
|---|
| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 552.008, Government Code, is amended by |
|---|
| 15 | 15 | | adding Subsections (b-3) and (b-4) to read as follows: |
|---|
| 16 | 16 | | (b-3) A governmental body shall provide written |
|---|
| 17 | 17 | | notification to a member, committee, or agency of the legislature |
|---|
| 18 | 18 | | that requests information under this section if the governmental |
|---|
| 19 | 19 | | body will require a person to sign a confidentiality agreement |
|---|
| 20 | 20 | | under Subsection (b) regarding the requested information. The |
|---|
| 21 | 21 | | governmental body must provide the notice to the requesting member, |
|---|
| 22 | 22 | | committee, or agency not later than the fifth business day |
|---|
| 23 | 23 | | following the date the governmental body receives the request for |
|---|
| 24 | 24 | | the information that is the subject of the notice. |
|---|
| 25 | 25 | | (b-4) Notwithstanding Subsection (b), a governmental body |
|---|
| 26 | 26 | | may not require a person to sign a confidentiality agreement |
|---|
| 27 | 27 | | regarding information requested under this section if: |
|---|
| 28 | 28 | | (1) the governmental body fails to provide the notice |
|---|
| 29 | 29 | | required by Subsection (b-3) regarding the information in the time |
|---|
| 30 | 30 | | and manner prescribed by that subsection; or |
|---|
| 31 | 31 | | (2) an agreement regarding the information is not |
|---|
| 32 | 32 | | signed by each party to the agreement before the 10th business day |
|---|
| 33 | 33 | | following the date the notice required by Subsection (b-3) is |
|---|
| 34 | 34 | | received by the requesting member, committee, or agency. |
|---|
| 35 | 35 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 36 | 36 | | a request for information received by a governmental body or |
|---|
| 37 | 37 | | officer for public information on or after the effective date of |
|---|
| 38 | 38 | | this Act. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2025. |
