88 AN ACT
99 relating to the authority of a governmental body to require certain
1010 persons to sign a confidentiality agreement in response to a
1111 request for public information for legislative purposes under the
1212 public information law.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 552.008, Government Code, is amended by
1515 adding Subsections (b-3) and (b-4) to read as follows:
1616 (b-3) A governmental body shall provide written
1717 notification to a member, committee, or agency of the legislature
1818 that requests information under this section if the governmental
1919 body will require a person to sign a confidentiality agreement
2020 under Subsection (b) regarding the requested information. The
2121 governmental body must provide the notice to the requesting member,
2222 committee, or agency not later than the fifth business day
2323 following the date the governmental body receives the request for
2424 the information that is the subject of the notice.
2525 (b-4) Notwithstanding Subsection (b), a governmental body
2626 may not require a person to sign a confidentiality agreement
2727 regarding information requested under this section if:
2828 (1) the governmental body fails to provide the notice
2929 required by Subsection (b-3) regarding the information in the time
3030 and manner prescribed by that subsection; or
3131 (2) an agreement regarding the information is not
3232 signed by each party to the agreement before the 10th business day
3333 following the date the notice required by Subsection (b-3) is
3434 received by the requesting member, committee, or agency.
3535 SECTION 2. The changes in law made by this Act apply only to
3636 a request for information received by a governmental body or
3737 officer for public information on or after the effective date of
3838 this Act.
3939 SECTION 3. This Act takes effect September 1, 2025.
