77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to proof of United States citizenship for the issuance or
1010 renewal of a personal automobile insurance policy.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 1951, Insurance Code, is amended by
1313 adding Section 1951.005 to read as follows:
1414 Sec. 1951.005. PROOF OF CITIZENSHIP REQUIRED. An insurer,
1515 including a county mutual insurance company, may not deliver, issue
1616 for delivery, or renew in this state a personal automobile
1717 insurance policy unless the proposed insured provides to the
1818 insurer one of the following documents as proof of United States
1919 citizenship:
2020 (1) an unexpired passport issued to the insured;
2121 (2) a certified copy of a birth certificate or other
2222 document confirming the insured's birth that is admissible in a
2323 court of law and establishes the insured's identity; or
2424 (3) United States citizenship papers issued to the
2525 insured.
2626 SECTION 2. The change in law made by this Act applies only
2727 to a personal automobile insurance policy that is delivered, issued
2828 for delivery, or renewed on or after January 1, 2026.
2929 SECTION 3. This Act takes effect September 1, 2025.
