77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the eligibility of certain officers of a political
1010 subdivision authorized to impose a tax or issue bonds to hold
1111 certain offices concurrently.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 180, Local Government Code, is amended
1414 by adding Section 180.0055 to read as follows:
1515 Sec. 180.0055. ELIGIBILITY OF CERTAIN ELECTED OR APPOINTED
1616 OFFICERS TO HOLD CERTAIN OTHER OFFICES. (a) This section applies
1717 only to an elected or appointed office of a political subdivision
1818 authorized to impose a tax or issue bonds. This section applies only
1919 to the extent it does not conflict with a provision of the state
2020 constitution.
2121 (b) An officer who holds an office to which this section
2222 applies is not eligible to hold at the same time another office to
2323 which this section applies.
2424 SECTION 2. Not later than the effective date of this Act, an
2525 officer who holds more than one office in violation of Section
2626 180.0055, Local Government Code, as added by this Act, shall
2727 resign, effective on that date, from each office necessary to allow
2828 the officer to be in compliance with the requirement of that
2929 section.
3030 SECTION 3. This Act takes effect September 1, 2025.
