88 AN ACT
99 relating to qualifications for a sheriff or constable or a
1010 candidate for sheriff or constable.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 85.0011(b) and (c), Local Government
1313 Code, are amended to read as follows:
1414 (b) A person is not eligible to serve as sheriff unless the
1515 person:
1616 (1) has a high school diploma or a high school
1717 equivalency certificate; and
1818 (2) either:
1919 (A) holds an active permanent peace officer
2020 license under Chapter 1701, Occupations Code; or
2121 (B) is eligible to be licensed under Sections
2222 1701.309 and 1701.312, Occupations Code, obtains a license
2323 described by Paragraph (A) within the time provided by Section
2424 1701.302(a), Occupations Code, and:
2525 (i) has a minimum of five years of
2626 experience as a federal special investigator; or
2727 (ii) is a military veteran with a minimum of
2828 10 years of combined active duty or national guard service
2929 experience.
3030 (c) A person is not eligible to be a candidate for the office
3131 of sheriff unless the person:
3232 (1) holds an active permanent peace officer license
3333 under Chapter 1701, Occupations Code; [,] or
3434 (2) is a person described by Subsection (b)(2)(B)(i)
3535 or (ii) and intends to obtain [obtains] a license described by
3636 Subdivision (1) within the time provided by Section 1701.302(a),
3737 Occupations Code.
3838 SECTION 2. Subchapter A, Chapter 86, Local Government Code,
3939 is amended by adding Section 86.0025 to read as follows:
4040 Sec. 86.0025. QUALIFICATIONS FOR CONSTABLE OR CANDIDATE FOR
4141 CONSTABLE. (a) In this section, "active duty," "federal special
4242 investigator," and "military veteran" have the meanings assigned by
4343 Section 85.0011.
4444 (b) A person is not eligible to serve as constable unless
4545 the person:
4646 (1) has a high school diploma or a high school
4747 equivalency certificate; and
4848 (2) either:
4949 (A) holds an active permanent peace officer
5050 license under Chapter 1701, Occupations Code; or
5151 (B) is eligible to be licensed under Sections
5252 1701.309 and 1701.312, Occupations Code, obtains a license
5353 described by Paragraph (A) within the time provided by Section
5454 1701.302(a), Occupations Code, and:
5555 (i) has a minimum of five years of
5656 experience as a federal special investigator; or
5757 (ii) is a military veteran with a minimum of
5858 10 years of combined active duty or national guard service
5959 experience.
6060 (c) A person is not eligible to be a candidate for the office
6161 of constable unless the person:
6262 (1) holds an active permanent peace officer license
6363 under Chapter 1701, Occupations Code; or
6464 (2) is a person described by Subsection (b)(2)(B)(i)
6565 or (ii) and intends to obtain a license described by Subdivision (1)
6666 within the time provided by Section 1701.302(a), Occupations Code.
6767 SECTION 3. Section 1701.302(a), Occupations Code, is
6868 amended to read as follows:
6969 (a) Except as provided by Sections 85.0011(b)(2)(A) and
7070 86.0025(b)(2)(A) [Section 85.0011], Local Government Code, an
7171 officer, including a sheriff and constable, elected under the Texas
7272 Constitution or a statute or appointed to fill a vacancy in an
7373 elective office must obtain a license from the commission not later
7474 than the second anniversary of the date the officer takes office.
7575 SECTION 4. Section 86.0021, Local Government Code, is
7676 repealed.
7777 SECTION 5. The changes in law made by this Act do not apply
7878 to a sheriff or constable serving a term that began before the
7979 effective date of this Act. A sheriff or constable serving a term
8080 that began before the effective date of this Act is governed for the
8181 remainder of that term by the law as it existed immediately before
8282 the effective date of this Act, and that law is continued in effect
8383 for that purpose.
8484 SECTION 6. This Act takes effect September 1, 2025.
