97 A BILL TO BE ENTITLED
108 AN ACT
119 relating to the authority of the Harris County Hospital District to
1210 employ and commission peace officers.
1311 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1412 SECTION 1. Section 281.057(a), Health and Safety Code, is
1513 amended to read as follows:
1614 (a) The board of the Dallas County Hospital District, the
1715 Tarrant County Hospital District, the Bexar County Hospital
1816 District, [or] the El Paso County Hospital District, or the Harris
1917 County Hospital District may employ and commission peace officers
2018 for the district.
2119 SECTION 2. Article 2A.001, Code of Criminal Procedure, is
2220 amended to read as follows:
2321 Art. 2A.001. PEACE OFFICERS GENERALLY. The following are
2422 peace officers:
2523 (1) a sheriff, a sheriff's deputy, or a reserve deputy
2624 sheriff who holds a permanent peace officer license issued under
2725 Chapter 1701, Occupations Code;
2826 (2) a constable, a deputy constable, or a reserve
2927 deputy constable who holds a permanent peace officer license issued
3028 under Chapter 1701, Occupations Code;
3129 (3) a marshal or police officer of a municipality or a
3230 reserve municipal police officer who holds a permanent peace
3331 officer license issued under Chapter 1701, Occupations Code;
3432 (4) a ranger, officer, or member of the reserve
3533 officer corps commissioned by the Public Safety Commission and the
3634 director of the Department of Public Safety;
3735 (5) an investigator of a district attorney's, criminal
3836 district attorney's, or county attorney's office;
3937 (6) a law enforcement agent of the Texas Alcoholic
4038 Beverage Commission;
4139 (7) a member of an arson investigating unit
4240 commissioned by a municipality, a county, or the state;
4341 (8) an officer commissioned under Section 37.081,
4442 Education Code, or Subchapter E, Chapter 51, Education Code;
4543 (9) an officer commissioned by the Texas Facilities
4644 Commission;
4745 (10) a law enforcement officer commissioned by the
4846 Parks and Wildlife Commission;
4947 (11) an officer commissioned under Chapter 23,
5048 Transportation Code;
5149 (12) a municipal park and recreational patrol officer
5250 or security officer;
5351 (13) a security officer or investigator commissioned
5452 as a peace officer by the comptroller;
5553 (14) an officer commissioned by a water control and
5654 improvement district under Section 49.216, Water Code;
5755 (15) an officer commissioned by a board of trustees
5856 under Chapter 54, Transportation Code;
5957 (16) an investigator commissioned by the Texas Medical
6058 Board;
6159 (17) an officer commissioned by:
6260 (A) the board of managers of the Dallas County
6361 Hospital District, the Tarrant County Hospital District, the Bexar
6462 County Hospital District, [or] the El Paso County Hospital
6563 District, or the Harris County Hospital District under Section
6664 281.057, Health and Safety Code;
6765 (B) the board of directors of the Ector County
6866 Hospital District under Section 1024.117, Special District Local
6967 Laws Code;
7068 (C) the board of directors of the Midland County
7169 Hospital District of Midland County, Texas, under Section 1061.121,
7270 Special District Local Laws Code; or
7371 (D) the board of hospital managers of the Lubbock
7472 County Hospital District of Lubbock County, Texas, under Section
7573 1053.113, Special District Local Laws Code;
7674 (18) a county park ranger commissioned under
7775 Subchapter E, Chapter 351, Local Government Code;
7876 (19) an investigator employed by the Texas Racing
7977 Commission;
8078 (20) an officer commissioned under Chapter 554,
8179 Occupations Code;
8280 (21) an officer commissioned by the governing body of
8381 a metropolitan rapid transit authority under Section 451.108,
8482 Transportation Code, or a regional transportation authority under
8583 Section 452.110, Transportation Code;
8684 (22) an investigator commissioned by the attorney
8785 general under Section 402.009, Government Code;
8886 (23) a security officer or investigator commissioned
8987 as a peace officer under Chapter 466, Government Code;
9088 (24) an officer appointed by an appellate court under
9189 Subchapter F, Chapter 53, Government Code;
9290 (25) an officer commissioned by the state fire marshal
9391 under Chapter 417, Government Code;
9492 (26) an investigator commissioned by the commissioner
9593 of insurance under Section 701.104, Insurance Code;
9694 (27) an apprehension specialist or inspector general
9795 commissioned by the Texas Juvenile Justice Department as an officer
9896 under Section 242.102 or 243.052, Human Resources Code;
9997 (28) an officer appointed by the inspector general of
10098 the Texas Department of Criminal Justice under Section 493.019,
10199 Government Code;
102100 (29) an investigator commissioned by the Texas
103101 Commission on Law Enforcement under Section 1701.160, Occupations
104102 Code;
105103 (30) a fire marshal or any related officer, inspector,
106104 or investigator commissioned by a county under Subchapter B,
107105 Chapter 352, Local Government Code;
108106 (31) a fire marshal or any officer, inspector, or
109107 investigator commissioned by an emergency services district under
110108 Chapter 775, Health and Safety Code;
111109 (32) an officer commissioned by the State Board of
112110 Dental Examiners under Section 254.013, Occupations Code, subject
113111 to the limitations imposed by that section; and
114112 (33) an investigator commissioned by the Texas
115113 Juvenile Justice Department as an officer under Section 221.011,
116114 Human Resources Code.
117115 SECTION 3. This Act takes effect immediately if it receives
118116 a vote of two-thirds of all the members elected to each house, as
119117 provided by Section 39, Article III, Texas Constitution. If this
120118 Act does not receive the vote necessary for immediate effect, this
121119 Act takes effect September 1, 2025.
