88 AN ACT
99 relating to the establishment of a property value study hardship
1010 grant program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 48, Education Code, is
1313 amended by adding Section 48.282 to read as follows:
1414 Sec. 48.282. PROPERTY VALUE STUDY HARDSHIP GRANTS. (a) For
1515 the 2025-2026 and 2026-2027 school years, from money appropriated
1616 for purposes of this section, the commissioner may administer a
1717 grant program to provide grants to eligible school districts to
1818 offset a reduction in the district's funding under the Foundation
1919 School Program resulting from the use of the state value for the
2020 district's taxable value of property as provided by Section
2121 403.302(c), Government Code, for the 2024 and 2025 tax years.
2222 (b) The amount of a grant awarded under this section is the
2323 difference, if that difference is greater than zero, between:
2424 (1) the funding the school district would have
2525 received under Chapter 46, this chapter, and Chapter 49 for the
2626 applicable school year if the local value for the district's
2727 taxable value of property was used for the applicable tax year; and
2828 (2) the funding to which the district is entitled
2929 under Chapter 46, this chapter, and Chapter 49 for the applicable
3030 school year.
3131 (c) An open-enrollment charter school is not eligible to
3232 receive a grant under this section.
3333 (d) Funding provided to a school district under this section
3434 is in addition to all other funding provided under Chapter 46, this
3535 chapter, and Chapter 49.
3636 (e) The commissioner may require a school district to
3737 submit, or request from a state agency or a political subdivision of
3838 this state, additional information as needed to make a
3939 determination under this section.
4040 (f) The total amount of grants awarded under this section
4141 for a school year may not exceed $175 million.
4242 (g) In awarding grants under this section, the commissioner
4343 shall prioritize school districts experiencing the greatest
4444 percentage reduction in funding described by Subsection (a).
4545 (h) The commissioner may not adjust the amount of a grant
4646 awarded under this section based on data revisions received after
4747 the grant has been awarded.
4848 (i) A determination by the commissioner under this section
4949 is final and may not be appealed.
5050 (j) This section expires September 1, 2027.
5151 SECTION 2. This Act takes effect September 1, 2025.
