11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter F, Chapter 48, Education Code, is |
---|
13 | 13 | | amended by adding Section 48.282 to read as follows: |
---|
14 | 14 | | Sec. 48.282. PROPERTY VALUE STUDY HARDSHIP GRANTS. (a) For |
---|
15 | 15 | | the 2025-2026 and 2026-2027 school years, from money appropriated |
---|
16 | 16 | | for purposes of this section, the commissioner may administer a |
---|
17 | 17 | | grant program to provide grants to eligible school districts to |
---|
18 | 18 | | offset a reduction in the district's funding under the Foundation |
---|
19 | 19 | | School Program resulting from the use of the state value for the |
---|
20 | 20 | | district's taxable value of property as provided by Section |
---|
21 | 21 | | 403.302(c), Government Code, for the 2024 and 2025 tax years. |
---|
22 | 22 | | (b) The amount of a grant awarded under this section is the |
---|
23 | 23 | | difference, if that difference is greater than zero, between: |
---|
24 | 24 | | (1) the funding the school district would have |
---|
25 | 25 | | received under Chapter 46, this chapter, and Chapter 49 for the |
---|
26 | 26 | | applicable school year if the local value for the district's |
---|
27 | 27 | | taxable value of property was used for the applicable tax year; and |
---|
28 | 28 | | (2) the funding to which the district is entitled |
---|
29 | 29 | | under Chapter 46, this chapter, and Chapter 49 for the applicable |
---|
30 | 30 | | school year. |
---|
31 | 31 | | (c) An open-enrollment charter school is not eligible to |
---|
32 | 32 | | receive a grant under this section. |
---|
33 | 33 | | (d) Funding provided to a school district under this section |
---|
34 | 34 | | is in addition to all other funding provided under Chapter 46, this |
---|
35 | 35 | | chapter, and Chapter 49. |
---|
36 | 36 | | (e) The commissioner may require a school district to |
---|
37 | 37 | | submit, or request from a state agency or a political subdivision of |
---|
38 | 38 | | this state, additional information as needed to make a |
---|
39 | 39 | | determination under this section. |
---|
40 | 40 | | (f) The total amount of grants awarded under this section |
---|
41 | 41 | | for a school year may not exceed $175 million. |
---|
42 | 42 | | (g) In awarding grants under this section, the commissioner |
---|
43 | 43 | | shall prioritize school districts experiencing the greatest |
---|
44 | 44 | | percentage reduction in funding described by Subsection (a). |
---|
45 | 45 | | (h) The commissioner may not adjust the amount of a grant |
---|
46 | 46 | | awarded under this section based on data revisions received after |
---|
47 | 47 | | the grant has been awarded. |
---|
48 | 48 | | (i) A determination by the commissioner under this section |
---|
49 | 49 | | is final and may not be appealed. |
---|
50 | 50 | | (j) This section expires September 1, 2027. |
---|
51 | 51 | | SECTION 2. This Act takes effect September 1, 2025. |
