69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to the prosecution and punishment of the offense of
912 unlawful production or distribution of certain sexually explicit
1013 media; increasing a criminal penalty.
1114 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1215 SECTION 1. The heading to Section 21.165, Penal Code, is
1316 amended to read as follows:
1417 Sec. 21.165. UNLAWFUL PRODUCTION OR DISTRIBUTION OF CERTAIN
1518 SEXUALLY EXPLICIT MEDIA [VIDEOS].
1619 SECTION 2. Section 21.165(a), Penal Code, is amended by
1720 amending Subdivision (1) and adding Subdivision (3) to read as
1821 follows:
1922 (1) "Deep fake media [video]" means a visual depiction
2023 [a video,] created or altered through [with] the use of software,
2124 machine learning, artificial intelligence, or any other
2225 computer-generated or technological means, including by adapting,
2326 modifying, manipulating, or altering an authentic visual depiction
2427 manually or through an automated process [intent to deceive], that
2528 appears to a reasonable person to depict a real person,
2629 indistinguishable from an authentic visual depiction of the real
2730 person, performing an action that did not occur in reality.
2831 (3) "Visual depiction" means a photograph, motion
2932 picture film, videotape, digital image or video, or other visual
3033 recording.
3134 SECTION 3. Section 21.165, Penal Code, is amended by
3235 amending Subsections (b) and (c) and adding Subsections (b-1),
3336 (c-1), and (c-2) to read as follows:
3437 (b) A person commits an offense if, without the effective
3538 consent of the person appearing to be depicted, the person
3639 knowingly produces or distributes by electronic means [a] deep fake
3740 media [video] that appears to depict the person:
3841 (1) with visible computer-generated intimate parts or
3942 with the visible intimate parts of another human being as the
4043 intimate parts of the person; or
4144 (2) engaging in sexual conduct in which the person did
4245 not engage [with the person's intimate parts exposed or engaged in
4346 sexual conduct].
4447 (b-1) Consent required by Subsection (b) is valid only if
4548 the person appearing to be depicted knowingly and voluntarily
4649 signed a written agreement that was drafted in plain language. The
4750 agreement must include:
4851 (1) a general description of the deep fake media; and
4952 (2) if applicable, the audiovisual work into which the
5053 deep fake media will be incorporated.
5154 (c) An offense under this section is a Class A misdemeanor,
5255 except that the offense is a felony of the third degree if it is
5356 shown on the trial of the offense that the defendant has been
5457 previously convicted of an offense under this section.
5558 (c-1) It is not a defense to prosecution under this section
5659 that the deep fake media:
5760 (1) contains a disclaimer stating that the media was
5861 unauthorized or that the person appearing to be depicted did not
5962 participate in the creation or development of the deep fake media;
6063 or
6164 (2) indicates, through a label or otherwise, that the
6265 depiction is not authentic.
6366 (c-2) It is an affirmative defense to prosecution under this
6467 section that the production or distribution of the deep fake media
6568 occurs in the course of:
6669 (1) lawful and common practices of law enforcement or
6770 medical treatment;
6871 (2) reporting unlawful activity; or
6972 (3) a legal proceeding, if the production or
7073 distribution is permitted or required by law.
7174 SECTION 4. The changes in law made by this Act apply only to
7275 an offense committed on or after the effective date of this Act. An
7376 offense committed before the effective date of this Act is governed
7477 by the law in effect on the date the offense was committed, and the
7578 former law is continued in effect for that purpose. For purposes of
7679 this section, an offense was committed before the effective date of
7780 this Act if any element of the offense occurred before that date.
7881 SECTION 5. This Act takes effect September 1, 2025.
