77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a requirement that certain special purpose districts
1010 cause certain information to be posted on an Internet website.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2051.202, Government Code, is amended by
1313 amending Subsections (a), (b), and (d) and adding Subsections (b-1)
1414 and (e) to read as follows:
1515 (a) In this section, "special purpose district" has the
1616 meaning assigned by Section 403.0241 [means a political subdivision
1717 of this state with geographic boundaries that define the
1818 subdivision's territorial jurisdiction. The term does not include
1919 a municipality, county, junior college district, independent
2020 school district, groundwater conservation district, river
2121 authority, or political subdivision with statewide jurisdiction].
2222 (b) This section applies only to a special purpose district
2323 described by Section 403.0241(b) [that:
2424 [(1) is authorized by the state by a general or special
2525 law to impose an ad valorem tax;
2626 [(2) during the most recent fiscal year imposed an ad
2727 valorem tax;
2828 [(3) during the most recent fiscal year:
2929 [(A) had bonds outstanding;
3030 [(B) had gross receipts from operations, loans,
3131 taxes, or contributions in excess of $250,000; or
3232 [(C) had cash and temporary investments in excess
3333 of $250,000; and
3434 [(4) at the beginning of the most recent fiscal year,
3535 had a population of 500 or more, as determined by the governing body
3636 of the special purpose district].
3737 (b-1) This section does not apply to a groundwater
3838 conservation district or a river authority.
3939 (d) A special purpose district shall post or cause to be
4040 posted on an Internet website the following information, if
4141 applicable:
4242 (1) the name of the special purpose district;
4343 (2) the name and term of office of each member of the
4444 governing body of the special purpose district;
4545 (3) the contact information for the main office of the
4646 special purpose district, including the physical address, the
4747 mailing address, and the telephone number;
4848 (4) the official contact information for each member
4949 of the governing body of the special purpose district;
5050 (5) if the special purpose district employs a person
5151 as a general manager or executive director, or in another position
5252 to perform duties or functions comparable to those of a general
5353 manager or executive director, the name of the general manager,
5454 executive director, or person that performs those duties;
5555 (6) if the special purpose district contracts with a
5656 utility operator, the contact information for a person representing
5757 the utility operator, including a mailing address and telephone
5858 number;
5959 (7) if the special purpose district contracts with a
6060 tax assessor-collector, the contact information for a person
6161 representing the tax assessor-collector, including a mailing
6262 address and telephone number;
6363 (8) if the special purpose district imposes an ad
6464 valorem tax, the rate of the ad valorem tax of the special purpose
6565 district;
6666 (9) if the special purpose district imposes a sales
6767 and use tax, the rate of the sales and use tax of the special purpose
6868 district;
6969 (10) any notice of tax hearing required to be given
7070 under Chapter 26, Tax Code, or Section 49.236, Water Code;
7171 (11) the location and schedule of meetings of the
7272 governing body of the special purpose district;
7373 (12) a statement substantially similar to the
7474 following: "Residents of the district have the right to request the
7575 designation of a meeting location within the district under Section
7676 49.062(g), Water Code. A description of this process can be found at
7777 (insert link to the Internet website described by Section
7878 49.062(g), Water Code).";
7979 (13) each notice of a meeting of the governing body of
8080 the special purpose district under Subchapter C, Chapter 551, for
8181 meetings conducted in the current calendar year and the immediately
8282 preceding calendar year;
8383 (14) the minutes of a public meeting of the governing
8484 body of the special purpose district under Section 551.021 for
8585 meetings conducted in the current calendar year and the immediately
8686 preceding calendar year; [and]
8787 (15) the most recent financial audit of the special
8888 purpose district; and
8989 (16) if the special purpose district has elected
9090 officers:
9191 (A) the date and location of the next election
9292 for each office; and
9393 (B) the requirements and deadline for filing for
9494 candidacy for each office.
9595 (e) A special purpose district must post the information
9696 required by Subsection (d)(16)(B) continuously for at least one
9797 year before the date of the election for the office.
9898 SECTION 2. Section 2051.201(c), Government Code, is
9999 repealed.
100100 SECTION 3. Section 2051.202(e), Government Code, as added
101101 by this Act, applies only to an office the election for which takes
102102 place after January 1, 2027.
103103 SECTION 4. This Act takes effect September 1, 2025.
