7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to a requirement that certain special purpose districts
10	10	cause certain information to be posted on an Internet website.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 2051.202, Government Code, is amended by
13	13	amending Subsections (a), (b), and (d) and adding Subsections (b-1)
14	14	and (e) to read as follows:
15	15	(a) In this section, "special purpose district" has the
16	16	meaning assigned by Section 403.0241 [means a political subdivision
17	17	of this state with geographic boundaries that define the
18	18	subdivision's territorial jurisdiction. The term does not include
19	19	a municipality, county, junior college district, independent
20	20	school district, groundwater conservation district, river
21	21	authority, or political subdivision with statewide jurisdiction].
22	22	(b) This section applies only to a special purpose district
23	23	described by Section 403.0241(b) [that:
24	24	[(1) is authorized by the state by a general or special
25	25	law to impose an ad valorem tax;
26	26	[(2) during the most recent fiscal year imposed an ad
27	27	valorem tax;
28	28	[(3) during the most recent fiscal year:
29	29	[(A) had bonds outstanding;
30	30	[(B) had gross receipts from operations, loans,
31	31	taxes, or contributions in excess of $250,000; or
32	32	[(C) had cash and temporary investments in excess
33	33	of $250,000; and
34	34	[(4) at the beginning of the most recent fiscal year,
35	35	had a population of 500 or more, as determined by the governing body
36	36	of the special purpose district].
37	37	(b-1) This section does not apply to a groundwater
38	38	conservation district or a river authority.
39	39	(d) A special purpose district shall post or cause to be
40	40	posted on an Internet website the following information, if
41	41	applicable:
42	42	(1) the name of the special purpose district;
43	43	(2) the name and term of office of each member of the
44	44	governing body of the special purpose district;
45	45	(3) the contact information for the main office of the
46	46	special purpose district, including the physical address, the
47	47	mailing address, and the telephone number;
48	48	(4) the official contact information for each member
49	49	of the governing body of the special purpose district;
50	50	(5) if the special purpose district employs a person
51	51	as a general manager or executive director, or in another position
52	52	to perform duties or functions comparable to those of a general
53	53	manager or executive director, the name of the general manager,
54	54	executive director, or person that performs those duties;
55	55	(6) if the special purpose district contracts with a
56	56	utility operator, the contact information for a person representing
57	57	the utility operator, including a mailing address and telephone
58	58	number;
59	59	(7) if the special purpose district contracts with a
60	60	tax assessor-collector, the contact information for a person
61	61	representing the tax assessor-collector, including a mailing
62	62	address and telephone number;
63	63	(8) if the special purpose district imposes an ad
64	64	valorem tax, the rate of the ad valorem tax of the special purpose
65	65	district;
66	66	(9) if the special purpose district imposes a sales
67	67	and use tax, the rate of the sales and use tax of the special purpose
68	68	district;
69	69	(10) any notice of tax hearing required to be given
70	70	under Chapter 26, Tax Code, or Section 49.236, Water Code;
71	71	(11) the location and schedule of meetings of the
72	72	governing body of the special purpose district;
73	73	(12) a statement substantially similar to the
74	74	following: "Residents of the district have the right to request the
75	75	designation of a meeting location within the district under Section
76	76	49.062(g), Water Code. A description of this process can be found at
77	77	(insert link to the Internet website described by Section
78	78	49.062(g), Water Code).";
79	79	(13) each notice of a meeting of the governing body of
80	80	the special purpose district under Subchapter C, Chapter 551, for
81	81	meetings conducted in the current calendar year and the immediately
82	82	preceding calendar year;
83	83	(14) the minutes of a public meeting of the governing
84	84	body of the special purpose district under Section 551.021 for
85	85	meetings conducted in the current calendar year and the immediately
86	86	preceding calendar year; [and]
87	87	(15) the most recent financial audit of the special
88	88	purpose district; and
89	89	(16) if the special purpose district has elected
90	90	officers:
91	91	(A) the date and location of the next election
92	92	for each office; and
93	93	(B) the requirements and deadline for filing for
94	94	candidacy for each office.
95	95	(e) A special purpose district must post the information
96	96	required by Subsection (d)(16)(B) continuously for at least one
97	97	year before the date of the election for the office.
98	98	SECTION 2. Section 2051.201(c), Government Code, is
99	99	repealed.
100	100	SECTION 3. Section 2051.202(e), Government Code, as added
101	101	by this Act, applies only to an office the election for which takes
102	102	place after January 1, 2027.
103	103	SECTION 4. This Act takes effect September 1, 2025.
