11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 2267, Government Code, is |
---|
13 | 13 | | amended by adding Section 2267.067 to read as follows: |

14 | 14 | | Sec. 2267.067. COST SHARING REQUIREMENTS FOR CERTAIN |
---|
15 | 15 | | QUALIFYING PROJECTS. (a) Subject to Subsection (b), a |
---|
16 | 16 | | comprehensive agreement or service contract for a qualifying |
---|
17 | 17 | | project authorizing the operation of a desalination facility, |
---|
18 | 18 | | including a brackish water desalination facility, shall require a |
---|
19 | 19 | | private entity to pay at least 50 percent of the energy costs to |
---|
20 | 20 | | operate the facility. |
---|
21 | 21 | | (b) This section applies only after a desalination facility |
---|
22 | 22 | | charges the first customer for water produced by the facility. |
---|
23 | 23 | | SECTION 2. Section 2267.067, Government Code, as added by |
---|
24 | 24 | | this Act, applies only to a comprehensive agreement or service |
---|
25 | 25 | | contract executed for a qualifying project authorizing the |
---|
26 | 26 | | operation of a desalination facility that begins charging customers |
---|
27 | 27 | | for water produced by the facility on or after the effective date of |
---|
28 | 28 | | this Act. A comprehensive agreement or service contract executed |
---|
29 | 29 | | for the operation of a desalination facility that began charging |
---|
30 | 30 | | customers for water produced by the facility before the effective |
---|
31 | 31 | | date of this Act is governed by the law in effect on the date the |
---|
32 | 32 | | agreement or contract was entered into, and the former law is |
---|
33 | 33 | | continued in effect for that purpose. |
---|
34 | 34 | | SECTION 3. This Act takes effect September 1, 2025. |
