77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to lobbying by former members of the legislature; creating
1010 a criminal offense.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 572, Government Code, is
1313 amended by adding Section 572.062 to read as follows:
1414 Sec. 572.062. FORMER LEGISLATOR: LOBBYING RESTRICTED;
1515 CRIMINAL OFFENSE. (a) In this section, "administrative action,"
1616 "communicates directly with," "legislation," "member of the
1717 executive branch," and "member of the legislative branch" have the
1818 meanings assigned by Section 305.002.
1919 (b) Except as provided by Subsection (c), a former member of
2020 the legislature may not engage in activities that require
2121 registration under Chapter 305 before the date of final adjournment
2222 of the second regular session of the legislature to convene after
2323 the date the person ceases to be a member of the legislature.
2424 (c) Subsection (b) does not apply to a former member of the
2525 legislature who:
2626 (1) communicates directly with a member of the
2727 legislative branch or a member of the executive branch only to
2828 influence legislation or an administrative action on behalf of:
2929 (A) a nonprofit organization that does not
3030 represent a political subdivision of this state;
3131 (B) an individual;
3232 (C) a group of low-income individuals; or
3333 (D) a group of individuals with disabilities; and
3434 (2) does not receive compensation other than
3535 reimbursement for actual expenses for engaging in communication
3636 described by Subdivision (1).
3737 (d) A former member of the legislature who violates this
3838 section commits an offense. An offense under this section is a Class
3939 A misdemeanor.
4040 SECTION 2. Section 572.062, Government Code, as added by
4141 this Act, applies only to a member of the legislature who ceases to
4242 be a member on or after the effective date of this Act.
4343 SECTION 3. This Act takes effect September 1, 2025.
