77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the purchase or sale of human organs; increasing a
1010 criminal penalty.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 48.02(d), Penal Code, is amended to read
1313 as follows:
1414 (d) An offense under [A violation of] this section is a
1515 state jail felony [Class A misdemeanor].
1616 SECTION 2. Subchapter B, Chapter 164, Occupations Code, is
1717 amended by adding Section 164.0571 to read as follows:
1818 Sec. 164.0571. REQUIRED REVOCATION OF LICENSE FOR PROCEDURE
1919 INVOLVING CERTAIN HUMAN ORGANS. The board shall revoke the license
2020 of a physician if the physician knowingly uses a human organ
2121 obtained in violation of Section 48.02, Penal Code, in a medical
2222 procedure.
2323 SECTION 3. Section 48.02(d), Penal Code, as amended by this
2424 Act, applies only to an offense committed on or after the effective
2525 date of this Act. An offense committed before the effective date of
2626 this Act is governed by the law in effect on the date the offense was
2727 committed, and the former law is continued in effect for that
2828 purpose. For purposes of this section, an offense was committed
2929 before the effective date of this Act if any element of the offense
3030 occurred before that date.
3131 SECTION 4. Section 164.0571, Occupations Code, as added by
3232 this Act, applies only to conduct that occurs on or after the
3333 effective date of this Act. Conduct that occurs before the
3434 effective date of this Act is governed by the law in effect on the
3535 date the conduct occurred, and the former law is continued in effect
3636 for that purpose.
3737 SECTION 5. This Act takes effect September 1, 2025.
